| The market regulatory bureaus (departments or commissions) of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps: | | 各省、自治区、直辖市及新疆生产建设兵团市场监督管理局（厅、委）： |
| For the purposes of ensuring the stability of market price order of masks, antiviral drugs, disinfection and sterilization supplies, and related medical devices and other epidemic prevention supplies, as well as grain, oil, meat, eggs, vegetables, milk and other basic commodities for the people's livelihood during the prevention and control of Novel Coronavirus Pneumonia outbreak (hereinafter referred to as the “epidemic situation”), strengthening and regulating the investigation and punishment of illegal acts of forcing up prices conducted by market regulatory departments at all levels, the following guiding opinions are hereby offered in accordance with the Price Law, the Provisions on Administrative Punishments against Price-related Violations of Law and other laws and regulations. | | 为确保新型冠状病毒感染肺炎疫情（以下简称疫情）防控期间口罩、抗病毒药品、消毒杀菌用品、相关医疗器械等防疫用品以及与群众日常生活相关的粮油肉蛋菜奶等基本民生商品市场价格秩序稳定，强化和规范各级市场监管部门查处哄抬价格违法行为，依照《价格法》《价格违法行为行政处罚规定》等法律法规，现提出如下指导意见： |
| I. No business operator may fabricate or disseminate information on increase in prices of epidemic prevention supplies or commodities for the people's livelihood. Any act of fabrication or dissemination by a business operator may be determined as the illegal act of forcing up prices set out in subparagraph (1) of Article 6 of the Provisions on Administrative Punishments against Price-related Violations of Law. | | 一、经营者不得捏造、散布防疫用品、民生商品涨价信息。经营者有捏造或者散布的任意一项行为，即可认定构成《价格违法行为行政处罚规定》第六条第（一）项所规定的哄抬价格违法行为。 |
| II. A business operator falling under any of the following circumstances may be determined as fabricating price rise information. | | 二、经营者存在以下情形的，可以认定为捏造涨价信息。 |
| (1) Fabricating purchase cost. | | （一）虚构购进成本的； |
| (2) Fabricating the information on short supply or sharp increase in market demand in the local area. | | （二）虚构本地区货源紧张或者市场需求激增的； |
| (3) Fabricating the information that other business operators have raised or are going to raise prices. | | （三）虚构其他经营者已经或者准备提价的； |
| (4) Fabricating other information that may push up price expectations for epidemic prevention supplies or commodities for the people's livelihood. | | （四）虚构可能推高防疫用品、民生商品价格预期的其他信息的。 |
| III. A business operator falling under any of the following circumstances may be determined as disseminating price rise information. | | 三、经营者存在以下情形的，可以认定为散布涨价信息。 |
| (1) Disseminating any fabricated price rise information. | | （一）散布捏造的涨价信息的； |
| (2) Disseminating the information that is not fabricated but contains urgent or inducing expressions such as “serious shortage” and “all-round price increase soon,” which results in pushing up price expectations. | | （二）散布的信息虽不属于捏造信息，但使用“严重缺货”“即将全线提价”等紧迫性用语或者诱导性用语，推高价格预期的； |
| (3) Disseminating opinions to call on or induce other business operators to raise prices. | | （三）散布言论，号召或者诱导其他经营者提高价格的； |
| (4) Disseminating other information that may push up the expectations for prices of epidemic prevention supplies or commodities for the people's livelihood. | | （四）散布可能推高防疫用品、民生商品价格预期的其他信息的。 |
IV. A business operator falling under any of the following circumstances may be determined as having constituted the illegal act of forcing up prices as set out in subparagraph (2) of Article 6 of the Provisions on Administrative Punishments against Price-related Violations of Law.
