| Chapter I General Provisions | | 第一章 总则 |
| Article 1 In order to protect the right to know, right to participate and right to supervise of citizens, legal persons and other organizations, enhance the transparency and credibility of customs work, promote administration by law and bring into full play the functions of customs government information in serving the production, living and economic and social activities of the people, these Measures are formulated in accordance with the provisions of the Customs Law of the People's Republic of China, the Regulation of the People's Republic of China on the Disclosure of Government Information and other laws and administrative regulations. | | 第一条 为了保障公民、法人和其他组织的知情权、参与权和监督权，提高海关工作透明度和公信力，促进依法行政，充分发挥海关政府信息对人民群众生产、生活和经济社会活动的服务作用，根据《中华人民共和国海关法》、《中华人民共和国政府信息公开条例》以及其他法律、行政法规的规定，制定本办法。 |
| Article 2 For purposes of these Measures, “customs government information” means the information produced or acquired, and recorded and preserved in a certain form by the customs during their performance of functions. | | 第二条 本办法所称的海关政府信息，是指海关在履行职责过程中制作或者获取的，以一定形式记录、保存的信息。 |
| Article 3 The customs government information shall be disclosed under the principles of impartiality, fairness, and convenience for the people. | | 第三条 海关政府信息公开应当遵循公正、公平、便民的原则。 |
| Article 4 The customs shall strengthen the organization and leadership of the work on the disclosure of customs government information. | | 第四条 海关应当加强对海关政府信息公开工作的组织领导。 |
| The General Office of the General Administration of Customs of the People's Republic of China (“GACC”) is the department in charge of the work on the disclosure of customs government information across the country, and shall be responsible for promoting, directing, coordinating and supervising the work on the disclosure of customs government information across the country. The customs offices directly under the GACC, the customs offices subordinated to the GACC, the offices or other departments assuming the functions of the offices of all dispatched offices are the departments in charge of the work on the disclosure of customs government information, and shall be responsible for promoting, directing, coordinating and supervising the work on the disclosure of customs government information within their respective customs areas. | | 海关总署办公厅是全国海关政府信息公开工作的主管部门，负责推进、指导、协调、监督全国海关政府信息公开工作。直属海关、隶属海关和各派出机构办公室或者承担办公室职能的其他部门是海关政府信息公开工作主管部门，负责推进、指导、协调、监督本关区海关政府信息公开工作。 |
| The major functions of a competent department for the work on the disclosure of customs government information are: | | 海关政府信息公开工作主管部门的主要职责是： |
| (1) organizing and developing the rules and regulations and working rules on the disclosure of customs government information, studying and making plans on the disclosure of customs government information, and determining the matters such as the specific scope and forms of and procedures for the disclosure of customs government information; | | （一）组织制定海关政府信息公开的规章制度、工作规则，研究制定海关政府信息公开方案，确定海关政府信息公开的具体范围、形式、程序等事宜； |
| (2) organizing and preparing the guide to the disclosure of customs government information, the catalogue of disclosed customs government information, and the annual work report on the disclosure of customs government information; | | （二）组织编制海关政府信息公开指南、海关政府信息公开目录和海关政府信息公开工作年度报告； |
| (3) organizing the maintenance and update of the customs government information that shall be disclosed voluntarily; | | （三）组织维护和更新应当主动公开的海关政府信息； |
| (4) accepting applications for the disclosure of government information filed with the customs; | | （四）受理向海关提出的政府信息公开申请； |
| (5) organizing the confidentiality review of the customs government information to be disclosed; and | | （五）组织对拟公开的海关政府信息进行保密审查； |
| (6) other functions relating to the disclosure of customs government information. | | （六）与海关政府信息公开有关的其他职责。 |
| Article 5 The customs government information prepared by the customs shall be disclosed by the customs preparing such information. | | 第五条 海关制作的海关政府信息，由制作该海关政府信息的海关负责公开。 |
| The customs government information acquired by the customs from citizens, legal persons or other organizations shall be disclosed by the customs preserving such information. | | 海关从公民、法人或者其他组织获取的海关政府信息，由保存该海关政府信息的海关负责公开。 |
| Article 6 The customs shall establish and improve the confidentiality review mechanism for the release of customs government information, and specify the procedures of and responsibilities for such review. | | 第六条 海关应当建立健全海关政府信息发布保密审查机制，明确审查的程序和责任。 |
| Before disclosing the customs government information, the customs shall review the information to be disclosed in accordance with the Law of the People's Republic of China on Guarding State Secrets, other laws and administrative regulations, and the relevant provisions of the state. | | 海关在公开海关政府信息前，应当依照《中华人民共和国保守国家秘密法》以及其他法律、行政法规和国家有关规定对拟公开的海关政府信息进行审查。 |
| Where the customs cannot determine whether the customs government information may be disclosed or not, it shall report to the relevant competent department or the confidentiality department at the same level for determination in accordance with laws, administrative regulations and the relevant provisions of the state. | | 海关对海关政府信息不能确定是否可以公开时，应当依照法律、行政法规和国家有关规定报有关主管部门或者同级保密工作部门确定。 |
| Article 7 The customs shall establish and improve the coordination mechanism for the disclosure of customs government information. If the customs government information to be disclosed by the customs involves any other administrative organ, the customs shall communicate and confirm with the relevant administrative organ, so as to guarantee that the customs government information is released in an accurate manner. | | 第七条 海关应当建立健全海关政府信息公开协调机制。海关发布的海关政府信息涉及其他行政机关的，应当与有关行政机关进行沟通、确认，保证海关政府信息准确发布。 |
| Where the customs government information to be released by the customs shall be subject to the approval in accordance with the relevant provisions of the state, such information may not be released without approval. | | 海关发布的海关政府信息依照国家有关规定需要批准的，未经批准不得发布。 |
| Article 8 The customs shall disclose the customs government information in a timely and accurate manner. Where a customs finds any false or incomplete information that affects or is likely to affect social stability or disturbs the social management order, it shall, within the scope of its functions, release accurate information to clarify it. | | 第八条 海关应当及时、准确地公开海关政府信息。海关发现影响或者可能影响社会稳定、扰乱社会管理秩序的虚假或者不完整信息的，应当在其职责范围内发布准确的海关政府信息予以澄清。 |
| Article 9 The customs government information to be disclosed by the customs shall not endanger the national security, public security, economic security and social stability. | | 第九条 海关公开海关政府信息，不得危及国家安全、公共安全、经济安全和社会稳定。 |

| Chapter II Scope of Disclosure | | 第二章 公开的范围 |
| Article 10 The customs shall take the initiative to disclose the following customs government information: | | 第十条 海关应当主动公开以下海关政府信息： |
| (1) customs rules and regulations and other regulatory documents issued in the form of the announcement of the GACC or customs offices directly under the GACC; | | （一）海关规章以及以海关总署公告、直属海关公告形式发布的其他规范性文件； |
| (2) information on major policies of the customs, important customs rules and regulations and interpretation of the Announcements of the GACC; | | （二）关于海关重大政策、重要海关规章和海关总署公告的解读信息； |
| (3) contents that are disclosed in accordance with Article 54 of the Regulation on Practicing Strict Economy and Combating Waste by Party and Government Organs; | | （三）《党政机关厉行节约反对浪费条例》第五十四条规定予以公开的内容； |
| (4) matters, basis, conditions, quantities, procedures and time limits for a customs administrative licensing, catalogue of all materials that need to be submitted for an application for administrative licensing, and the handling information; | | （四）海关行政许可的事项、依据、条件、数量、程序、期限以及申请行政许可需要提交的全部材料目录及办理情况； |
| (5) organizational structure, functions and powers, office address, office hours and contact number of the customs; | | （五）海关的机构设置、职责权限以及办公地点、办公时间和联系电话； |
| (6) name, job number, duties, functions, and other relevant information of the customs personnel on business sites; | | （六）业务现场海关人员的姓名、工号、职务、职责等相关信息； |
| (7) comprehensive customs statistical data involving the import and export trade in goods; | | （七）涉及进出口货物贸易的海关综合统计资料； |
| (8) items, basis and standards of customs administrative charges; | | （八）海关行政事业性收费的项目、依据、标准； |
| (9) information on the public auction of properties confiscated by the customs; and | | （九）海关罚没财物公开拍卖信息； |
| (10) other matters, which involve the vital interests of citizens, legal persons or other organizations, shall be widely known or participated by the general public, or shall be voluntarily disclosed as prescribed by laws, administrative regulations and the provisions of the GACC. | | （十）其他涉及公民、法人或者其他组织切身利益、需要社会公众广泛知晓或者参与以及法律、行政法规、海关总署规定应当主动公开的事项。 |
Where the disclosure of customs government information is prescribed by any international convention or treaty acceded to or accepted by China, the relevant information shall be disclosed as required.
