| Article 1 These Measures are specially formulated to further encourage, guide and regulate the mainland enterprises' direct investment in Taiwan Region, realize the mutual benefits and win-win situation of the economy on both sides of the Straits and boost the peaceful development of cross-strait relations. | | 第一条 为进一步鼓励、引导和规范大陆企业赴台湾地区直接投资，实现两岸经济互利共赢，推动两岸关系和平发展，特制定本办法。 |

| Article 2 We shall encourage and support mainland enterprises to actively yet prudently go to Taiwan Region for investment and form a mutually complementary and beneficial pattern. The mainland enterprises' investment in Taiwan Region shall follow the principle of mutual benefits, win-win and market economy. | | 第二条 鼓励和支持大陆企业积极稳妥地赴台湾地区投资，形成互补互利的格局。大陆企业赴台湾地区投资应遵循互利共赢和市场经济原则。 |

| Article 3 The mainland enterprises' investment in Taiwan Region shall initiatively adapt to the characteristics of the economic and industrial development of both sides of the Straits, elaborately select investment fields and projects in light of their own advantages and enterprise development strategies; earnestly comprehend and observe the local laws and regulations, respect the local customs, attach importance to environmental protection, and perform necessary social responsibility. | | 第三条 大陆企业赴台湾地区投资，应主动适应两岸经济和产业发展特点，结合自身优势和企业发展战略，精心选择投资领域和项目；认真了解并遵守当地法律法规，尊重当地风俗习惯，注重环境保护，善尽必要的社会责任。 |

| Article 4 To make investment in Taiwan Region, a mainland investor shall meet the following requirements: | | 第四条 大陆投资主体赴台湾地区投资，应符合以下条件： |

| 1. It shall be a legal person enterprise which has been legally registered and is operating in the Mainland; | | （一）在大陆依法注册、经营的企业法人； |
| |
|
| 2. It shall have the industrial background, capital, technology and management strength for the investment project under application; and | | （二）具备投资所申报项目的行业背景、资金、技术和管理实力； |
| |
|
| 3. The investment shall be favorable to the peaceful development of cross-strait relations and shall not compromise the national security and unity. | | （三）有利于两岸关系和平发展，不危害国家安全、统一。 |

| Article 5 For the mainland enterprises' investment projects in Taiwan Region, the local enterprises shall file the applications with the local development and reform commissions at the provincial level, and the provincial development and reform commissions shall submit them to the National Development and Reform Commission for approval after their preliminary examination. The Central enterprises shall directly apply to the National Development and Reform Commission for approval. | | 第五条 大陆企业赴台湾地区投资项目，地方企业向所在地省级发展改革委提出申请，由省级发展改革委初审后，报国家发展改革委核准。中央企业直接向国家发展改革委申请核准。 |

| Article 6 To invest and establish an enterprise legal person or non-business legal person in Taiwan Region, the mainland enterprise shall obtain the approval of the Ministry of Commerce. If it is a local enterprise, it shall make an application to the Ministry of Commerce upon preliminary examination by the local commerce administrative department at the provincial level; if it is a Central enterprise, it shall directly file the application with the Ministry of Commerce. | | 第六条 大陆企业赴台湾地区投资设立企业或非企业法人，由商务部核准。地方企业由所在地省级商务主管部门初审后向商务部提出申请；中央企业直接向商务部提出申请。 |

Article 7 The National Development and Reform Commission shall examine and approve the investment projects in Taiwan Region in accordance with the Interim Measures for the Administration of Examination and Approval of Overseas Investment Projects (Order No.21 of the National Development and Reform Commission) and solicit the opinions of the Taiwan Affairs Office of the State Council in the examination and approval; and the copies of the approval documents of the National Development and Reform Commission shall be sent to the Ministry of Commerce, the Taiwan Affairs Office of the State Council and other relevant departments.
