Free Trade Agreement between the Government of the People's Republic of China and the Government of the Islamic Republic of Pakistan

Preamble 

序言
The Government of the People's Republic of China ("China") and the Government of the Islamic Republic of Pakistan ("Pakistan") hereinafter referred to as "the Parties"; 中华人民共和国(中国)政府和巴基斯坦伊斯兰共和国(巴基斯坦)政府(以下简称“缔约双方”);
Committed to strengthening the special bonds of friendship and cooperation between their countries; 致力于加深两国间的特殊友谊与合作;
Building on their respective rights and obligations under the WTO Agreement and other multilateral, regional and bilateral instruments of cooperation; 建立在各自在WTO协定和其他多边、区域和双边合作机制的权利和义务基础上;
Resolved to promote reciprocal trade through the establishment of clear and mutually advantageous trade rules and the avoidance of trade barriers; 决定通过建立明确和互利的贸易规则并避免贸易壁垒以促进互惠贸易;
Recognizing that this Agreement should be implemented with a view toward raising the standard of living, creating new job opportunities, and promoting sustainable development in a manner consistent with environmental protection and conservation; and 认识到执行本协定是为了提高生活水平、创造新的工作机会并以与环境保护相一致的方式促进可持续发展;
Committed to promoting the public welfare within each of their countries; 并致力于在各自国内促进公共福利的发展;
Have agreed as follows: 协议如下:
Chapter I Initial Provisions 

第一章 初始条款

Article 1 Establishment of a Free Trade Area 

第一条 自由贸易区的建立

The Parties to this Agreement, consistent with Article XXIV of the General Agreement on Tariffs and Trade 1994, hereby establish a free trade area. 本协定缔约双方在遵守1994年关税和贸易总协定第二十四条的前提下,特此建立自由贸易区。
Article 2 Objectives 

第二条 目标

1. The objectives of this Agreement are to: 一、本协定的目标是:
(a) strengthen the mutual friendship between the Parties; (一)加深缔约双方相互之间的友谊;
(b) encourage expansion and diversification of trade between the Parties; (二)鼓励缔约双方间贸易的扩大和多样化;
(c) eliminate barriers to trade in, and facilitate the cross-border movement of, goods between the Parties; (三)取消缔约双方间货物贸易壁垒,并便利缔约双方间货物的跨境移动;
(d) provide fair conditions of competition for trade between the Parties (四)为缔约双方间的贸易提供公平的竞争条件;
(e) establish a framework for further bilateral economic cooperation to expand and enhance the benefits of this Agreement. (五)建立进一步双边经济合作的机制以扩大和增强本协定的效益。
2. The Parties shall interpret and apply the provisions of this Agreement in the light of its objectives set out in paragraph 1 and in accordance with customary rules of interpretation of public international law. 二、缔约双方应本着第一款所述的目标,并按照国际公法的解释惯例来解释和适用本协定。
Article 3 Relation to Other Agreements 

第三条 与其他协定的关系

The Parties affirm their existing rights and obligations with respect to each other under the WTO Agreement and other agreements to which both Parties are parties. 缔约双方确认WTO协定和其他双方均为成员的协定项下的现有权利和义务。
Article 4 Application of this Agreement 

第四条 本协定适用的范围

The free trade area to which this Agreement applies consists of the territory of the parties with the exception of any part thereof which constitute separate customs territories. 本协定适用的自由贸易区由缔约双方领土组成,不包括任一缔约方所属的单独关税领土。
Chapter II General Definitions 

第二章 一般定义

Article 5 Definitions of General Application 

第五条 一般适用的定义

For purposes of this Agreement, unless otherwise specified: 在本协定中,除非另有规定:
days mean calendar days; 日指日历日;
GATT 1994 means the General Agreement on Tariffs and Trade 1994; GATT1994指1994年关税和贸易总协定;
territory means: 领土指:
(a) with respect to China, the territory of the People's Republic of China, including land territory, internal waters, territorial sea and any maritime areas beyond the territorial sea that, in accordance with international law and its domestic law, China may exercise sovereign rights or jurisdiction with respect to the sea, seabed and subsoil and their natural resources. (一)就中国而言,指中华人民共和国领土,包括陆地领土、内水、领海以及根据国际法和国内法,中国可以行使关于海洋、海床、底土和自然资源的主权或管辖权的位于领海之外的海洋区域。
(b) with respect to Pakistan, land territory, internal waters and territorial sea as well as and any maritime area situated beyond the territorial sea which has been or might in future be designated under its national law, in accordance with international law, as an area within which PAKISTAN may exercise defacto and de jure sovereign rights or jurisdiction with regard to the sea, sea-bed, the subsoil and the natural resources; (二)就巴基斯坦而言,指陆地领土、内水和领海以及任何已经或未来可能根据国际法,由巴基斯坦国内法指定为巴基斯坦可在其中行使实际的和法律上的关于海洋、海床、底土和自然资源的主权或管辖权的位于领海之外的海洋区域。
WTO means the World Trade Organization; WTO指世界贸易组织;
WTO Agreement means the Marrakesh Agreement Establishing the World Trade Organization, done on April 15, 1994; and WTO协定指1994年4月15日签署的《马拉喀什建立世界贸易组织协定》;以及
CPFTA means the Free Trade Agreement between the Government of the People's Republic of China and the Government of the Islamic Republic of Pakistan. 中巴自由贸易协定指中华人民共和国政府和巴基斯坦伊斯兰共和国政府自由贸易协定。
Chapter III National Treatment and Market Access for Goods 

第三章 货物的国民待遇和市场准入

Article 6 Scope and Coverage 

第六条 领域和范围

Except as otherwise provided, this Chapter applies to trade in goods between the Parties. 除非另有规定,本章适用于缔约双方之间的货物贸易。
Article 7 National Treatment 

第七条 国民待遇

Each Party shall accord national treatment to the goods of the other Party in accordance with Article III of the GATT 1994, including its interpretative notes, and to this end Article III of GATT 1994, and its interpretative notes, are incorporated into and made part of this Agreement, mutatis mutandis. 各缔约方应根据GATT1994第三条及其解释性注释,给予另一缔约方的货物国民待遇。为此目的,GATT1994第三条及其解释性注释在做必要的细节修改后被纳入本协定,成为本协定的一部分。
Article 8 Tariff Elimination 

第八条 消除关税

1. Except as otherwise provided in this Agreement, each Party shall progressively eliminate its import customs duties on goods originating in the territory of another Party in accordance with Annex 1. 一、除非本协定另有规定,各缔约方应根据附件一对原产于另一方货物逐步消除进口海关关税。
2. If a Party reduces its applied most favored nation import customs duty rate after the entry into force of this Agreement and before the end of the tariff elimination period, the tariff elimination schedule (Schedule) of that Party shall apply to the reduced rate. 二、如果一缔约方在本协定生效后和关税减让期截止前,降低其适用的最惠国进口海关关税税率,则该缔约方的关税减让表应适用降低后的关税税率。
3. On the request of either Party, the Parties shall consult to consider accelerating the elimination of import customs duties set out in their Schedules. An agreement between the Parties to accelerate the elimination of an import customs duty on a good shall supersede any duty rate or staging category determined pursuant to their Schedules for such good when approved by each Party in accordance with their respective applicable legal procedures. 三、应任一缔约方的要求,缔约双方应进行协商,考虑加速消除关税减让表中的进口海关关税。如缔约双方达成协议,同意加速消除某类货物的进口海关关税,则经各缔约方根据各自适用的法律程序规定批准后,将取代根据关税减让表为该类货物确定的任何关税税率或分级类别。
4. Review and Modification of Tariff Reduction Modality and the Lists shall be as follows: 四、关税减让模式和清单的审评和修改应按如下方式进行:
(a) Tariff Reduction Modality and the lists shall be reviewed and modified every five years by the Committee on Trade in Goods. (一)货物贸易委员会应每五年审评和修改关税减让模式和清单。
(b) The review shall be undertaken on the basis of friendly consultation and accommodation of the concerns of the Parties. (二)缔约双方应在友好协商和照顾双方关注的基础上进行审评。
(c) The first review and modification shall be undertaken either at the end of the fourth year or at the beginning of the fifth year of entry into force of this Agreement. (三)第一次审评和修改应在本协定自生效后的第四年年底或第五年年初进行。
(d) Either party may request for an additional review at any time after coming into force of this Agreement. Such a request shall be favorably considered by the other Party. (四)任一缔约方可在本协定生效后的任何时间提出另外的审评要求。另一缔约方应积极考虑该要求。
Article 9 Administrative Fees and Formalities 

第九条 行政费用和手续

1. Each Party shall ensure, in accordance with Article VIII:1 of the GATT 1994 and its interpretive notes, that all fees and charges of whatever character (other than import customs duties, charges equivalent to an internal tax or other internal charge applied consistently with Article III:2 of the GATT 1994, and antidumping and countervailing duties) imposed on or in connection with importation or exportation are limited in amount to the approximate cost of services rendered and do not represent an indirect protection to domestic goods or a taxation of imports or exports for fiscal purposes. 一、各缔约方应该依照GATT1994第八条第一款及其解释性注释的规定,确保所有的在进口或出口时征收的或者与进口或出口有关的任何性质的手续费或者费用(除了进口海关关税、等同于国内税的收费或者其他符合GATT1994第三条第二款规定的适用的国内费用,以及反倾销和反补贴税)将被限制在所提供的服务的大概成本范围内,并且不能被作为国内货物的间接保护措施或者出于财政目的而对进口或出口货物征收的一种税。
2. Each Party shall make available through the Internet or a comparable computer-based telecommunications network a list of the fees and charges and changes thereto levied by the central/federal Government, as the case may be, thereof in connection with importation or exportation. 二、各缔约方应通过国际互联网或者相当的基于计算机的通讯网络,相互提供目前由中央或联邦政府所征收的与进口或者出口有关的手续费和费用的清单及今后所作的修改。
Article 10 Special Requirements Related to Border Measures 

第十条 与边境措施有关的特别要求

1. Each Party shall provide that any right holder initiating procedures for suspension by the customs authorities of the release of suspected counterfeit trademark or pirated copyright goods into free circulation is required to provide adequate evidence to satisfy the competent authorities that, under the relevant laws of the Party of importation, there is prima facie an infringement of the right holder's intellectual property right and to supply sufficient information to make the suspected goods reasonably recognizable to the customs authorities. The sufficient information required shall not unreasonably deter recourse to these procedures. 一、各缔约方必须规定,任何启动程序要求海关中止放行被怀疑假冒商标的货物或者盗版的货物①进入自由流通的知识产权持有者,需要向主管机关提供足够的证据来使其确信,根据进口缔约方的相关法律规定,已有初步证据证明该知识产权持有者的知识产权已经受到侵害,并且提供充分的信息让受到怀疑的货物能够被海关合理地辨认。要求提供的充分信息不应不合理地妨碍对上述程序的援用。
注①:在本条中:
(一)假冒商标的货物指包括包装在内的,在没有授权的情况下使用某一与该类货物已有效注册的商标相同的商标,或者在其基本特征方面不能与上述商标区别,并且因此根据进口缔约方的法律侵犯了所涉商标权人的权利的任何货物;
(二)盗版的货物指在没有经过知识产权持有者或者在产品生产缔约方内该权利持有者充分授权的人士同意而制造的复制品,以及直接或者间接由一个物品制造出的货物,如此种复制在进口缔约方和法律项下构成对版权或相关权利的侵犯。
2. Each Party shall provide the competent authorities with the powers to require an applicant to provide a reasonable security or equivalent assurance sufficient to protect the defendant and the competent authorities and to prevent abuse. Such security or equivalent assurance shall not unreasonably deter recourse to these procedures. 二、各缔约方应该给予主管机关要求申请人提供足以保护被告和主管机关以及防止滥用权利的合理的保证金或者相当的担保的权力。上述保证金或者相当的担保不应不合理地妨碍对上述程序的援用。
3. Where the competent authorities have made a determination that goods are counterfeit or pirated, a Party shall grant the competent authorities the right to inform the right holder, at the right holder's request, of the names and addresses of the consignor, the importer, and the consignee, and of the quantity of the goods in question. 三、当主管机关裁定货物系假冒商标或者盗版时,该缔约方应给予主管机关权利,以应知识产权持有者的要求向其告知发货人、进口商和收货人的姓名和地址以及受到怀疑的货物的数量。
4. Each Party shall provide that the competent authorities are permitted to initiate border measures ex officio, without the need for a formal complaint from a person or right holder. Such measures shall be used when there is reason to believe or suspect that goods being imported, or destined for export are counterfeit or pirated. 四、各缔约方应该规定允许主管机关依职权启动边境措施,而不需要来自某人或者某知识产权持有者的正式申诉。上述措施应在有理由相信或者怀疑正在进口或者用于出口的货物系假冒商标或者盗版时采用。
Article 11 Committee on Trade in Goods 

第十一条 货物贸易委员会

1. The Parties hereby establish a Committee on Trade in Goods, comprising representatives at the level of joint secretary, director general or deputy director general respectively. 一、缔约双方应专门设立货物贸易委员会,由联秘、司长或副司长相应级别的双方代表组成。
2. The Committee shall meet on the request of either Party or the Commission established under Chapter XI of this Agreement to consider any matter arising under this Chapter, Chapter IV and Chapter V. 二、本委员会应就任一缔约方或者根据本协定第十一章成立的委员会的要求举行会议,考虑由本章、第四章或第五章所引起的任何问题。
3. The Committee's functions shall include: 三、本委员会的职能应包括:
(a) promoting trade in goods between the Parties, including through consultations on accelerating tariff elimination under this Agreement and other issues as appropriate; (一)促进缔约双方之间的货物贸易,包括通过磋商加速本协定规定的关税消除及其他适当的问题;
(b) addressing barriers to trade in goods between the Parties, especially those related to the application of non-tariff measures, and, if appropriate, referring such matters to the Commission established under Chapter XI of this Agreement for its consideration; (二)着力于解决缔约双方之间货物贸易壁垒特别是与适用非关税措施有关的问题,并且在适当的情况下将上述问题交由根据本协定第十一章成立的委员会考虑;
(c) monitoring and evaluating the implementation of schedule of tariff reduction as provided in Annex I of this Agreement; and (三)监测和评估本协定附件一关税减让表的执行;以及
(d) any other issue related to trade in goods, referred to the Committee by either Party. (四)任一缔约方向委员会提出的其他与货物贸易有关的问题。
4. The Committee may establish working groups to deliberate on any matter if required. 四、如需要,本委员会可设立工作组商议任何具体事务。
Chapter IV Rules of Origin 

第四章 原产地规则

Article 12 Definitions 

第十二条 定义

For the purposes of these Rules: 为执行原产地规则:
(a) "CIF value" means the price actually paid or payable to the exporter for the good when the good is unloaded from the carrier, at the port of importation. The value includes the cost of the good, insurance and freight necessary to deliver the good to the named port of destination. (一)“成本、保险费加运费价格(CIF)”是指实付或应付给出口人的货物在进口港从运输工具卸下后的价格。它包括货物的成本和将货物运至指定目的港所需的保险费和运费。
(b)"Customs Valuation Agreement" means the WTO Agreement on Implementation of Article VII of the =T&origin_id=1348276&provider_id=1&isEnglish=Y" class="link_2" re="T" cate="en_href" target="_blank" >General Agreement on Tariffs and Trade 1994. (二)“海关估价协议”指WTO协议中《关于实施1994年关税与贸易总协定第七条的协定》。
(c) "FOB value" means the price actually paid or payable to the exporter for the good when the good is loaded into the carrier at the named port of exportation. The value includes the cost of the good and all costs necessary to bring the good into the carrier. (三)“船上交货价格(FOB)”是指实付或应付给出口人的货物在指定出口港装上运输工具后的价格。它包括货物的成本和将货物运至运输工具所需的所有成本。
(d) "Materials" include ingredients, parts, components, subassembly and/or goods that were physically incorporated into another good or were subject to a process in the production of another good. (四)“材料”包括组成成分、零件、部件、组件及/或已实际上构成另一个货物部分或已用于另一货物生产过程的货物。
(e) "Originating goods" means products that qualify as originating in accordance with the provisions of Article 13. (五)“原产货物”是指根据第十三条的规定确定为原产的货物。
(f) "Product Specific Rules" are rules that specify that the materials have undergone a change in tariff classification or a specific manufacturing or processing operation, or satisfy an ad valorem criterion or a combination of any of these criteria. (六)“产品特定原产地标准”是指规定材料已经过税号改变或特定制造或加工工序,或满足某一从价百分比标准,或者混合使用任何这些标准的规则。
(g) "Indirect material" means a good used in the production, testing or inspection of a good but not physically incorporated into the good, or a good used in the maintenance of buildings or the operation of equipment associated with the production of a good, including: (七)“间接材料”是指用于某一货物的生产、测试和检查,但没有实际性地组成到这一货物中的物品,又或者是一种用于与某一货物的生产有关的厂房维护或设备操作的物品,包括:
(i) Fuel and energy; 1.燃料与能源;
(ii) Tools, dies, and moulds; 2.工具、模具及铸模;
(iii) Parts and materials used in the maintenance of equipment and buildings; 3.用于设备及厂房维护的零件和材料;
(iv) Lubricants, greases, compounding materials, and other materials used in production or used to operate equipment and buildings; 4.用于生产或设备操作和厂房的润滑剂、润滑油、混合材料及其他材料;
(v) Gloves, glasses, footwear, clothing, safety equipment, and supplies; 5.手套、眼镜、鞋、衣服、安全装置及用品;
(vi) Equipment, devices, and supplies used for testing or inspecting the goods; 6.用于货物的测试或检查的设备、装置和用品;
(vii) Catalysts and solvents; and any other goods that are not incorporated into the good but whose use in the production of the good can reasonably be demonstrated to be part of that production; 7.催化剂和溶剂;及其他任何可被证明用于货物的生产但未构成货物组成部分的货物。
(h) "Non-originating material" used in production means any material whose country of origin is other than that of the Parties and any material whose origin cannot be determined; (八)“非原产材料”是指用于货物生产中的非任何缔约一方原产的材料,以及不明原产地的材料。
(i) "Production" includes methods of obtaining goods including manufacturing, producing, assembling, processing, raising, growing, breeding, mining, extracting, harvesting, fishing, trapping, gathering, collecting, hunting and capturing. (九)“生产”是指获得货物的方法,包括制造、生产、装配、加工、饲养、种植、繁殖、开采、提取、收获、捕捞、诱捕、采集、收集、狩猎和捕获。
Article 13 Origin Criteria 

第十三条 原产地标准

For the purposes of this Agreement, products imported by a Party shall be deemed to be originating and eligible for preferential concessions if they conform to the origin requirements under any one of the following: 本协议中,从缔约一方进口的符合以下任何一项原产地要求的产品,应视为原产并可以享受优惠关税减让:
(a) products which are wholly obtained or produced as set out and defined in Article 14; or (一)第十四条中明确规定的完全获得或生产的产品;或
(b) products not wholly obtained or produced provided that the said products are eligible under Article 15, Article 16 or Article 17. (二)符合第十五条、第十六条或第十七条中规定的非完全获得或生产的产品。
Article 14 Wholly Obtained or Produced Products 

第十四条 完全获得或生产的产品

Within the meaning of Article13 (a), the following shall be considered as wholly produced or obtained in a Party: 下列产品应当视为符合第十三条(一)所指的完全在缔约一方获得或生产:
(a) Plant and plant products harvested, picked or gathered there; (一)在缔约一方收获、采摘或收集的植物及植物产品;
(b) Live animals born and raised there; (二)在缔约一方出生和饲养的活动物;
(c) Products obtained from live animals referred to in paragraph (b) above; (三)在缔约一方从上述第(二)项活动物中获得的产品;
(d) Products obtained from hunting, trapping, fishing, aquaculture, gathering or capturing conducted there; (四)在缔约一方狩猎、诱捕、捕捞、水生养殖、收集或捕获所得的产品;
(e) Minerals and other naturally occurring substances, not included in paragraphs (a) to (d) above, extracted or taken from its soil, waters, seabed or beneath their seabed; (五)从缔约一方领土、领水、海床或海床底土开采或提取的除上述第(一)至(四)项以外的矿物或其他天然生成物;
(f) Products taken from the waters, seabed or beneath the seabed outside the territorial waters of that Party; provided that that Party has the rights to exploit such waters, seabed and beneath the seabed in accordance with international law; (六)在缔约一方领水以外的水域、海床或海床底土获得的产品,但该成员方须按照国际法规定有权开发上述水域、海床及海床底土;
(g) Products of sea fishing and other marine products taken from the high seas by vessels registered with a Party or entitled to fly the flag of that Party; (七)在缔约一方注册或悬挂该成员方国旗的船只在公海捕捞获得的鱼类及其他海产品;
(h) Products processed and/or made on board factory ships registered with a Party or entitled to fly the flag of that Party, exclusively from products referred to in paragraph (g) above; (八)在缔约一方注册或悬挂该成员方国旗的加工船上仅从第(七)项产品中加工和/或制造所得的产品;
(i) Parts or raw materials recovered there from articles which can no longer perform their original purpose nor are capable of being restored or repaired; (九)在缔约一方从既不能用于原用途,也不能恢复或修理的物品上回收的零件或原材料;
(j) Articles collected there which can no longer perform their original purpose nor are capable of being restored or repaired and are fit only for disposal or recovery of parts of raw materials, or for recycling purposes; (十)在缔约一方收集的既不能用于原用途,也不能恢复或修理,仅适于用作弃置或部分原材料的回收,或者仅适于作再生用途的物品;
(k) Waste and scrap resulting from manufacturing operations conducted there; and (十一)在缔约一方境内生产加工过程中产生的废碎料;和
(l) Goods obtained or produced in a Party solely from products referred to in paragraphs (a) to (k) above. (十二)仅用上述第(一)至(十一)项所列产品在缔约一方加工获得的产品。
Article 15 Not Wholly Produced or Obtained Products 

第十五条 非完全获得或生产的产品

(a) For the purposes of Article 13(b), a product shall be deemed to be originating if not less than 40% of its content originates from a Party. (一)十三条(二)中,如原产于缔约一方的成分在产品中不少于40%,则该产品应视为该方原产。
(b) For the purposes of calculating the originating value content the following method shall apply: (二)计算本地增值成分应适用以下方法:
非原产材料的价格
 -----------×100%<60%
(c) The value of the non-originating materials shall be: 船上交货价格(FOB)
 
(i) the CIF value at the time of importation of the materials; or 
 (三)非原产材料价值应为:
(ii) the earliest ascertained price paid for the materials of undetermined origin in the territory of the Party where the working or processing takes place. 
 1.材料进口时的成本、运费加保险费价格(CIF);或
Article 16 Cumulative Rule of Origin 
Unless otherwise provided for, products which comply with origin requirements provided for in Article 13 and which are used in the territory of a Party as materials for a finished product eligible for preferential treatment under the Agreement shall be considered as products originating in the territory of the Party where working or processing of the finished product has taken place provided that the aggregate China-Pakistan originating content on the final product is not less than 40%. 2.在进行制造或加工的成员方境内最早确定的为不明原产地材料支付的价格。
Article 17 Product Specific Rules 

第十六条 累计原产地规则

Products which have undergone sufficient transformation in a Party shall be treated as originating goods of that Party. Products which satisfy the Product Specific Criteria as annexed to these Rules shall be considered as goods to which sufficient transformation has been carried out in a Party. 除另有规定外,符合第十三条原产地要求的产品在缔约一方境内用作生产享受本协议优惠待遇的制成品的原材料,如果最终产品的中国-巴基斯坦累计成分不低于40%的,则该产品应视为原产于制造或加工该制成品的成员方境内。
Article 18 Minimal Operations and Processes 

第十七条 产品特定原产地标准

The following operations or processes shall be considered as minimal operations and shall not be taken into account in determining the origin of a product in terms of Article 13: 在缔约一方经过充分加工的产品应视为该成员方的原产货物。符合本规则附件所列产品特定原产地标准的产品,应视为在缔约一方经过了充分的加工。
(a) Operations to ensure the preservation of products in good condition during transport and storage (such as drying, freezing, keeping in brine, ventilation, spreading out, chilling, placing in salt, sulphur dioxide or other aqueous solutions, removal of damaged parts, and like operations); 

第十八条 微小加工及处理

 下列的加工或处理均视为微小加工及处理,在按照第十三条确定货物原产地时,应不予考虑:
(b) Simple operations consisting of removal of dust, sifting or screening, sorting, classifying, matching (inkling the making-up of sets of articles), washing, painting, cutting; 
 (一)为运输或贮存货物使货物保持良好状态的处理(例如干燥、冷冻、盐水保存、通风、摊开、冷却、置于盐、二氧化硫或其他水溶液中、去除已损害部分等类似处理);
(c) Changes of packing and breaking up and assembly of consignments; 
 (二)除尘、筛选、分类、分级、匹配(指示组成成套物品),洗涤、涂抹和切割;
(d) Simple cutting, slicing and repacking or placing in bottles, flasks, bags, boxes, fixing on cards or boards and all other simple packing operations; 
 (三)改变包装及为发货而进行的拆分、装配;
(e) Affixing of marks, labels or other like distinguishing signs on products or their packaging; 
 (四)简单的切割、切片和再包装,或者装瓶、入袋、进箱、固定在硬纸板或木板上,以及其他所有的简单包装操作;
(f) Simple mixing of products whether or not of different kinds, where one or more components of the mixture do not meet the conditions laid down in this Chapter to enable them to be considered as originating products; 
 (五)在产品或包装上粘贴标志、标签或其他类似的区别标记;
(g) Simple assembly of parts of products to constitute a complete product; 
 (六)简单混合不论是否同种类的产品,而且该混合而得的一个或多个组成部分不得因满足本章规定的条件而获得原产地资格;
(h) Disassembly; 
 (七)简单组装产品的各部件以组成一个完整品;
(i) Slaughter of animals; 
 (八)拆装;
(j) Mere dilution with water or another substance that does not materially alter the characteristics of the goods; and 
 (九)屠宰动物;
(k) A combination of two or more operations referred to in paragraphs (a) to (j). 
 (十)仅用水或其他物质稀释,而不改变货物的性质;以及
Article 19 Direct Consignment 
The following shall be considered as consigned directly from the exporting Party to the importing Party: (十一)上述(一)到(十)项中的两项或多项操作的组合。
(a) If the products are transported without passing through the territory other than China and Pakistan; 

第十九条 直接运输

 下列情况应视为从出口成员方向进口成员方的直接运输:
(b) The products whose transport involves transit through one or more intermediate non-CPFTA countries with or without transshipment or temporary storage in such countries, provided that: 
 (一)货物运输未经过中国和巴基斯坦以外的任何其他国家或地区境内;
(i) the transit entry is justified for geographical reason or by consideration related exclusively to transport requirements; 
 (二)货物运输途中经过中国-巴基斯坦自由贸易区成员方之外的一个或多个国家境内,不论是否在这些国家转换运输工具或作临时储存,如果:
(ii) the products have not entered into trade or consumption there;and 
 1.可证明过境运输是由于地理原因或仅出于运输需要的考虑;
(iii) the products have not undergone any operation there other than unloading and reloading or any operation required to keep them in good condition. 
 2.货物未在这些国家进入贸易或消费领域;以及
Article 20 Treatment of Packing 
 3.除装卸或其他为使货物保持良好状态的处理外,货物在这些国家未经任何其他操作。
(a) Where for purposes of assessing customs duties, a Party treats products separately from their packing; it may also, in respect of its imports consigned from another Party, determine separately the origin of such packing. 
 

第二十条 包装

(b) Where paragraph (a) above is not applied, packing shall be considered as forming a whole with the products and no part of any packing required for their transport or storage shall be considered as having been imported from outside the CPFTA when determining the origin of the products as a whole. 
 (一)缔约一方如对货物及其包装分别计征关税,就可对从另缔约一方进口的货物及其包装分别确定原产地。
Article 21 Accessories, Spare Parts and Tools 
The origin of accessories, spare parts, tools and instructional or other information materials presented with the goods therewith shall be neglected in determining the origin of the goods, provided that such accessories, spare parts, tools and information materials are classified and collected customs duties with the goods by the importing member state. (二)在上述第(一)项不适用的情况下,包装应与货物视为一个整体,运输或贮藏所需的包装在确定货物原产地时应与货物一并考虑,而不应将其视为从中国-巴基斯坦自由贸易区外进口。
Article 22 Treatment of Indirect Materials 

第二十一条 附件、备件及工具

Unless otherwise provided, for the purpose of determining the origin of goods, the origin of indirect materials as defined in Article 12 (h), or the materials used in its manufacture which do not remain in the goods or form part of the goods, shall not be taken into account. 如进口成员方将与货物一同报验的附件、备件、工具及指导性或其他介绍说明性材料同货物一并归类和征收关税,在确定该货物的原产地时,这些附件,备件及工具等应忽略不计。
Article 23 Certificate of Origin 

第二十二条 间接材料

A claim that products shall be accepted as eligible for preferential concession shall be supported by a Certificate of Origin issued by a government authority designated by the exporting Party and notified to the other Party to the Agreement in accordance with the operational certification procedures, as set out in Annex II. 除另有规定外,在确定货物的原产地时,应不考虑在第十二条(八)中定义的间接材料的原产地,对在制造过程中未留在货物里或未构成货物一部分的材料的原产地也不予考虑。
Article 24 Review and Modification 

第二十三条 原产地证书

These rules may be reviewed and modified as and when necessary upon request of a Party and may be open to such reviews and modifications as may be agreed upon by both Parties. 申请享受优惠关税减让的产品,申报时应提交由出口成员方指定并已按附件二所列签证操作程序的规定通知协议另缔约一方的政府机构签发的原产地证书。
Chapter V Trade Remedies 

第二十四条 审议及修改

 应缔约一方要求,必要时可对这些规则进行审议及修改。如经双方共同同意,这些规则的审议及修改可予以开放。
Article 25 Anti-Dumping and Countervailing Measures 
 

第五章 贸易救济

1. The Parties maintain their rights and obligations under the Agreement on Implementation of Article VI of the GATT 1994 and the Agreement on Subsidies and Countervailing Measures, which are parts of the WTO Agreement. 
 

第二十五条 反倾销和反补贴措施

2. Antidumping actions taken pursuant to Article VI of GATT l994 and the Agreement on Implementation of Article VI of the GATT 1994 or countervailing actions taken pursuant to Article VI of GATT l994 and the Agreement on Subsidies and Countervailing Measures shall not be subject to Chapter X (Dispute Settlement) of this Agreement. 
 一、缔约双方保留构成WTO协定组成部分的《关于实施1994年关税与贸易总协定第六条的协定》和《补贴与反补贴措施协定》项下的权利与义务。
Article 26 Global Safeguard Measures 
 二、缔约双方依据GATT1994第六条和《关于实施1994年关税与贸易总协定第六条的协定》所采取的反倾销措施,和依据GATT1994第六条和《补贴与反补贴措施协定》所采取的反补贴措施均不适用本协定第十章(争端解决)的规定。
1. The Parties maintain their rights and obligations under Article XIX of GATT l994 and the Safeguards Agreement. 
 

第二十六条 全球性保障措施

2. Actions taken pursuant to Article XIX of GATT 1994 and the Safeguards Agreement shall not be subject to Chapter X (Dispute Settlement) of this Agreement. 
 一、缔约双方保留GATT1994第十九条和《保障措施协定》项下的权利与义务。
Article 27 Bilateral Safeguard Measures 
 二、缔约方依据GATT1994第十九条和保障措施协定所采取的行动不适用本协定第十章(争端解决)的规定。
1. For purposes of this Section: 
 

第二十七条 双边保障措施

(a) Competent investigating authority means: 
 一、在本节中:
(i) in the case of China, Ministry of Commerce, or its successor; and 
 (一)主管调查机关指:
(ii) in the case of Pakistan, National Tariff Commission, or its successor; 
 1.就中国而言,商务部,或其继任者;及
(b) Domestic industry means "the producers as a whole of the like or directly competitive product operating within the territory of the Party, or those producers whose collective production of the like or directly competitive product constitutes a major proportion of the total domestic production of such product"; 
 2.就巴基斯坦而言,全国关税委员会,或其继任者。
(c) Serious injury means "a significant overall impairment in the position of a domestic industry"; 
 (二)国内产业指在一方领土内生产同类产品或直接竞争产品的生产者全体,或指同类产品或直接竞争产品的总产量占这些产品全部国内产量主要部分的生产者;
(d) Threat of serious injury means "serious injury that, on the basis of facts and not merely on allegation, conjecture or remote possibility, is clearly imminent"; and 
 (三)严重损害指对一国内产业状况的重大全面减损;
(e) Transition period means "five-year period in the first phase of customs duty reduction or elimination". With regard to transition period in the second phase, the Parties shall meet to determine it in the review of this Article. 
 (四)严重损害威胁指根据事实,而非仅凭指控、推测或极小的可能性确定的,且明显迫近的严重损害;以及
2. During the transition period only, if as a result of the reduction or elimination of a customs duty under this Agreement, an originating good of a Party is being imported into the other party's territory in such increased quantities, in absolute terms, and under such conditions as to constitute a substantial cause of serious injury or threat of serious injury to domestic industry producing a like or directly competitive product, the importing Party may: 
 (五)过渡期指降低或取消关税第一阶段的五年期间。关于第二阶段的过渡期,缔约双方应在审议本条款时决定。
(a) suspend the further reduction of any rate of customs duty on the good provided for under this Agreement; or 
 二、如果由于按照本协定降低或取消关税,导致原产于一缔约方的产品被进口至另一缔约方领土内的数量绝对增加,且从出口方进口本产品构成对进口方生产同类产品或直接竞争产品的国内产业造成严重损害或带来严重损害威胁,则,仅限于在过渡期内,进口方可:
(b) increase the rate of customs duty on the good to a level not to exceed the lesser of 
 (一)中止按照本协定的规定进一步削减此产品关税税率;或者
(i) The MFN applied rate of customs duty on the good in effect at the time the measure is taken; and 
 (二)提高此产品的关税税率,但不应超过下列税率两者之中较低水平:
(ii) The MFN applied rate of customs duty on the good in effect on date of entry into force of this agreement; or 
 1.采取此措施时,正在实施的最惠国关税税率;以及
(c) in the case of a customs duty applied to a good on a seasonal basis, increase the rate of customs duty to a level not to exceed the lesser of 
 2.本协定正式生效之日正在实施的最惠国关税税率。
(i) the MFN applied rate of customs duty on the good in effect for the immediately preceding corresponding season; and 
 (三)如果对货物实施的是季节税,提高关税税率,但不应超过下列税率两者之中较低水平:
(ii) the MFN applied rate of customs duty on the good in effect on the date of entry into force of this agreement. 
 1.措施实施之日前相应季节使用的该货物的最惠国关税税率;以及
3. The following conditions and limitations shall apply to an investigation or a measure described in Paragraph 1(a). 
 2.本协定正式生效之日正在实施的最惠国关税税率。①
①协议双方认为关税配额和数量限制都不属于保障措施所允许的形式。
(a) A party shall immediately deliver written notice to the other Party upon: 
 三、下列条件和限制对第一款第(一)项规定的调查措施适用:
(i) initiating an investigatory process relating to serious injury or threat thereof and the reasons for it; 
 (一)在下列情况下,一缔约方应立即以书面形式通知另一缔约方:
(ii) making a finding of serious injury or threat thereof caused by increased imports; and 
 1.发起与由此产生的严重损害或严重损害威胁相关的调查活动及其原因;
(iii) taking a decision to apply a safeguard measure. 
 2.得出因进口增加造成严重损害或严重损害威胁的调查结果;以及
(b) in making the notification referred to in paragraph (a)(ii) and (a)(iii), the Party proposing to apply or extend a safeguard measure shall provide the other Party with all pertinent information, which shall include evidence of serious injury or threat thereof caused by the increased imports, precise description of the good involved and the proposed measure, proposed date of introduction and expected duration; the Party proposing to apply a measure shall also provide any additional information which the other Party considers pertinent; 
 3.决定采取一项保障措施。
(c) a Party proposing to apply a measure shall provide adequate opportunity for prior consultations with the other Party as far in advance of taking any such measure as practicable, with a view to reviewing the information arising from the investigation, exchanging views on the measure and reaching an agreement on compensation set out in Paragraph 4. The Parties shall in such consultations, review, inter alia, the information provided under paragraph (b), to determine: 
 (二)在作出第(一)项2和3所指的通知时,提出实施或延长保障措施的缔约方应向另一缔约方提供所有相关的信息,包括增加的进口造成严重损害或严重损害威胁的证据、对所涉及产品和拟议采取的措施的准确描述、拟议采取措施的日期和预期期限;提出实施措施的缔约方还应提供另一缔约方认为相关的任何其他信息;
(i) compliance with the other provisions of this Article; 
 (三)提出实施保障措施的缔约方应在采取保障措施前,在尽可能早的时间里,为另一缔约提供充分的机会,以便事先磋商,以审议调查的信息、交换关于保障措施的观点和就第四款提及的补偿达成一致。在上述磋商中,缔约双方应特别就第(二)项中的信息进行审议,以决定:
(ii) whether any proposed measure should be taken; and 
 1.与本条其他规定是否一致;
(iii) the appropriateness of the proposed measure, including consideration of alternative measures; 
 2.是否采取拟议的保障措施;以及
(d) a Party shall apply the measure only following an investigation by the competent authorities of such Party in accordance with Articles 3 and 4.2(c) of the WTO Agreement on Safeguards; and to this end, Articles 3 and 4.2(c) of the WTO Agreement on Safeguards are incorporated into and made a part of this Agreement, mutatis mutandis; 
 3.拟议的保障措施的恰当性,包括考虑其他替代的保障措施。
(e) in undertaking the investigation described in paragraph (d), a Party shall comply with the requirements of Article 4.2(a) and (b) of the WTO Agreement on Safeguards; and to this end, Article 4.2(a) and (b) are incorporated into and made a part of this Agreement, mutates mutandis; 
 (四)一缔约方只有经过主管机关按照世界贸易组织《保障措施协定》第3条和第4.2(c)条进行调查后,才能实施保障措施;并且为此目的,世界贸易组织《保障措施协定》第3条和第4.2(c)条在细节上作必要修改后应成为本协定一个组成部分;
(f) the investigation shall in all cases be completed within one year following its date of initiation; 
 (五)在开展第(四)项中所述的调查中,一方应遵守世界贸易组织《保障措施协定》第4.2(a)和(b)条的要求;并且为此目的,第4.2(a)和(b)条在细节上作必要修改后应成为本协定一个组成部分;
(g) no bilateral safeguard measure shall be maintained: 
 (六)无论什么情况,调查都应在其启动之日后一年内完成。
(i) except to the extent and for such time as may be necessary to remedy serious injury and to facilitate adjustment; 
 (七)根据本条采取的任何措施应符合下列条件:
(ii) for a period exceeding two years, except that in exceptional circumstances, the period may be extended by up to an additional one year, to a total maximum of three years from the date of first imposition of the measure if the investigating authorities determine in conformity with procedures set out paragraphs (a) through (g), that the safeguard measure continues to be necessary to prevent or remedy serious injury and to facilitate adjustment and that there is evidence that the industry is adjusting;
