食用菌菌种管理办法

(Issued in Order No. 62 of the Ministry of Agriculture on March 27, 2006 and revised in Order No. 5 [2013] of the Ministry of Agriculture on December 31, 2013) (2006年3月27日农业部令第62号公布 2013年12月31日农业部令2013年第5号修订)
 

Chapter I General Provisions 

第一章 总则

Article 1 To protect and utilize the germplasm resources of edible fungi in a reasonable manner, regulate the breeding of varieties of edible fungi and the production, business operation, use and management of pure cultures of edible fungi (hereinafter referred to as “cultures”), these Measures are formulated in accordance with the Seed Law of the People's Republic of China.   第一条 为保护和合理利用食用菌种质资源,规范食用菌品种选育及食用菌菌种(以下简称菌种)的生产、经营、使用和管理,根据《中华人民共和国种子法》,制定本办法。
Article 2 Whoever engages in the breeding of varieties of edible fungi and the production, business operation, use and management of cultures within the People's Republic of China shall follow these Measures.   第二条 在中华人民共和国境内从事食用菌品种选育和菌种生产、经营、使用、管理等活动,应当遵守本办法。
Article 3 The term “cultures” under these Measures refers to propagation materials composed of mycelia of edible fungi and their substrates.   第三条 本办法所称菌种是指食用菌菌丝体及其生长基质组成的繁殖材料。
Cultures are divided into three grades: stock cultures (Grade I), original cultures (Grade II) and cultivars (Grade III). 菌种分为母种(一级种)、原种(二级种)和栽培种(三级种)三级。
Article 4 The Ministry of Agriculture shall be in charge of the nationwide work on cultures. The competent administrative departments of agriculture (or edible fungi, hereinafter the same) of local people's governments at or above the county level shall be responsible for the administration of cultures within their respective administrative regions.   第四条 农业部主管全国菌种工作。县级以上地方人民政府农业(食用菌,下同)行政主管部门负责本行政区域内的菌种管理工作。
Article 5 The competent administrative departments of agriculture of local people's governments at or above the county level shall strengthen the protection of germplasm resources of edible fungi and the breeding, production, renovation and promotion of quality cultures, and encourage the combination of breeding, production and business operation.   第五条 县级以上地方人民政府农业行政主管部门应当加强食用菌种质资源保护和良种选育、生产、更新、推广工作,鼓励选育、生产、经营相结合。
 

Chapter II Germplasm Resource Protection and Variety Breeding 

第二章 种质资源保护和品种选育

Article 6 The state shall protect germplasm resources of edible fungi, which no entity or individual may encroach upon or damage.   第六条 国家保护食用菌种质资源,任何单位和个人不得侵占和破坏。
Article 7 Collection of germplasm resources of natural edible fungi under key protection by the state is prohibited. Where scientific research or other special circumstances indeed require collection thereof, the collection formalities shall be handled in accordance with law.   第七条 禁止采集国家重点保护的天然食用菌种质资源。确因科研等特殊情况需要采集的,应当依法申请办理采集手续。
Article 8 Provision of germplasm resources of edible fungi (including cultivating substrates with mycelia and fruiting bodies used for culture separation) for a party overseas by any entity or individual shall, upon review by the competent administrative department of agriculture of the people's government at the provincial level at the place where the entity or individual is located, be submitted to the Ministry of Agriculture for approval.   第八条 任何单位和个人向境外提供食用菌种质资源(包括长有菌丝体的栽培基质及用于菌种分离的子实体),应当经所在地省级人民政府农业行政主管部门审核,报农业部批准。
Article 9 Cultures imported from overseas shall be subject to quarantine in accordance with law. Moreover, within 30 days after the cultures are imported, an appropriate quantity thereof shall be sent to and kept at the Agricultural Culture Collection of China.   第九条 从境外引进菌种,应当依法检疫,并在引进后30日内,送适量菌种至中国农业微生物菌种保藏管理中心保存。
Article 10 The state shall encourage entities and individuals to engage in breeding and development of varieties of edible fungi and lend its support, encourage the collaboration between scientific research entities and enterprises to breed new varieties, and guide enterprises in their investments in new variety breeding.   第十条 国家鼓励和支持单位和个人从事食用菌品种选育和开发,鼓励科研单位与企业相结合选育新品种,引导企业投资选育新品种。
Whoever breeds a new variety may apply for new plant variety rights in accordance with law, and the state shall protect the legitimate rights and interests of variety right owners. 选育的新品种可以依法申请植物新品种权,国家保护品种权人的合法权益。
Article 11 Breeders (or importers) of varieties of edible fungi may voluntarily apply to the National Service Center for Promotion of Agricultural Technologies for variety certification. The National Service Center for Promotion of Agricultural Technologies shall establish a variety certification committee for edible fungi to handle technical evaluation for variety certification.   第十一条 食用菌品种选育(引进)者可自愿向全国农业技术推广服务中心申请品种认定。全国农业技术推广服务中心成立食用菌品种认定委员会,承担品种认定的技术鉴定工作。
Article 12 Names of varieties of edible fungi shall be standardized. The specific naming rules shall be separately set out by the Ministry of Agriculture.   第十二条 食用菌品种名称应当规范。具体命名规则由农业部另行规定。
 

Chapter III Culture Production and Business Operation 

第三章 菌种生产和经营

Article 13 Any entity or individual engaging in culture production and business operation shall obtain a License for the Production and Business Operation of Pure Cultures of Edible Fungi.   第十三条 从事菌种生产经营的单位和个人,应当取得《食用菌菌种生产经营许可证》。
Where an entity or individual only engages in business operations involving cultivars, the entity or individual does not have to obtain the License for the Production and Business Operation of Pure Cultures of Edible Fungi. However, the business operator shall be equipped with relevant knowledge about cultures, have appropriate culture storage equipment and facilities, and file for recordation with the competent administrative department of agriculture of the people's government at the county level. 仅从事栽培种经营的单位和个人,可以不办理《食用菌菌种生产经营许可证》,但经营者要具备菌种的相关知识,具有相应的菌种贮藏设备和场所,并报县级人民政府农业行政主管部门备案。
Article 14 A License for the Production and Business Operation of Pure Cultures of Edible Fungi with regard to stock cultures or original cultures shall be reviewed by the competent administrative department of agriculture of the people's government at the county level at the place where the business is located, issued by the competent administrative department of agriculture of the people's government at the provincial level, and filed with the Ministry of Agriculture for recordation.   第十四条 母种和原种《食用菌菌种生产经营许可证》,由所在地县级人民政府农业行政主管部门审核,省级人民政府农业行政主管部门核发,报农业部备案。
A License for the Production and Business Operation of Pure Cultures of Edible Fungi with regard to cultivars shall be issued by the competent administrative department of agriculture of the people's government at the county level at the place where the business is located, and filed with the competent administrative department of agriculture of the people's government at the provincial level for recordation. 栽培种《食用菌菌种生产经营许可证》由所在地县级人民政府农业行政主管部门核发,报省级人民政府农业行政主管部门备案。
Article 15 Where an entity or individual applies for a License for the Production and Business Operation of Pure Cultures of Edible Fungi with regard to stock cultures or original cultures, the entity or individual shall satisfy the following conditions:   第十五条 申请母种和原种《食用菌菌种生产经营许可证》的单位和个人,应当具备下列条件:
(1) For production and business operations involving stock cultures, the registered capital shall be no less than 1,000,000 yuan. For production and business operations involving original cultures, the registered capital shall be no less than 500,000 yuan. (一)生产经营母种注册资本100万元以上,生产经营原种注册资本50万元以上;
(2) There shall be no less than one inspector who has passed the examination of the competent administrative department of agriculture of the people's government at the provincial level and no less than two production technicians. (二)省级人民政府农业行政主管部门考核合格的检验人员1名以上、生产技术人员2名以上;
(3) There shall be appropriate equipment and facilities for sterilization, inoculation, breeding, storage and other purposes, as well as appropriate appliances and facilities for quality inspection. Where stock cultures are produced, necessary equipment and facilities for fungal fruiting experiments shall also be available.
