| Chapter I General Provisions | | 第一章 总 则 |

| Article 1 To regulate drug rehabilitation,help drug addicts get free of drugs, and maintain the social order, this Regulation is formulated in accordance with theNarcotics Control Law of the People's Republic of China. | | 第一条 为了规范戒毒工作，帮助吸毒成瘾人员戒除毒瘾，维护社会秩序，根据《中华人民共和国禁毒法》，制定本条例。 |

| Article 2 The people's government at or above the county level shall establish a drug rehabilitation working mechanism under the uniform leadership of the government, in which the narcotics control committee organizes, coordinates and guides drug rehabilitation work, the related departments perform their respective responsibilities and duties and social forces participate comprehensively. | | 第二条 县级以上人民政府应当建立政府统一领导，禁毒委员会组织、协调、指导，有关部门各负其责，社会力量广泛参与的戒毒工作体制。 |
In the drug rehabilitation work, the principles of “people first, scientific drug rehabilitation, comprehensive treatment, care and assistance” shall be followed, various measures such as voluntary drug rehabilitation, community-based drug rehabilitation, isolated compulsory drug rehabilitation and community-based recovery shall be adopted, and a working system covering drug rehabilitation treatment, recovery guidance and assistance service shall be established. | |
戒毒工作坚持以人为本、科学戒毒、综合矫治、关怀救助的原则，采取自愿戒毒、社区戒毒、强制隔离戒毒、社区康复等多种措施，建立戒毒治疗、康复指导、救助服务兼备的工作体系。 |

| Article 3 The people's government at or above the county level shall, according to the relevant provisions of the state, include the operating funds needed for drug rehabilitation in the fiscal budget of the same level. | | 第三条 县级以上人民政府应当按照国家有关规定将戒毒工作所需经费列入本级财政预算。 |
| |
|
| Article 4 The narcotics control committee established by the local people's government at or above the county level may organize the public security organ, the health administrative department and the department of drug supervision and administration to conduct monitoring and survey of drug addiction, and release to the public the monitoring and survey results. | | 第四条 县级以上地方人民政府设立的禁毒委员会可以组织公安机关、卫生行政和药品监督管理部门开展吸毒监测、调查，并向社会公开监测、调查结果。 |
The public security organ of the local people's government at or above the county level shall be responsible for the testing of suspected drug addicts; register and dynamically manage and control drug addicts according to law; order community-based drug rehabilitation, decide isolated compulsory drug rehabilitation and order community-based recovery according to law; manage the isolated compulsory drug rehabilitation centers and the drug rehabilitation centers of public security organs; and provide guidance and support for community-based drug rehabilitation and community-based recovery. | |
县级以上地方人民政府公安机关负责对涉嫌吸毒人员进行检测，对吸毒人员进行登记并依法实行动态管控，依法责令社区戒毒、决定强制隔离戒毒、责令社区康复，管理公安机关的强制隔离戒毒场所、戒毒康复场所，对社区戒毒、社区康复工作提供指导和支持。 |
The justice administrative department of the local people's government at or above the level of a districted city shall be responsible for managing the isolated compulsory drug rehabilitation centers and the drug rehabilitation centers of the justice administrative departments, and providing guidance and support for community-based drug rehabilitation and community-based recovery. | |
设区的市级以上地方人民政府司法行政部门负责管理司法行政部门的强制隔离戒毒场所、戒毒康复场所，对社区戒毒、社区康复工作提供指导和支持。 |
The health administrative department of the local people's government at or above the county level shall be responsible for the supervision and administration of drug rehabilitation medical institutions, make plans on the setup of drug rehabilitation medical institutions jointly with the public security organ, the justice administrative department and other departments, and provide guidance and support for drug rehabilitation medical services. | |
县级以上地方人民政府卫生行政部门负责戒毒医疗机构的监督管理，会同公安机关、司法行政等部门制定戒毒医疗机构设置规划，对戒毒医疗服务提供指导和支持。 |
The civil affairs, human resources and social security, education and other departments of the local people's government at or above the county level shall, according to their respective functions, provide guidance and support in recovery, vocational skill training and other fields for community-based drug rehabilitation and community-based recovery. | |
县级以上地方人民政府民政、人力资源社会保障、教育等部门依据各自的职责，对社区戒毒、社区康复工作提供康复和职业技能培训等指导和支持。 |

| Article 5 The people's governments of towns (townships) and the sub-district offices of cities shall be responsible for community-based drug rehabilitation and community-based recovery. | | 第五条 乡（镇）人民政府、城市街道办事处负责社区戒毒、社区康复工作。 |
| |
|
| Article 6 To set up the isolated compulsory drug rehabilitation centers and the drug rehabilitation centers, the people's government at the county level or at the level of a districted city shall make reasonable arrangements on distribution, report to the people's government of the corresponding province, autonomous region or municipality directly under the Central Government for approval, and include it in the local planning on national economic and social development. | | 第六条 县级、设区的市级人民政府需要设置强制隔离戒毒场所、戒毒康复场所的，应当合理布局，报省、自治区、直辖市人民政府批准，并纳入当地国民经济和社会发展规划。 |
The construction standards for the isolated compulsory drug rehabilitation centers and the drug rehabilitation centers shall be formulated by the construction department and development and reform department of the State Council jointly with the public security department and justice administrative department of the State Council. | |
强制隔离戒毒场所、戒毒康复场所的建设标准，由国务院建设部门、发展改革部门会同国务院公安部门、司法行政部门制定。 |

| Article 7 There shall be no discrimination against drug addicts subject to drug rehabilitation in enrollment to schools, employment, social security and other aspects. | | 第七条 戒毒人员在入学、就业、享受社会保障等方面不受歧视。 |
The personal information of drug addicts subject to drug rehabilitation shall be kept confidential according to law. Those who have not taken drugs for three years after getting free of drugs shall no longer be subject to the dynamic management and control. | |
对戒毒人员戒毒的个人信息应当依法予以保密。对戒断3年未复吸的人员，不再实行动态管控。 |

| Article 8 The state encourages and supports the participation of social organizations, enterprises, public institutions and individuals in the scientific research, social services and public causes on drug rehabilitation. | | 第八条 国家鼓励、扶持社会组织、企业、事业单位和个人参与戒毒科研、戒毒社会服务和戒毒社会公益事业。 |
Those who have made prominent achievements and remarkable contributions in drug rehabilitation work shall be commended or rewarded according to the relevant provisions of the state. | |
对在戒毒工作中有显著成绩和突出贡献的，按照国家有关规定给予表彰、奖励。 |

| Chapter II Voluntary Drug Rehabilitation | | 第二章 自愿戒毒 |
| |
|
| Article 9 The state encourages drug addicts to voluntarily get free of drugs. Drug addicts may voluntarily go to drug rehabilitation medical institutions to receive drug rehabilitation treatment. A drug addict who voluntarily receives drug rehabilitation treatment shall not be punished by the public security organ for former drug-taking behaviors. | | 第九条 国家鼓励吸毒成瘾人员自行戒除毒瘾。吸毒人员可以自行到戒毒医疗机构接受戒毒治疗。对自愿接受戒毒治疗的吸毒人员，公安机关对其原吸毒行为不予处罚。 |

| Article 10 A drug rehabilitation medical institution shall sign a voluntary drug rehabilitation agreement with a drug addict who voluntarily undergoes drug rehabilitation or his/her guardian, providing for the drug rehabilitation methods and term, confidentiality of the personal information of the drug addict in drug rehabilitation, rules and regulations to be observed by the drug addict, circumstances of termination of drug rehabilitation treatment and other matters and stating the curative effects of drug rehabilitation and risks of drug rehabilitation treatment. | | 第十条 戒毒医疗机构应当与自愿戒毒人员或者其监护人签订自愿戒毒协议，就戒毒方法、戒毒期限、戒毒的个人信息保密、戒毒人员应当遵守的规章制度、终止戒毒治疗的情形等作出约定，并应当载明戒毒疗效、戒毒治疗风险。 |

| Article 11 A drug rehabilitation medical institution shall perform the following obligations: | | 第十一条 戒毒医疗机构应当履行下列义务： |
| |
|
| 1. providing drug addicts who voluntarily undergo drug rehabilitation with consultation and education on the prevention of AIDS and other infectious diseases; | | （一）对自愿戒毒人员开展艾滋病等传染病的预防、咨询教育； |
| |
|
| 2. adopting various treatment measures, such as detoxification treatment, psychological rehabilitation and behavioral correction, to drug addicts who voluntarily undergo drug rehabilitation, and complying with the drug rehabilitation treatment specifications formulated by the health administrative department of the State Council; | | （二）对自愿戒毒人员采取脱毒治疗、心理康复、行为矫治等多种治疗措施，并应当符合国务院卫生行政部门制定的戒毒治疗规范； |
| |
|
| 3. adopting scientific and standard diagnosis and treatment technologies and methods, and using medicines, hospital preparations and medical apparatus that meet the relevant provisions of the state; and | | （三）采用科学、规范的诊疗技术和方法，使用的药物、医院制剂、医疗器械应当符合国家有关规定； |
| |
|
| 4. strengthening drug administration according to law to prevent loss or abuse of narcotics and psychotropic substances. | | （四）依法加强药品管理，防止麻醉药品、精神药品流失滥用。 |
| |
|
| Article 12 A drug addict in drug rehabilitation who meets the conditions for maintenance treatment with drug-relief medicines may, upon his/her application and registration, participate in the maintenance treatment with drug-relief medicines. The information on drug addicts who register to participate in the maintenance treatment with drug-relief medicines shall be timely filed with the public security organ. | | 第十二条 符合参加戒毒药物维持治疗条件的戒毒人员，由本人申请，并经登记，可以参加戒毒药物维持治疗。登记参加戒毒药物维持治疗的戒毒人员的信息应当及时报公安机关备案。 |
The measures for the administration of maintenance treatment with drug-relief medicines shall be formulated by the health administrative department of the State Council jointly with the public security department and department of drug supervision and administration of the State Council. | |
戒毒药物维持治疗的管理办法，由国务院卫生行政部门会同国务院公安部门、药品监督管理部门制定。 |
| |
|
| Chapter III Community-based Drug Rehabilitation | | 第三章 社区戒毒 |
| |
|
| Article 13 The public security organ of the people's government at the level of a county or a districted city may order a drug addict to receive community-based drug rehabilitation, issue a written decision on ordering community-based drug rehabilitation, serve the decision upon the drug addict and his/her relatives, and notify the people's government of the town (township) or sub-district office of the city where his/her registered permanent residence is located or his/her current residence is located. | | 第十三条 对吸毒成瘾人员，县级、设区的市级人民政府公安机关可以责令其接受社区戒毒，并出具责令社区戒毒决定书，送达本人及其家属，通知本人户籍所在地或者现居住地乡（镇）人民政府、城市街道办事处。 |

| Article 14 A drug addict subject to community-based drug rehabilitation shall, within 15 days from the date of receiving a written decision on ordering community-based drug rehabilitation, register at the people's government of the town (township)or the sub-district office of the city where the community-based drug rehabilitation is executed, and the drug addict shall be deemed to have refused to receive community-based drug rehabilitation if he/she fails to register within the prescribed time limit without any good reason. | | 第十四条 社区戒毒人员应当自收到责令社区戒毒决定书之日起15日内到社区戒毒执行地乡（镇）人民政府、城市街道办事处报到，无正当理由逾期不报到的，视为拒绝接受社区戒毒。 |
The term of community-based drug rehabilitation shall be three years, starting from the date of registration. | |
社区戒毒的期限为3年，自报到之日起计算。 |

| Article 15 The people's government of a town (township) or the sub-district office of a city shall, as needed by work, establish a leading group for community-based drug rehabilitation, have full-time personnel for community-based drug rehabilitation, make work plans on community-based drug rehabilitation, and give effect to community-based drug rehabilitation measures. | | 第十五条 乡（镇）人民政府、城市街道办事处应当根据工作需要成立社区戒毒工作领导小组，配备社区戒毒专职工作人员，制定社区戒毒工作计划，落实社区戒毒措施。 |

| Article 16 The people's government of a town (township) or the sub-district office of a city shall timely sign a community-based drug rehabilitation agreement with a drug addict subject to community-based drug rehabilitation after his/her registration, clarifying the specific community-based drug rehabilitation measures, the provisions to be observed by the drug addict and the liabilities for violation of the community-based drug rehabilitation agreement. | | 第十六条 乡（镇）人民政府、城市街道办事处，应当在社区戒毒人员报到后及时与其签订社区戒毒协议，明确社区戒毒的具体措施、社区戒毒人员应当遵守的规定以及违反社区戒毒协议应承担的责任。 |

| Article 17 The full-time personnel for community-based drug rehabilitation, the people's police in a community, the medical personnel in a community, the family members of drug addicts subject to community-based drug rehabilitation and narcotics control volunteers shall jointly form a community-based drug rehabilitation working team to carry out the specific work on community-based drug rehabilitation. | | 第十七条 社区戒毒专职工作人员、社区民警、社区医务人员、社区戒毒人员的家庭成员以及禁毒志愿者共同组成社区戒毒工作小组具体实施社区戒毒。 |

Article 18 The people's government of a town (township), the sub-district office of a city and the community-based drug rehabilitation working team shall take the following measures to manage and help drug addicts subject to community-based drug rehabilitation:
