| The construction of pilot free trade zones (hereinafter referred to as PFTZs) is a strategic move of the CPC Central Committee and the State Council to comprehensively deepen reform and expand opening-up under the new situation. The report of the 19th CPC National Congress emphasized the need to give greater autonomy to PFTZs and set new directions and raise new requirements for the construction of PFTZs in the new era. In order to implement the decisions and arrangements of the CPC Central Committee and the State Council, support PFTZs in deepening reform and innovation, and further improve the quality of construction, the relevant matters are hereby notified as follows: | | 建设自由贸易试验区（以下简称自贸试验区）是党中央、国务院在新形势下全面深化改革和扩大开放的战略举措。党的十九大报告强调要赋予自贸试验区更大改革自主权，为新时代自贸试验区建设指明了新方向、提出了新要求。为贯彻落实党中央、国务院决策部署，支持自贸试验区深化改革创新，进一步提高建设质量，现将有关事项通知如下： |
| I. Creating a Good Investment Environment | | 一、营造优良投资环境 |
| 1. Relax the requirements for the proportion of foreign technical personnel in foreign-invested construction and engineering design enterprises, and relax the restrictions on human resource intermediaries, by drawing on the experience of the comprehensive pilot program of expanding the opening-up of the service industry in Beijing. (Responsible departments: Ministry of Human Resources and Social Security, Ministry of Housing and Urban-Rural Development, Ministry of Commerce. Scope of application: all PFTZs, the following measures are applicable to all PFTZs, except for those marked as applicable to specific PFTZs) | | （一）借鉴北京市服务业扩大开放综合试点经验，放宽外商投资建设工程设计企业外籍技术人员的比例要求、放宽人才中介机构限制。（负责部门：人力资源社会保障部、住房城乡建设部、商务部；适用范围：所有自贸试验区，以下除标注适用于特定自贸试验区的措施外，适用范围均为所有自贸试验区） |
| 2. When preparing and issuing the national land use plan, consider the actual situation of PFTZs and reasonably arrange the land use plans for the relevant provinces (municipalities directly under the Central Government); the relevant local authorities shall support the construction of PFTZs on a priority basis and promote the healthy and orderly development of PFTZs. (Responsible department: Ministry of Natural Resources) | | （二）编制下达全国土地利用计划时，考虑自贸试验区的实际情况，合理安排有关省（市）的用地计划；有关地方应优先支持自贸试验区建设，促进其健康有序发展。（负责部门：自然资源部） |
| 3. Delegate the approval authority for licenses of construction projects such as construction permits for construction projects and production safety licenses for construction engineering enterprises to PFTZs. (Responsible department: Ministry of Housing and Urban-Rural Development) | | （三）将建筑工程施工许可、建筑施工企业安全生产许可等工程审批类权限下放至自贸试验区。（负责部门：住房城乡建设部） |
| 4. Authorize PFTZs to carry out pilot work, and change the licensing system implemented by competent authorities at or below the provincial level to the notification and commitment system in terms of construction enterprises' application for or upgrading of qualification, and adding of new qualifications (Responsible department: Ministry of Housing and Urban-Rural Development) | | （四）授权自贸试验区开展试点工作，将省级及以下机关实施的建筑企业资质申请、升级、增项许可改为实行告知承诺制。（负责部门：住房城乡建设部） |
| 5. Delegate the approval authority, at or below the provincial level, for the qualifications and permits for investment in and establishment of the construction industry (including subjects related to engineering construction such as design, construction, supervision, inspection, cost consulting) to PFTZs. (Responsible department: Ministry of Housing and Urban-Rural Development) | | （五）将外商投资设立建筑业（包括设计、施工、监理、检测、造价咨询等所有工程建设相关主体）资质许可的省级及以下审批权限下放至自贸试验区。（负责部门：住房城乡建设部） |
| 6. When a wholly foreign-owned construction enterprise in a PFTZ undertakes a Sino-foreign joint construction project of the province (municipality directly under the Central Government) concerned, it is not subject to the restriction on the proportion of Chinese investment to foreign investment in construction projects. (Responsible department: Ministry of Housing and Urban-Rural Development) | | （六）自贸试验区内的外商独资建筑业企业承揽本省（市）的中外联合建设项目时，不受建设项目的中外方投资比例限制。（负责部门：住房城乡建设部） |
| 7. Under the Mainland and Hong Kong Closer Economic Partnership Arrangement, the Mainland and Macao Closer Economic Partnership Arrangement and the Cross-Straits Economic Cooperation Framework Agreement, Hong Kong, Macao and Taiwan-invested construction enterprises in PFTZs are not subject to the restrictive provisions on project contracting scope in the Provisions on the Administration of Foreign-invested Construction Enterprises. (Responsible department: Ministry of Housing and Urban-Rural Development) | | （七）在《内地与香港关于建立更紧密经贸关系的安排》、《内地与澳门关于建立更紧密经贸关系的安排》、《海峡两岸经济合作框架协议》下，对自贸试验区内的港澳台资建筑业企业，不再执行《外商投资建筑业企业管理规定》中关于工程承包范围的限制性规定。（负责部门：住房城乡建设部） |
| 8. For foreign-invested engineering design (except for engineering survey) enterprises in PFTZs that serve the provinces (municipalities directly under the Central Government) concerned, the engineering design performance requirements for investors at the time of first application for qualification shall be canceled. (Responsible department: Ministry of Housing and Urban-Rural Development) | | （八）对于自贸试验区内为本省（市）服务的外商投资工程设计（工程勘察除外）企业，取消首次申请资质时对投资者的工程设计业绩要求。（负责部门：住房城乡建设部） |
| 9. Health administrative departments shall implement the notification and commitment system for the allocation of Class-B large medical equipment to privately-invested medical institutions in PFTZs. (Responsible department: National Health Commission) | | （九）卫生健康行政部门对自贸试验区内的社会办医疗机构配置乙类大型医用设备实行告知承诺制。（负责部门：卫生健康委） |
| 10. Medical institutions in PFTZs may conduct research projects on cutting-edge clinical medical technologies for stem cells according to their own technical capabilities and in accordance with the relevant regulations. (Responsible department: National Health Commission) | | （十）自贸试验区内医疗机构可根据自身的技术能力，按照有关规定开展干细胞临床前沿医疗技术研究项目。（负责部门：卫生健康委） |
| 11. Allow PFTZs to introduce innovative tax service initiatives that are in line with international standards. (Responsible department: State Administration of Taxation) | | （十一）允许自贸试验区创新推出与国际接轨的税收服务举措。（负责部门：税务总局） |
| 12. Provincial market regulatory departments may delegate the preliminary examination authority for the registration of resident representative offices of foreign enterprises to the market regulatory departments with the administrative authority for registration of foreign investment in PFTZs. (Responsible department: State Administration for Market Regulation) | | （十二）省级市场监管部门可以将外国（地区）企业常驻代表机构登记注册初审权限下放至自贸试验区有外资登记管理权限的市场监管部门。（负责部门：市场监管总局） |
| 13. Support the establishment of trademark reception windows in PFTZs. (Responsible department: National Intellectual Property Administration) | | （十三）支持在自贸试验区设置商标受理窗口。（负责部门：知识产权局） |
| 14. Establish acceptance points in PFTZs to accept the registration of the pledge of trademark rights. (Responsible department: National Intellectual Property Administration) | | （十四）在自贸试验区设立受理点，受理商标权质押登记。（负责部门：知识产权局） |
| 15. Further relax the restrictions on the conditions for shareholders of patent agencies. If a limited liability patent agency is newly established, Chinese citizens who account for no more than one-fifth of the total number of shareholders, have no patent agent qualification, have reached the age of 18, and can work at the patent agency on a full-time basis are allowed to act as shareholders of the patent agency. (Responsible department: National Intellectual Property Administration) | | （十五）进一步放宽对专利代理机构股东的条件限制，新设立有限责任制专利代理机构的，允许不超过五分之一不具有专利代理人资格、年满18周岁、能够在专利代理机构专职工作的中国公民担任股东。（负责部门：知识产权局） |
| 16. Strengthen the top-level design and explore and innovate the oil reserve model that combines innovative government reserves with enterprise reserves in PFTZs. (Responsible departments: National Development and Reform Commission, National Grain and Material Reserve Bureau. Scope of application: Zhejiang Pilot Free Trade Zone) | | （十六）加强顶层设计，在自贸试验区探索创新政府储备与企业储备相结合的石油储备模式。（负责部门：发展改革委、粮食和储备局，适用范围：浙江自贸试验区） |

| 17. Study and support the implementation of bonded supervision for the aviation maintenance businesses outside the areas under special customs supervision which "put both ends of the production process (the supply of raw materials and the marketing of products) on the world market". (Responsible departments: Ministry of Commerce, General Administration of Customs, Ministry of Finance, State Administration of Taxation) | | （十七）研究支持对海关特殊监管区域外的“两头在外”航空维修业态实行保税监管。（负责部门：商务部、海关总署、财政部、税务总局） |
18. Support well-qualified PFTZs in studying and exploring the endowing of international railway freight bills with the function of documents of title so that railway freight bills can serve as bills for negotiation of letters of credit, to improve the level of railway freight transport. (Responsible departments: Ministry of Commerce, China Banking and Insurance Regulatory Commission, National Railway Administration, China Railway Corporation)
