| For the purposes of implementing the requirements of the CPC Central Committee and the State Council for the unified real estate registration, adapting to the needs of forestry development and reform, resolving the problems such as the irregular and incomplete registration of real estates in the forest rights category, adhering to the principles of requiring no change and replacement of original certificates, numerus clausus, and providing convenience for and benefiting the people, and fully fulfilling the registration functions of forest rights, you are hereby notified of relevant matters as follows: | | 为落实党中央、国务院关于不动产统一登记的要求，适应林业发展改革需要，解决林权类不动产登记工作不规范、不到位等问题，坚持不变不换、物权法定、便民利民原则，全面履行林权登记职责，现就有关事项通知如下。 |
| I. Regulating the acceptance of registration applications | | 一、规范登记业务受理 |
| Local real estate registration authorities (hereinafter referred to as “registration authorities”) shall include the registration of forest rights in the real estate registration for acceptance by one window. Except for statutory circumstances under which the registration shall not be accepted, the registration application shall not be rejected for reasons such as failure to transfer registration materials, failure to integrate data, insufficient accuracy in survey and measurement, and overlapping land types. | | 各地不动产登记机构（以下简称“登记机构”）要将林权登记纳入不动产登记一窗受理。除法定不予受理情形外，不得以登记资料未移交、数据未整合、调查测量精度不够、地类重叠等原因拒绝受理。 |
| 1. The forest right certificates issued by the original authorities in accordance with the law shall remain effective and are not required to be changed or replaced. Where a right holder applies for the replacement of a forest right certificate, the application shall be handled according to the requirements for uniform real estate registration. An application filed separately for registration of forests or trees will not be accepted. | | （一）原有权机关依法颁发的林权证书继续有效，不变不换。权利人申请换发林权证书的，按照不动产统一登记要求办理。单独申请森林、林木登记的，不予受理。 |
| 2. Where any party requires the registration of the division of woodlands registered by associated usufructuaries, under the principle that “whoever is willing to be associated usufructuaries may remain associated and whoever is willing to a separate usufructuary may be divided,” the landowner shall organize the relevant right holders to divide the parcel of woodland, and after they enter into a contracting contract of woodlands with undisputed ownership, clear boundaries, and defined metes and bounds, the registration authorities shall handle the transfer registration formalities according to the law. | | （二）当事人要求对已登记的联户林地拆宗申请办理登记的，按照“愿联则联、愿单则单”的原则，由发包方组织相关权利人拆宗，并订立权属无争议、界址清晰、四至明确的林地承包合同后，登记机构依法办理转移登记。 |
| 3. For the usufruct on the registered woodlands, where the usufruct transfer contract is terminated according to the law or the contract expires without renewal, the holder of the usufruct may apply for the cancellation of the usufruct. | | （三）已登记的林地经营权，经营权流转合同依法解除或者合同期限届满未续约的，经营权权利人可以申请经营权注销登记。 |
| 4. Where any party mortgages the woodlands owned collectively or owned by the state and used by farmers collectively under the law and the trees thereon according to the law, the registration authority shall handle mortgage registration formalities according to the law. | | （四）当事人以农民集体所有或国家所有依法由农民集体使用的林地、林木进行依法抵押的，登记机构依法办理抵押登记。 |
| II. Clarifying the types of registered rights in accordance with the law | | 二、依法明确登记权利类型 |
| Registration authorities shall adapt to the reform requirements, and lawfully undergo registration formalities according to the types of rights clearly specified in the Land Administration Law of the People's Republic of China, the Forest Law of the People's Republic of China, and the Law of the People's Republic of China on Rural Land Contracting. | | 登记机构要适应改革要求，根据《中华人民共和国土地管理法》《中华人民共和国森林法》《中华人民共和国农村土地承包法》等明确规定的权利类型，依法登记。 |

| Where state-owned woodlands and the forests and trees thereon are so determined by law to be used by the usufructuary of woodlands according to the approval documents of the people's government with the approval authority or the competent authority, the type of rights shall be registered as the rights to use woodlands and forests and trees thereon. | | 国家所有的林地和林地上的森林、林木，按照有批准权的人民政府或者主管部门的批准文件，依法确定给林业经营者使用的，权利类型登记为林地使用权/森林、林木使用权。 |
| 6. Woodlands owned collectively or owned by the state and used by farmers collectively under the law and the trees thereon: | | （六）集体所有或国家所有依法由农民集体使用的林地和林地上的林木。 |
| (1) Where woodlands owned collectively or owned by the state and used by farmers collectively under the law and the trees thereon are contracted, in the form of family-based contracting, for forestry production, according to the contracting contract, the type of rights shall be registered as the usufruct on woodlands and the ownership of the trees on the woodlands. | | 1.以家庭承包方式承包农民集体所有或国家所有依法由农民集体使用的林地从事林业生产的，依据承包合同，权利类型登记为林地承包经营权/林木所有权。 |
(2) Where trees are planted on plots of hilly land allotted for private use, etc., according to relevant agreements or materials, the type of rights shall be registered as the rights to use woodlands and the trees thereon.
