| In accordance with the relevant laws and regulations and the Plan for Comprehensively Furthering the Efforts of Reform and Opening Up in the China (Shanghai) Pilot Free Zone, the Action Plan of Shanghai Municipality to Carry Out the State's Major Initiatives for further expansion of Opening Up and Accelerate the Establishment of a New System of Open Economy, and the Implementing Measures for the Negative List Administrative Mode of Cross-Border Trade in Services in the China (Shanghai) Pilot Free Trade Zone, the Special Administrative Measures (Negative List) for Cross-Border Trade in Services in the China (Shanghai) Pilot Free Trade Zone (2018) is hereby issued with effect from November 1, 2018. | | 根据有关法律法规和国务院批准的《全面深化中国（上海）自由贸易试验区改革开放方案》《上海市贯彻落实国家进一步扩大开放重大举措加快建立开放型经济新体制行动方案》《中国（上海）自由贸易试验区跨境服务贸易负面清单管理模式实施办法》，现予公布《中国（上海）自由贸易试验区跨境服务贸易特别管理措施（负面清单）（2018年）》，自2018年11月1日起施行。 |

| I. The Special Administrative Measures (Negative List) for Cross-Border Trade in Services in the China (Shanghai) Pilot Free Trade Zone (2018) (hereinafter referred to as the “Negative List”) is developed in accordance with the current laws, regulations, rules, and relevant state provisions. For purposes of the Negative List, “cross-border trade in services” means: | | 一、《中国（上海）自由贸易试验区跨境服务贸易特别管理措施（负面清单）（2018年）》（以下简称《跨境服务贸易负面清单》）依据现行法律、法规、规章和国家有关规定编制。《跨境服务贸易负面清单》所称跨境服务贸易，是指： |
| (1) providing services from overseas into the China (Shanghai) Pilot Free Trade Zone (“SHFTZ”), i.e. the mode of cross-border supply; | | （一）自境外向中国（上海）自由贸易试验区（以下简称“自贸试验区”）内提供服务，即跨境交付模式； |
| (2) providing services overseas to consumers from the SHFTZ, i.e. the mode of consumption abroad; and | | （二）在境外向来自自贸试验区内的消费者提供服务，即境外消费模式； |
(3) providing services by an overseas service provider via presence of a natural person in the SHFTZ, i.e. the mode of movement of natural persons.
