| The departments of housing and urban-rural development of all provinces and autonomous regions; the construction commissions of municipalities directly under the Central Government; and the Construction Bureau of Xinjiang Production and Construction Corps | | 各省、自治区住房城乡建设厅，直辖市建委，新疆生产建设兵团建设局： |
| To implement the Measures for the Administration of Construction Permits for Construction Projects (Order No. 18, MOHURD, hereinafter referred to as the “Measures”) and the rules for the administration of construction permits, and strictly implement basic construction procedures so as to ensure the quality and safety of construction projects, you are hereby notified of relevant matters as follows: | | 为贯彻《建筑工程施工许可管理办法》（住房城乡建设部令第18号，以下简称《办法》），落实施工许可管理制度，严格执行基本建设程序，确保工程质量安全，现就有关事项通知如下： |
| I. Implementing construction permits according to law | | 一、依法实施施工许可 |
| 1. Granting a permit in strict accordance with the conditions. The administrative departments of housing and urban-rural development at all levels shall strictly implement the Construction Law, the Measures and other laws and regulations, and examine the conditions and issue construction permits in accordance with the law, and shall not arbitrarily set additional conditions and examination procedures for granting a construction permit. The related documents on construction permits shall be comprehensively reviewed in accordance with the Construction Law, the Measures and the requirements of this Notice, and the conditions and requirements for granting a permit as set without any basis in laws and regulations shall be canceled without exceptions. They shall administer in strict accordance with law, and issue construction permits in a timely manner for the applications that meet the conditions; they shall inform, at one time, the construction entities of all the contents that need to be supplemented or corrected when the application materials are not complete or do not conform to the statutory form. | | （一）严格许可条件。各级住房城乡建设主管部门要严格执行建筑法和《办法》等法律法规，依法审查和颁发施工许可证，不得“搭车”增设施工许可条件和审核程序。要依照建筑法、《办法》和本通知要求，全面清理施工许可相关文件，对于没有法律法规依据设置的许可条件和要求，一律取消。要严格依法行政，对符合条件的申请及时发放施工许可证；对于申请材料不齐全或不符合法定形式的，要一次告知建设单位需要补正的全部内容。 |
| 2. Ensuring receipt of construction funds. The administrative departments of housing and urban-rural development at all levels shall strengthen the examination of the receipt of construction funds, and require a construction entity applying for a construction permit to provide a certificate or a letter of guaranty issued by a bank on the amount of funds already received and submit a letter of commitment that it has no default on construction payments by the date of application or any other certification document. A construction entity shall ensure that construction funds are put in place, and shall not conceal any relevant information or provide any false materials. | | （二）落实建设资金。各级住房城乡建设主管部门要加强对建设资金落实情况的监督检查，要求建设单位申请领取施工许可证时，提供建设资金已经落实承诺书。建设单位要确保建设资金落实到位，不得提供虚假承诺。 |
| 3. Intensifying information disclosure. The administrative departments of housing and urban-rural development at all levels shall further intensify the information disclosure of construction permits, and disclose the basis, conditions, procedures, time limit and application materials for a construction permit, and the model text, among others, at their business premises and on the related websites. A construction entity shall set up a billboard for its construction permit at a conspicuous position of the construction site, the content of which shall be consistent with the content of its construction permit, so as to take the initiative in accepting social supervision. | | （三）加大公开力度。各级住房城乡建设主管部门要进一步加大施工许可信息公开力度，将许可依据、条件、程序、期限、申请材料和示范文本等，在办公场所和有关网站予以公示。建设单位要在施工现场显著位置设置施工许可公告牌，公告牌内容应与施工许可证内容一致，主动接受社会监督。 |
4. Strengthening supervision and inspection. The administrative departments of housing and urban-rural development at all levels shall intensify efforts to conduct supervision and inspection after the construction permits are issued, and shall supervise and inspect the circumstances of no longer meeting the conditions, postponement of commencement of construction, suspension of construction, and other relevant circumstances that occur after construction permits are obtained. An entity or a related liable person's violations of laws and regulations such as beginning any unauthorized construction without a construction permit, concealing relevant information or providing false materials when applying for a construction permit, or forging or altering a construction permit shall be punished in strict accordance with the provisions of the Measures, and the information on punishment shall serve as the information on misconduct to be submitted to the supervision and integrity information publishing platform of the national construction market for disclosure.
．．．．．． | | （四）加强监督检查。各级住房城乡建设主管部门要加大颁发施工许可证后的监督检查力度，对取得施工许可证后不再符合许可条件、延期开工、中止施工等行为进行监督检查。对存在未取得施工许可证擅自施工、以隐瞒有关情况或者提供虚假材料申请施工许可证以及伪造或者涂改施工许可证等违法违规行为的单位及相关责任人，要严格按照《办法》的规定进行惩处，并将处罚信息作为不良行为信息上报全国建筑市场监管公共服务平台曝光。
