The Interim Provisions on the Administration of Title Evaluation, as deliberated and adopted at the 26th executive meeting of the Ministry of Human Resources and Social Security on June 14, 2019, are hereby issued and shall come into force on September 1, 2019. 《职称评审管理暂行规定》已经2019年6月14日人力资源社会保障部第26次部务会讨论通过,现予公布,自2019年9月1日起施行。

Interim Provisions on the Administration of Professional Title Evaluation 职称评审管理暂行规定
Chapter I General Provisions 

第一章 总 则

 
Article 1 These Provisions are developed in accordance with relevant laws and regulations and the provisions of the State Council in order to regulate the procedures for evaluating professional titles, strengthen the administration of professional title evaluation and ensure the quality of professional title evaluation.   第一条 为规范职称评审程序,加强职称评审管理,保证职称评审质量,根据有关法律法规和国务院规定,制定本规定。
Article 2 Professional title evaluation is the appraisal and recognition of moral character, ability and performance of professional technical personnel according to evaluation standards and procedures. The results of professional title evaluation are an important basis for the employment, evaluation and promotion of professional technical personnel.   第二条 职称评审是按照评审标准和程序,对专业技术人才品德、能力、业绩的评议和认定。职称评审结果是专业技术人才聘用、考核、晋升等的重要依据。
These Provisions apply to enterprises, public institutions, social organizations, individual economic organizations and so forth (hereinafter referred to as “employers”) and freelancers in evaluating professional and technical titles. 对企业、事业单位、社会团体、个体经济组织等(以下称用人单位)以及自由职业者开展专业技术人才职称评审工作,适用本规定。
Article 3 Professional title evaluation shall, under the principle of “combining integrity with ability, with priority given to integrity”, evaluate the professional ethics, innovation ability, performance level and actual contribution of professional technical personnel in a scientific and fair manner.   第三条 职称评审坚持德才兼备、以德为先的原则,科学公正评价专业技术人才的职业道德、创新能力、业绩水平和实际贡献。
Article 4 The administrative department of human resources and social security under the State Council shall be responsible for the overall planning and comprehensive management of professional title evaluation nationwide. Local administrative departments of human resources and social security at and above the county level shall be responsible for the comprehensive management, organization and implementation of professional title evaluation in their respective regions.   第四条 国务院人力资源社会保障行政部门负责全国的职称评审统筹规划和综合管理工作。县级以上地方各级人力资源社会保障行政部门负责本地区职称评审综合管理和组织实施工作。
The departments having jurisdictions over different industries shall, within their scope of functions and duties, be responsible for the evaluation, management and implementation of professional titles. 行业主管部门在各自职责范围内负责本行业的职称评审管理和实施工作。
Article 5 The standards for evaluating professional titles shall be divided into national standards, regional standards and entity standards.   第五条 职称评审标准分为国家标准、地区标准和单位标准。
The national standards for professional titles shall be developed by the administrative department of human resources and social security under the State Council, along with departments having jurisdictions over different industries. 各职称系列国家标准由国务院人力资源社会保障行政部门会同行业主管部门制定。
The regional standards shall be developed by administrative departments of human resources and social security of each region as well as departments having jurisdictions over different industries in accordance with the national standards and based on local realities. 地区标准由各地区人力资源社会保障行政部门会同行业主管部门依据国家标准,结合本地区实际制定。
Entity standards shall be developed by the employers having the power to evaluate professional titles according to the national standards and regional standards and in light of the realities of such entities. 单位标准由具有职称评审权的用人单位依据国家标准、地区标准,结合本单位实际制定。
The regional standards and entity standards shall not be lower than the national standards. 地区标准、单位标准不得低于国家标准。
Chapter II Professional Title Evaluation Committee 

第二章 职称评审委员会

 
Article 6 In conducting professional title evaluation, all regions, departments and employers shall, as required, apply for the establishment of professional title evaluation committees.   第六条 各地区、各部门以及用人单位等按照规定开展职称评审,应当申请组建职称评审委员会。
Professional title evaluation committees shall be responsible for evaluating and determining the academic and technical level and professional ability of professional technical personnel, and be accountable to and supervised by establishing entities. 职称评审委员会负责评议、认定专业技术人才学术技术水平和专业能力,对组建单位负责,受组建单位监督。
Professional title evaluation committees shall be organized according to title series or specialties, and no comprehensive professional title evaluation committee shall be formed across the series. 职称评审委员会按照职称系列或者专业组建,不得跨系列组建综合性职称评审委员会。
Article 7 Professional title evaluation committees shall fall into senior, intermediate and junior ones.   第七条 职称评审委员会分为高级、中级、初级职称评审委员会。
The following requirements shall be met in applying for the establishment of a senior professional title evaluation committee: 申请组建高级职称评审委员会应当具备下列条件:
(1) The professional title series or specialties to be evaluated are the main title series or specialties of entities establishing professional title evaluation committees; (一)拟评审的职称系列或者专业为职称评审委员会组建单位主体职称系列或者专业;
(2) The professional title series or specialties to be evaluated are of great influence in the industry, and the level of professional development in the corresponding fields; (二)拟评审的职称系列或者专业在行业内具有重要影响力,能够代表本领域的专业发展水平;
(3) The establishing entity has a certain number of professional and technical personnel and eligible experts with senior professional titles; and (三)具有一定数量的专业技术人才和符合条件的高级职称评审专家;
(4) The establishing entity has the ability to carry out the evaluation of senior professional titles. (四)具有开展高级职称评审的能力。
Article 8 The State shall implement the system of approval and recordation for professional title evaluation committees. The period of validity of the recordation of the professional title evaluation committee shall not exceed 3 years, and upon expiration of the period, the recordation shall be re-approved.   第八条 国家对职称评审委员会实行核准备案管理制度。职称评审委员会备案有效期不得超过3年,有效期届满应当重新核准备案。
The senior professional title evaluation committees established by various departments under the State Council, central enterprises, national trade associations and societies, and personnel exchange service bodies shall be approved by and filed with the administrative department of human resources and social security under the State Council. The senior professional title evaluation committee established in each region shall be approved by and filed with the provincial human resources and social security administrative department. The senior professional title evaluation committee established by other employers shall be approved by and filed with the human resources and social security administrative departments at or above the provincial level according to the administrative authority of professional title evaluation. 国务院各部门、中央企业、全国性行业协会学会、人才交流服务机构等组建的高级职称评审委员会由国务院人力资源社会保障行政部门核准备案;各地区组建的高级职称评审委员会由省级人力资源社会保障行政部门核准备案;其他用人单位组建的高级职称评审委员会按照职称评审管理权限由省级以上人力资源社会保障行政部门核准备案。
The conditions for applying for the establishment of an intermediate or junior professional title evaluation committee and the specific measures for approval and filing shall be developed by various departments under the State Council, provincial human resources and social security administrative departments and employers having the power to evaluating professional titles according to the administrative authority of professional title evaluation. 申请组建中级、初级职称评审委员会的条件以及核准备案的具体办法,按照职称评审管理权限由国务院各部门、省级人力资源社会保障行政部门以及具有职称评审权的用人单位制定。
Article 9 The membership of the professional title evaluation committee members shall be an odd number, and a chairman and vice-chairmen shall be appointed as needed. The senior professional title evaluation committee established according to professional title series shall have no less than 25 experts, and the senior professional title evaluation committee established according to specialties shall be composed of no less than 11 experts. The number of the senior professional title evaluation committee established in each region may be appropriately adjusted with the approval of the provincial human resources and social security administrative department.   第九条 职称评审委员会组成人员应当是单数,根据工作需要设主任委员和副主任委员。按照职称系列组建的高级职称评审委员会评审专家不少于25人,按照专业组建的高级职称评审委员会评审专家不少于11人。各地区组建的高级职称评审委员会的人数,经省级人力资源社会保障行政部门同意,可以适当调整。
Article 10 The evaluation experts of the professional title evaluation committee shall meet the following requirements:   第十条 职称评审委员会的评审专家应当具备下列条件:
(1) Abiding by the constitution and laws; (一)遵守宪法和法律;
(2) Having good professional ethics; (二)具备良好的职业道德;
(3) Having the title in this professional title series or professional titles at corresponding levels; (三)具有本职称系列或者专业相应层级的职称;
(4) Engaging in professional and technical work in the field; and (四)从事本领域专业技术工作;
(5) Able to perform the duties of professional title evaluation. (五)能够履行职称评审工作职责。
The term of office of an evaluation expert shall be not more than three years. 评审专家每届任期不得超过3年。
Article 11 Each region, department and employer may, according to title series or specialties, establish a pool of professional title evaluation committee experts, from which a specified number of evaluation experts can be randomly selected to form a professional title evaluation committee.   第十一条 各地区、各部门和用人单位可以按照职称系列或者专业建立职称评审委员会专家库,在职称评审委员会专家库内随机抽取规定数量的评审专家组成职称评审委员会。
The approval and filing of the pool of experts shall be governed mutatis mutandis by Article 8 of these Provisions, and the professional title evaluation committee composed of experts drawn from the pool of experts shall not be filed again. 职称评审委员会专家库参照本规定第八条进行核准备案,从专家库内抽取专家组成的职称评审委员会不再备案。
Article 12 Entities establishing professional title evaluation committees may set up working bodies for professional title evaluation or designate special institutions as working bodies for professional title evaluation, which shall be responsible for the daily work of professional title evaluation.   第十二条 职称评审委员会组建单位可以设立职称评审办事机构或者指定专门机构作为职称评审办事机构,由其负责职称评审的日常工作。
