| Decision of the Ministry of Commerce on Repealing and Amending Some Rules | | 《商务部关于废止和修改部分规章的决定》 |
| For the purposes of continuing to further the simplification of administrative procedures and decentralization of powers, combination of decentralization and control, and optimization of service reform, in accordance with the requirements of the State Council, the Ministry of Commerce has reviewed the rules involved in the matters such as repealing administrative approval items. It is hereby decided that: | | 为继续深化简政放权、放管结合、优化服务改革，根据国务院要求，商务部对取消行政审批项目等事项涉及的规章进行了清理。现决定： |
| I. Three rules are repealed. | | 一、对3部规章予以废止 |
| (1) The Detailed Rules for the Approval and Management of Resident Representative Offices of Foreign Enterprises in China (Order No. 3 [1995], MOFTEC) are repealed. | | （一）废止《关于审批和管理外国企业在华常驻代表机构的实施细则》（外经贸部令1995年第3号）。 |
| (2) The Interim Measures for the Qualification Certification of Export Suppliers of Tungsten Products and Antimony Products (Order No. 21 [2001], SETC and MOFTEC) are repealed. | | （二）废止《钨品、锑品出口供货企业资格认证暂行办法》（国家经贸委、外经贸部令2001年第21号）。 |
| (3) Through consultation with and obtaining the approval of the Ministry of Housing and Urban-Rural Development, the Measures for the Administration of the Qualification for Contracting Foreign Projects (Order No. 9 [2009], MOF and MHURD) are repealed. | | （三）经商住房城乡建设部同意，废止《对外承包工程资格管理办法》（商务部、住房城乡建设部令2009年第9号）。 |
| II. Some clauses of three rules are amended. | | 二、对3部规章的部分条款予以修改 |
| (1) Through consultation with and obtaining the approval of the Ministry of Public Security, the State Administration for Industry and Commerce and the State Administration of Taxation, Articles 9, 10 and 11 of the Administrative Measures for the Circulation of Used Cars (Order No. 2 [2005], MOC, MPS, SAIC and SAT) are deleted. | | （一）经商公安部、工商总局、税务总局同意，删去《二手车流通管理办法》（商务部、公安部、工商总局、税务总局令〔2005〕第2号）第九条、第十条、第十一条。 |
(2) Through consultation with and obtaining the approval of the Ministry of Finance and the China Banking Regulatory Commission, Article 23 of the Measures for the Administration of Risk Disposal Reserves for Foreign Labor Service Cooperation (for Trial Implementation) (Order No. 2 [2014], MOC and MOF) is amended to read:
