最高人民法院关于明田（湖南）企业有限公司与衡阳市殡葬事业管理处、衡阳市民政局解除合同纠纷一案的请示的复函

湖南省高级人民法院：
你院（2008）湘高法民三初字第1号“关于原告（反诉被告）明田（湖南）企业有限公司与被告（反诉原告）衡阳市殡葬事业管理处、衡阳市民政局解除合同纠纷一案的请示”收悉。经研究，答复如下：
国务院1997年7月21日发布实施的《殡葬管理条例》第八条第二款规定的“外资”，是指经我国有关部门批准直接进入我国境内的外国企业、个人或者其他经济组织的投资。香港、澳门、台湾地区的企业、个人或者其他经济组织直接进入大陆境内的投资参照外资办理。明田（湖南）企业有限公司系在大陆境内设立的港资、台资合资企业，其投资建设衡阳市新殡仪馆项目，不适用上述《殡葬管理条例》第八条第二款之审批规定。
