Notice by the China Banking and Insurance Regulatory Commission and the Ministry of Human Resources and Social Security of Issues Concerning the Inquiry about Relevant Entities' Bank Accounts by the Administrative Departments of Human Resources and Social Security

All local offices of the China Banking and Insurance Regulatory Commission ("CBIRC"); the human resources and social security departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps; and all policy banks, large-scale banks, and joint-stock banks; foreign-funded banks: 各银保监局,各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅(局),各政策性银行、大型银行、股份制银行,外资银行:
For the purposes of investigating and punishing illegal acts of defaulting on migrant workers' wages and effectively protecting their rights and interests on labor remunerations, in accordance with the Regulation on Ensuring Wage Payment to Migrant Workers (Order No. 724, State Council) and related regulations, the administrative department of human resources and social security shall have the power to inquire about relevant entities' bank accounts with relevant banking financial institutions in investigating and handling cases about default on migrant workers' wages. And you are hereby notified of the relevant matters as follows: 为依法查处拖欠农民工工资违法行为,切实维护农民工工资报酬权益,根据《保障农民工工资支付条例》(国务院令第724号)相关规定,人力资源社会保障行政部门在查处拖欠农民工工资案件时,有权依法向有关银行业金融机构查询相关单位银行账户,现就有关事项通知如下:
I. The administrative department of human resources and social security shall inquire about bank accounts of relevant entities and obtain certification materials in accordance with the law, and relevant banking financial institutions shall provide assistance.   一、人力资源社会保障行政部门依法查询相关单位银行账户,并取得证明材料,有关银行业金融机构应当予以协助。
Bank accounts under inquiry shall include all kinds of accounts opened by relevant entities with banking financial institutions such as commercial banks, policy banks, rural credit cooperatives, and rural cooperative banks. The inquiry contents shall include information on account opening and cancellation, account balance, capital flows and dates, and the details of salary paid by the entrusted bank. 被查询的银行账户包括相关单位在商业银行、政策性银行、农村信用合作社、农村合作银行等银行业金融机构开立的各类账户。查询内容包括相关单位开户销户信息、账户余额、资金往来及日期、委托银行发放工资明细等。
II. In carrying out the inquiry, the administrative department of human resources and social security shall strictly perform the approval procedures, and obtain the approval of the person in charge of the administrative department of human resources and social security at or above the level of a districted city.   二、人力资源社会保障行政部门开展查询工作,应当严格履行审批程序,经设区的市级以上人力资源社会保障行政部门负责人批准,依法开展查询工作。
III. When the administrative department of human resources and social security needs to inquire about bank accounts of the relevant entity in a different place, its officials may go to that place to conduct inquiry according to the law or entrust the inquiry with the administrative department of human resources and social security in that place. The entrusted administrative department of human resources and social security shall, when performing the inquiry task, produce a power of attorney to the relevant banking institution.   三、人力资源社会保障行政部门需要查询异地相关单位银行账户时,可赴异地依法直接查询,也可委托相关地人力资源社会保障行政部门查询。受委托的人力资源社会保障行政部门执行查询任务时,应向有关银行业金融机构出具委托函。
IV. When conducting the inquiry according to the law, the administrative department of human resources and social security may request branches, sub-branches, and operations offices of banking financial institutions for inquiry. The inquiry shall be conducted by not less than two labor security supervisors, who shall produce labor security supervision certificates and the Notifications of Inquiry about Bank Accounts of Entities (See Annex 1). The banking institution shall actively provide cooperation.   四、人力资源社会保障行政部门依法执行查询任务时,可向各银行业金融机构的分行、支行、营业部等提出查询要求,开展查询工作不得少于两名劳动保障监察员,并应当出示劳动保障监察证件和《查询单位银行账户通知书》(见附件1),银行业金融机构应当积极配合。
V. Banking financial institutions shall assist the administrative department of human resources and social security in effectively making inquiries. If a banking institution can give timely feedback, it shall complete the inquiry and feedback on the day when the Notifications of Inquiry about Bank Accounts of Entities is received. If further access to relevant archives is required, such inquiry and feedback shall be completed within five working days in principle. If a banking institution is unable to give feedback within the prescribed time limit due to technical conditions, force majeure, and other objective reasons, it shall explain the reasons to the administrative department of human resources and social security and take measures to complete the inquiry and feedback as soon as possible. Banking financial institutions shall complete the Receipt for Inquiry about Bank Accounts of Entities (see Annex 2) and truthfully provide the inquiry results and relevant information to which their seals are affixed, and shall not delay the provision, shuffle responsibilities or conceal the relevant information.   五、银行业金融机构应当协助人力资源社会保障行政部门做好查询工作。可及时反馈的,应于收到《查询单位银行账户通知书》当日完成查询并反馈;需要进一步查阅相关档案资料的,原则上应于五个工作日内完成查询并反馈。对于因技术条件、不可抗力等客观原因,银行业金融机构无法在规定时限内反馈的,应当向人力资源社会保障行政部门说明原因,并采取措施尽快完成查询反馈。银行业金融机构应填写《查询单位银行账户回执》(见附件2),如实提供查询结果和相关资料并加盖印章,不得拖延、推诿或者隐匿。
VI. If the administrative department of human resources and social security is unable to provide the accurate account name or account number of the entity under inquiry, the banking institution shall assist the inquiry according to the information provided by such administrative department of human resources and social security. If the information on the bank account of the entity under inquiry is indeed unable to be found, the banking institution shall give a timely reply and explain the situation.   六、人力资源社会保障行政部门不能提供被查询单位准确账户名称或账号的,银行业金融机构应当根据人力资源社会保障行政部门提供的信息协助查询,确实无法查询到单位银行账户信息的,应及时回复并说明情况。
VII. Banking financial institutions and their relevant employees shall keep confidential the contents and relevant information inquired by the administrative departments of human resources and social security, and shall not inform the entity under inquiry. The administrative department of human resources and social security and the personnel performing the inquiry shall be obliged to keep confidential the information provided by banking financial institutions.   七、银行业金融机构及其有关工作人员对人力资源社会保障行政部门查询内容和相关情况应当保密,不得告知被查询单位。人力资源社会保障行政部门及其执行查询任务人员对银行业金融机构提供的信息资料负有保密义务。
VIII. If the administrative department of human resources and social security or the relevant staff member thereof makes inquiries in violation of the relevant provisions of this Notice, the relevant authority shall hold the relevant person liable according to the law. If a banking financial institution fails to assist in the inquiry according to the law, the administrative department of human resources and social security shall transfer the relevant information to the relevant banking regulatory authority. The banking regulatory authority shall handle the case in accordance with the provisions of Article 58 of the Regulation on Ensuring Wage Payment to Migrant Workers, and feed the handling information back to the administrative department of human resources and social security.

   八、人力资源社会保障行政部门或相关工作人员违反本通知相关规定进行查询的,由相关部门依法追究有关人员责任。银行业金融机构未依法协助开展查询的,由人力资源社会保障行政部门将有关情况移送银行业监督管理机构。银行业监督管理机构按照《保障农民工工资支付条例》第五十八条规定依法处理,并将处理情况反馈人力资源社会保障行政部门。
