(Interpretation No.1 [2011] of the Supreme People's Court, adopted at the 1,507th Session of the Judicial Committee of the Supreme People's Court on December 27, 2010) | |

To solve the problems concerning the application of law in the jurisdiction, preservation, and enforcement, etc. of the relevant futures disputes, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China, the relevant laws and administrative regulations, and in light of the needs of the trial practice. | |
为解决相关期货纠纷案件的管辖、保全与执行等法律适用问题，根据《中华人民共和国民事诉讼法》等有关法律、行政法规的规定以及审判实践的需要，制定本规定。 |

| Article 1 A commercial case arising from the performance of duties by a futures exchange which is the defendant or the third party shall be under the jurisdiction of the intermediate people's court at the place where the futures exchange is located. | | 第一条 以期货交易所为被告或者第三人的因期货交易所履行职责引起的商事案件，由期货交易所所在地的中级人民法院管辖。 |

| Article 2 The term “commercial case arising from the performance of duties by a futures exchange” shall refer to: | | 第二条 期货交易所履行职责引起的商事案件是指： |

| 1. a commercial litigation case lodged by a member of the futures exchange or a relevant person thereof, a margin custodian bank or a relevant person thereof, a client, or any other futures market participant against a futures exchange on the ground that the said exchange has, as in violation of any law, regulation or provision of the futures regulatory authority of the State Council, improperly performed its duties of supervision and administration and caused any damage to it/him; | | （一）期货交易所会员及其相关人员、保证金存管银行及其相关人员、客户、其他期货市场参与者，以期货交易所违反法律法规以及国务院期货监督管理机构的规定，履行监督管理职责不当，造成其损害为由提起的商事诉讼案件； |

| 2. a commercial litigation case lodged by a member of the futures exchange or a relevant person thereof, a margin custodian bank or a relevant person thereof, a client, or any other futures market participant against a futures exchange on the ground that the said exchange has, as in violation of any provision of its bylaws, trading rules or detailed implementing rules or any stipulation of its business agreements, improperly performed its duties of supervision and administration and caused any damage to it/him; or | | （二）期货交易所会员及其相关人员、保证金存管银行及其相关人员、客户、其他期货市场参与者，以期货交易所违反其章程、交易规则、实施细则的规定以及业务协议的约定，履行监督管理职责不当，造成其损害为由提起的商事诉讼案件； |

| 3. any other commercial litigation case arising from the performance of duties by a futures exchange. | | （三）期货交易所因履行职责引起的其他商事诉讼案件。 |

Article 3 Where a futures exchange is the debtor, and the creditor claims for freezing or transferring the following funds or negotiable securities in the account, the people's court shall not support such claim:
