| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For the purposes of regulating consular authentication, maintaining the credibility of consular authentication, promoting foreign contact, and protecting the lawful rights and interests of natural persons, legal persons, and other organizations, these Measures are developed. | | 第一条 为了规范领事认证工作，维护领事认证公信力，促进对外交往，保障自然人、法人或者其他组织的合法权益，制定本办法。 |
| Article 2 These Measures shall be applicable to the consular authentication of the documents that are issued in China for use outside China and the documents that are issued outside China for use in China. | | 第二条 本办法适用于国内出具的需送往国外使用的文书和国外出具的需送至国内使用的文书的领事认证。 |
| Article 3 For the purpose of these Measures, consular authentication means that a consular authentication institution, upon the application of a natural person, a legal person, or another organization, confirms the authenticity of the last seal and signature on a foreign-related notarization or any other certification document issued in China or a relevant document issued in a foreign country. | | 第三条 本办法所称领事认证，是指领事认证机构根据自然人、法人或者其他组织的申请，对国内涉外公证书、其他证明文书或者国外有关文书上的最后一个印鉴、签名的真实性予以确认的活动。 |
| The term “consular authentication institution” as mentioned in the preceding paragraph are institutions that perform consular authentication under these Measures, including the Ministry of Foreign Affairs (“MFA”), the local people's governments' foreign affairs departments authorized by the MFA (hereinafter referred to as “local foreign affairs offices”), embassies and consulates in foreign countries, and other institutions functioning abroad as authorized by the MFA. | | 前款所称领事认证机构，是指依照本办法办理领事认证的机构，包括外交部、外交部委托的地方人民政府外事部门（以下称地方外办）和驻外使馆、领馆以及外交部委托的其他驻外机构。 |
| Entities that handle acceptance, entry, consulting, and other service affairs upon the authorization of consular authentication institutions shall carry out relevant activities within the scope of authorization. | | 领事认证机构委托代办接件、录入、咨询等服务性事务的单位，应当在委托范围内从事相关活动。 |
| Article 4 In performing consular authentication, a consular authentication institution shall comply with the law, adhere to the principles of objectivity and authenticity, and not damage national interests or public interests. | | 第四条 领事认证机构办理领事认证，应当遵守法律，坚持客观、真实的原则，不得损害国家利益和社会公共利益。 |
| Article 5 The MFA shall be responsible for the consular authentication of the state. | | 第五条 外交部负责国家领事认证工作。 |
| Article 6 Consular authentication includes the consular authentication of domestic documents and the consular authentication of foreign documents. | | 第六条 领事认证分为国内文书的领事认证和国外文书的领事认证。 |
| The MFA and local foreign affairs offices shall be responsible for the consular authentication of domestic documents. | | 外交部和地方外办负责办理国内文书的领事认证。 |
| Embassies and consulates in foreign countries, and other institutions functioning abroad as authorized by the MFA shall be responsible for the consular authentication of foreign documents. | | 驻外使馆、领馆以及外交部委托的其他驻外机构负责办理国外文书的领事认证。 |
| Article 7 Consular authentication officers include consular authentication signers and consular authentication assistants. | | 第七条 领事认证人员包括领事认证签署人员和领事认证协助人员。 |
| Consular authentication signers shall be responsible for examination and signing. | | 领事认证签署人员负责审核、签署工作。 |
| Consular authentication assistants shall be responsible for acceptance, certificate making, fees collection, and other routine work. | | 领事认证协助人员负责受理、制证、收费等事务性工作。 |
| Article 8 The consular authentication signers of the MFA, embassies and consulates in foreign countries, and other institutions functioning abroad as authorized by the MFA shall have diplomatic posts of attaché or above or consular posts of consular attaché and above. | | 第八条 外交部和驻外使馆、领馆以及外交部委托的其他驻外机构的领事认证签署人员应当为随员及以上外交职务或者领事随员及以上领事职务。 |
| Consular authentication signers of local foreign affairs offices shall have posts of principal staff member or above. | | 地方外办的领事认证签署人员应当为主任科员及以上职务。 |
| A consular authentication signer shall have more than three years of work experience in diplomatic or foreign affairs, have professional knowledge and competence required for signing for consulate authentication, and participate in relevant training organized by the MFA. | | 领事认证签署人员应当具有3年以上外交或者外事工作经历，具备领事认证签署工作所需的专业知识和能力，并参加外交部组织的相应培训。 |
| Consular authentication signers of embassies and consulates in foreign countries, other institutions functioning abroad as authorized by the MFA, and local foreign affairs offices shall be reported to the MFA for recordation, and be subject to the approval of the MFA under special circumstances. | | 驻外使馆、领馆以及外交部委托的其他驻外机构和地方外办的领事认证签署人员应当报外交部备案，特殊情况应当报外交部批准。 |
| Article 9 A consular authentication officer shall not have any of the following conduct: | | 第九条 领事认证人员不得实施下列行为： |
| (1) Performing consular authentication for himself and his immediate relatives or performing consular authentication in which he or his immediate relative has an interest. | | （一）为本人及其近亲属办理领事认证或者办理与本人及其近亲属有利害关系的领事认证； |
| (2) Failing to issue a consular authentication certificate by the prescribed procedure. | | （二）未按规定程序出具领事认证书； |
| (3) Deliberately damaging or tampering with a consular authentication certificate or a consular authentication file. | | （三）故意毁损、篡改领事认证书或者领事认证档案； |
| (4) Misappropriating or stealing anti-fake paper, seal, or other special items for consulate authentication. | | （四）侵占、盗窃领事认证防伪纸张、印章等专用物品； |
| (5) Seeking monetary or material benefits by taking advantage of his position, or seeking other illicit interests in performing consulate authentication. | | （五）利用办理领事认证的职务便利索取财物，或者牟取其他不正当利益； |
| (6) Other acts prohibited by any law or administrative regulation. | | （六）其他法律、行政法规禁止的行为。 |
| Article 10 An applicant for consular authentication or any other individual or organization shall not have any of the following conduct: | | 第十条 领事认证的申请人以及其他个人或者组织不得实施下列行为： |
| (1) Carrying out illegal activities by using a consular authentication certificate. | | （一）利用领事认证书从事非法活动； |
| (2) Forging or altering a consular authentication certificate. | | （二）伪造、变造领事认证书； |
| (3) Forging or arbitrarily changing or alters a notarization or any other certificate that has been granted consular authentication. | | （三）伪造或者擅自变动、改动经领事认证的公证书或者其他证明文书。 |
| Chapter II Recordation of Specimen Seals and Signatures | | 第二章 印鉴和签名式样的备案 |
| Article 11 A consular authentication institution shall, before performing consular authentication, submit relevant specimen seals and signatures for recordation under this chapter. | | 第十一条 领事认证机构在办理领事认证前应当依照本章规定对相应印鉴和签名式样进行备案。 |
Article 12 Domestic notary organizations and other certification institutions shall submit relevant seals and the specimen signatures of notaries and signers to the MFA or local foreign affairs offices for recordation.
