The Regulation on Human Organ Transplantation, which were adopted at the 171st Executive Meeting of the State Council on March 21, 2007, are hereby enacted, and shall be effective as of May 1, 2007.

Chapter I General Provisions
 

第一章 总则


Article 1 In order for regulating the human organ transplantation, guaranteeing the quality of medical treatment, protecting the human health, and maintaining the legitimate rights and interests of citizens, the present Regulation are made.
   第一条 为了规范人体器官移植,保证医疗质量,保障人体健康,维护公民的合法权益,制定本条例。
Article 2 The present Regulation shall apply to the transplantation of human organs within the territory of the People's Republic of China; and shall not apply to the transplantation of human tissues such as human cells, cornea and bone marrow.
The human organ transplantation in the present Regulation shall refer to the process of removing all or part of an organ with particular functions such as heart, lung, liver, kidney or pancreas out of a human organ donor and planting it into the body of a recipient to replace the failing organ.
   第二条 在中华人民共和国境内从事人体器官移植,适用本条例;从事人体细胞和角膜、骨髓等人体组织移植,不适用本条例。
本条例所称人体器官移植,是指摘取人体器官捐献人具有特定功能的心脏、肺脏、肝脏、肾脏或者胰腺等器官的全部或者部分,将其植入接受人身体以代替其病损器官的过程。

Article 3 Any organization or person shall not trade in any way the human organs, and shall not be engaged in any activity in relation to the trade of human organs.
   第三条 任何组织或者个人不得以任何形式买卖人体器官,不得从事与买卖人体器官有关的活动。
Article 4 The competent health authority of the State Council shall be responsible for overseeing and managing the national human organ transplantation. The competent health authorities of the people's governments at or above the county level shall be responsible for overseeing and managing the human organ transplantation within their respective administrative regions.
The Red Cross organizations at various levels shall participate in the work of publicity of the human organ donation according to law.
   第四条 国务院卫生主管部门负责全国人体器官移植的监督管理工作。县级以上地方人民政府卫生主管部门负责本行政区域人体器官移植的监督管理工作。
各级红十字会依法参与人体器官捐献的宣传等工作。

Article 5 Any organization or person shall has the right to report any violation of the present Regulation to the competent health authority and other relevant authorities; and shall have the right to report any failure to perform the overseeing and managing functions of the competent health authority and other relevant authorities to the people's government at the same level or the relevant authority of the people's government at a higher level. The people's government, competent health authority and other relevant authorities shall timely verify and process the report, and notify the informant of the processing results.
   第五条 任何组织或者个人对违反本条例规定的行为,有权向卫生主管部门和其他有关部门举报;对卫生主管部门和其他有关部门未依法履行监督管理职责的行为,有权向本级人民政府、上级人民政府有关部门举报。接到举报的人民政府、卫生主管部门和其他有关部门对举报应当及时核实、处理,并将处理结果向举报人通报。
Article 6 The state shall, by establishing the work system of human organ transplantation, carry out the publicity and promotion work on human organ donation, determine the list of recipients awaiting human organ transplantation, and organize and coordinate the use of human organs.
   第六条 国家通过建立人体器官移植工作体系,开展人体器官捐献的宣传、推动工作,确定人体器官移植预约者名单,组织协调人体器官的使用。
Chapter II Human Organ Donation
 

第二章 人体器官的捐献


Article 7 The donation of human organs shall be made under the principle of free will and free of charge.
A citizen shall be entitled to donate or not to donate his or her human organ; and any organization or person shall not force, cheat or entice others into donating their human organs.
   第七条 人体器官捐献应当遵循自愿、无偿的原则。
公民享有捐献或者不捐献其人体器官的权利;任何组织或者个人不得强迫、欺骗或者利诱他人捐献人体器官。
Article 8 The citizen donating his or her human organ shall have full competency in civil act. The citizen donating his or her human organ shall fix his or her desire of donation in writing, and shall be entitled to revoke such a fixed desire of donation.
Any organization or person shall not donate or remove any human organ of a citizen who has disagreed with the donation of any of his or her human organs while alive; the spouse, grownup children or parents of a deceased citizen who has not disagreed with the donation of any of his or her human organs when alive may jointly agree in writing with the donation of this citizen's human organs subsequent to his or her death.
   第八条 捐献人体器官的公民应当具有完全民事行为能力。公民捐献其人体器官应当有书面形式的捐献意愿,对已经表示捐献其人体器官的意愿,有权予以撤销。
公民生前表示不同意捐献其人体器官的,任何组织或者个人不得捐献、摘取该公民的人体器官;公民生前未表示不同意捐献其人体器官的,该公民死亡后,其配偶、成年子女、父母可以以书面形式共同表示同意捐献该公民人体器官的意愿。
Article 9 Any organization or person shall not remove any living organ of a citizen under the age of 18 for transplantation.
   第九条 任何组织或者个人不得摘取未满18周岁公民的活体器官用于移植。
Article 10 The recipient of a living organ shall be limited to the spouse, lineal relative by blood or collateral relative by blood up to the third degree of kinship of the living organ donor, or a person who is proved to have developed a relative relationship with the living organ donor for reasons such as assistance and support.
   第十条 活体器官的接受人限于活体器官捐献人的配偶、直系血亲或者三代以内旁系血亲,或者有证据证明与活体器官捐献人存在因帮扶等形成亲情关系的人员。

第三章 人体器官的移植


Article 11 A medical institution engaged in the human organ transplantation shall apply for the registration of the diagnosis and treatment subject of human organ transplantation to the competent health authority of the people's government of the province, autonomous region, or municipality directly under the Central Government where the medical institution is located, and in accordance with the provisions of the Regulation on Management of Medical Institutions.
A medical institution engaged in the human organ transplantation shall satisfy the following conditions:
   第十一条 医疗机构从事人体器官移植,应当依照《医疗机构管理条例》的规定,向所在地省、自治区、直辖市人民政府卫生主管部门申请办理人体器官移植诊疗科目登记。
医疗机构从事人体器官移植,应当具备下列条件:
(a) Having the practicing doctors and other medical staff suitable for carrying out human organ transplantation;

 (一)有与从事人体器官移植相适应的执业医师和其他医务人员;
