| The ecology and environment departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government; the Ecology and Environment Bureau of Xinjiang Production and Construction Corps: | | 各省、自治区、直辖市生态环境厅（局），新疆生产建设兵团生态环境局： |
| For the purposes of thoroughly implementing the spirit of the Fourth Plenary Session of the 19th CPC Central Committee, accelerating the advancement of reform of the licensing system for discharges of pollutants from stationary sources of pollution, and achieving the tasks and objectives for the full coverage of the licensing administration of discharges of pollutants from stationary sources of pollution, in accordance with the Environmental Protection Law of the People's Republic of China, the Atmospheric Pollution Prevention and Control Law of the People's Republic of China, the Water Pollution Prevention and Control Law of the People's Republic of China, the Notice by the General Office of the State Council of Issuing the Implementation Plan for the Licensing System for Controlling Pollutant Discharges (No. 81 [2016], General Office of the State Council) and other provisions, you are hereby notified of the relevant matters concerning the rectification of discharges of pollutants during specified periods as follows: | | 为深入贯彻落实党的十九届四中全会精神，加快推进固定污染源排污许可制度改革，实现固定污染源排污许可管理全覆盖任务目标，根据《中华人民共和国环境保护法》《中华人民共和国大气污染防治法》《中华人民共和国水污染防治法》和《国务院办公厅关于印发控制污染物排放许可制实施方案的通知》（国办发〔2016〕81号）等规定，现就排污限期整改有关事项通知如下： |
| I. Applicable circumstances | | 一、适用情形 |
| If a pollutant discharging entity falls under any of the following circumstances, an ecology and environment department shall temporarily not issue a pollutant discharge permit to it, and shall issue a notice of rectification of the discharge of pollutants during a specified period (hereinafter referred to as a ‘notice of rectification'). | | 排污单位存在下列情形之一的，生态环境主管部门暂不予核发排污许可证，并下达排污限期整改通知书（以下简称整改通知书）。 |
| (1) It is in the category of those ‘failing to meet the discharge standards', that is, its discharge of pollutants fails to meet the requirements of pollutant discharge standards; its discharge of major pollutants fails to comply with the technical specifications for pollutant discharge permit application and issuance, the approval document for the environmental impact report (form), and total quantity control requirements for the discharge of major pollutants; and the pollutant discharging entity is located in a key area or drainage basin that does not meet the national environmental quality standards, and its discharge of pollutants fails to meet the special requirements of the relevant local people's governments for improving the quality of ecology and environment. | | （一）“不能达标排放”类，污染物排放不符合污染物排放标准要求；重点污染物排放不符合排污许可证申请与核发技术规范、环境影响报告书（表）批准文件、重点污染物排放总量控制要求；排污单位位于未达到国家环境质量标准的重点区域、流域，污染物排放不符合有关地方人民政府关于改善生态环境质量特别要求的。 |
| (2) It is in the category of those ‘failing to undergo complete formalities', that is, it fails to obtain the approval document for the environmental impact report (form) for a construction project, and fails to undergo the environmental impact registration and recordation formalities, except for where the relevant certification materials have been obtained according to relevant provisions proving that it has been dealt with, rectified and regulated by the local people's government in accordance with the law, and meet relevant requirements, or has obtained the pollutant discharge permit in accordance with the relevant provisions issued by the local people's government. | | （二）“手续不全”类，未依法取得建设项目环境影响报告书（表）批准文件，未办理环境影响登记备案手续，但是已经按照有关规定获得经地方人民政府依法处理、整顿规范并符合要求的相关证明材料的，或者按照地方人民政府有关规定已经取得排污许可证的除外。 |
| (3) It is in the category of ‘other', that is, it fails to install and use automatic monitoring equipment and be connected to the monitoring equipment of the ecology and environment department as required, or fails to set pollutant discharge outlets as required. | | （三）“其他”类，如未按照规定安装、使用自动监测设备并与生态环境主管部门监控设备联网，未按规定设置污染物排放口等。 |
| II. Rectification period | | 二、整改期限 |
| A rectification period shall be three months to one year. Where there are multiple rectification circumstances, a notice of rectification shall put forward corresponding each rectification requirement respectively, and the rectification period shall be longest of the rectification periods specified for the aforementioned circumstances, which cannot be accumulated and shall not exceed one year. | | 整改期限为三个月至一年。对于存在多种整改情形的，整改通知书应分别提出相应整改要求，整改期限以整改时间最长的情形为准，不得累加，最长不超过一年。 |
| A pollutant discharging entity shall, according to existing problems, propose a feasible rectification plan. An ecology and environment department shall determine a rectification period in a reasonable manner. | | 排污单位应根据存在的问题，提出切实可行的整改计划。生态环境主管部门应合理确定整改期限。 |
| III. Requirements for the format of a notice of rectification | | 三、整改通知书格式要求 |
| A notice of rectification shall consist of two parts, namely text and attachment. Please refer to the Annex for the specific format. | | 整改通知书由正文和附件两部分组成。具体格式详见附件。 |
