Since eight departments including the Ministry of Commerce issued the Several Opinions on Promoting the Pilot Program of Parallel Import of Automobiles (No. 50 [2016], Ministry of Commerce), important progress has been made in the pilot program of parallel import of automobiles, a socialized automobile circulation system has basically been established, a group of experience that can be replicated and promoted has been gained, and the diversified and multi-level consumer demand has been effectively satisfied. Nevertheless, there are still problems such as ambiguous procedure for the establishment of sites for conformity modification of parallel imported automobiles, much room for improvement of trade facilitation, and needed strengthening of government regulation. For the purposes of further promoting the well-regulated development of parallel import of automobiles, the following opinions are hereby offered: 商务部等8部门印发《关于促进汽车平行进口试点的若干意见》(商建发[2016]50号)以来,汽车平行进口试点工作取得了重要进展,社会化汽车流通体系基本建立,形成了一批可复制推广经验,有效满足了多样化多层次消费需求。但是,还存在平行进口汽车整改场所设立程序不明确、贸易便利化水平有待提升、政府监管需要强化等问题。为进一步促进汽车平行进口规范发展,现提出如下意见:
I. Allowing the exploration of establishment of sites for modifying parallel imported automobiles to conform to standards. Under the premise of risk controllability and compliance with the laws and regulations, provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning (hereinafter referred to as the "relevant regions") that have already carried out the work related to parallel import of automobiles shall be allowed to establish sites for standards conformity modifications in areas under special customs supervision. The relevant regions shall disclose to the public information on sites for standards conformity modifications determined by the relevant departments of the local people's governments and promptly report to the Ministry of Commerce, the Ministry of Industry and Information Technology, the General Administration of Customs, and the State Administration for Market Regulation. The business of standards conformity modifications to parallel imported automobiles may be conducted only in a modification site, and modification items shall be restricted only to a total of 16 sub-classifications under five major classifications including marks of complete automobiles (see Annex). A parallel imported automobile as modified shall conform to national safety technical standards such as the Technical Specifications for Safety of Power-driven Automobiles Operating on Roads (GB7258). Under the premise of complying with industry policies and relevant customs rules, a designated certification body may conduct CCC factory inspection only on modification sites in areas under special customs supervision, depending on the circumstances. The relevant regions shall effectively strengthen the supervision of modification sites, clarify the departmental regulatory duties and responsible entities, and strictly prohibit modification sites from carrying out business other than standards conformity modifications. A video recording of modification shall be made throughout, and the relevant video recording shall be retained for not less than three years.   一、允许探索设立平行进口汽车标准符合性整改场所。在风险可控、依法合规前提下,允许已开展汽车平行进口工作的省、自治区、直辖市、计划单列市(以下简称有关地区)在海关特殊监管区域内设立标准符合性整改场所。有关地区应向社会公布经当地人民政府有关部门确定的标准符合性整改场所信息,并及时上报商务部、工业和信息化部、海关总署、市场监管总局。平行进口汽车标准符合性整改业务只能在整改场所实施,且整改项目仅限于整车标志等5大类别共计16小项(详见附件)。经整改后的平行进口汽车应当符合《机动车运行安全技术条件》(GB7258)等国家安全技术标准。在符合产业政策、海关相关规定的前提下,指定认证机构可视情况仅对在海关特殊监管区域内的整改场所进行CCC认证工厂检查。有关地区要切实加强整改场所监管,明确部门监管职责和责任主体,严禁整改场所开展标准符合性整改以外的业务。整改过程应全程录像,相关影像资料保存期不少于3年。
II. Further improving trade facilitation with respect to parallel import of automobiles. The application and management system for automatic import licenses for automobiles shall be simplified, and for automatic import licenses for parallel imported automobile products for which enterprises that are determined to conduct the business of parallel import of automobiles by the relevant regions (hereinafter referred to as the "enterprises under the pilot program"), the provincial commerce departments of the relevant regions shall be commissioned to print and issue the automatic import licenses, as examined and granted by the Ministry of Commerce. The paperless application for automatic import licenses shall be vigorously furthered, and the application of electronic documents of imports shall be promoted. Parallel imported automobiles shall conform to the provisions on the administration of import ports for complete automobiles issued by the State Council, and the relevant procedures shall be instituted at import ports, at the time of import on leaving bonded zones, in accordance with relevant provisions. The relevant regions shall allow non-local enterprises under the pilot program to carry out bonded warehousing business for parallel imported whole automobiles in local qualified areas under special customs supervision and bonded logistics centers (type B). Customs declaration, customs clearance, inspection, and other procedures shall be optimized to improve customs clearance efficiency.   二、进一步提高汽车平行进口贸易便利化水平。简化汽车自动进口许可证申领管理制度,对有关地区确定的开展汽车平行进口业务的企业(以下简称试点企业)申报的平行进口汽车产品自动进口许可证,经商务部审核签发后,委托有关地区省级商务主管部门打印发放。积极推动自动进口许可证无纸化申领,推广进口证件电子化应用。平行进口汽车应符合国务院整车进口口岸管理的相关规定,在进口口岸、出区进口时按照相关规定办理有关手续。有关地区应允许非本地试点企业在本地符合条件的海关特殊监管区域和保税物流中心(B型)开展平行进口汽车整车保税仓储业务。优化报关、通关、查验等流程,提高通关效率。
