中华人民共和国政府与东南亚国家联盟关于在《中国-东盟全面经济合作框架协议》下《货物贸易协议》中纳入技术性贸易壁垒和卫生与植物卫生措施章节的议定书

The Government of the People's Republic of China (hereinafter referred to as "China") and the Governments of Brunei Darussalam, the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic ("Lao PDR"), Malaysia, the Republic of the Union of Myanmar, the Republic of the Philippines, the Republic of Singapore, the Kingdom of Thailand and the Socialist Republic of Viet Nam, Member States of the Association of Southeast Asian Nations (hereinafter referred to collectively as "ASEAN" or "ASEAN Member States" or singularly as "ASEAN Member State"), (hereinafter referred to collectively as "Parties" or individually as "Party"), 中华人民共和国(以下简称“中国”)政府与文莱达鲁萨兰国、柬埔寨王国、印度尼西亚共和国、老挝人民民主共和国、马来西亚、缅甸联邦共和国、菲律宾共和国、新加坡共和国、泰王国和越南社会主义共和国等东南亚国家联盟成员国(以下整体简称为“东盟”或“东盟各成员国”,单指一国时简称“东盟成员国”)政府(以下将其整体简称为“各缔约方”,单指一个东盟成员国或中国时简称“一缔约方”):
RECALLING the Agreement on Trade in Goods of the Framework Agreement on Comprehensive Economic Cooperation between the People's Republic of China and the Association of Southeast Asian Nations (hereinafter referred to as "TIG Agreement"), signed by Economic Ministers of China and the ASEAN Member States on 29 November 2004 in Vientiane, Lao PDR, and its associated Protocols; 考虑到2004年11月29日在老挝万象由中国和东盟各成员国经贸部长签署的《中国-东盟全面经济合作框架协议》下的《货物贸易协议》(以下简称《货物贸易协议》)及相关议定书;
RECOGNISING the need to deepen economic linkages between China and ASEAN by minimising barriers to trade while ensuring the protection of human, animal or plant life or health in their respective territories; 认识到必须通过尽量减少贸易壁垒并保障对各缔约方领土内人类、动植物生命或健康进行保护,以深化中国与东盟各成员国的经济往来的必要性;
CONFIDENT that a high-quality TIG Agreement would facilitate and enhance the effective implementation and utilisation of tariff preferences under the China-ASEAN Free Trade Area; 同时,高水平的货物贸易协议将便利并加强中国-东盟自贸区关税优惠政策的有效实施和利用;
NOTING that Article 18 of the TIG Agreement provides that the TIG Agreement "shall include all future legal instruments agreed pursuant to this Agreement"; 注意到《货物贸易协议》的第18条规定,协议应“包括将来依据本协议达成的所有法律文件”;
SEEKING to incorporate into the TIG Agreement substantive provisions on the application of technical barriers to trade (hereinafter referred to as "TBT") and the application of sanitary and phytosanitary (hereinafter referred to as "SPS") measures; 需要将实施技术性贸易壁垒(TBT)和卫生与植物卫生(SPS)措施的实质性规定纳入《货物贸易协议》。
Have agreed as follows: 现达成如下协议:
 

Chapter I Technical Barriers to Trade
 第一章 技术性贸易壁垒
Article 1 jective 

The objectives of this Chapter are to:   第一条 目标
 本章旨在:
1. facilitate and promote trade in goods among the Parties by ensuring that technical regulations, standards and conformity assessment procedures do not create unnecessary barriers to trade; 
2. strengthen cooperation, including information exchange in relation to the preparation, adoption and application of standards, technical regulations and conformity assessment procedures; (一)便利和促进各缔约方间的货物贸易,确保技术法规、标准及合格评定程序不会对贸易造成不必要的障碍;
 


3. promote mutual understanding of each Party's standards, technical regulations and conformity assessment procedures; and (二)加强在制订、采用和实施技术法规、标准与合格评定程序工作上的信息交换合作;
4. effectively solve the problems arising from trade between the Parties. (三)推动对各缔约方技术法规、标准与合格评定程序的相互理解;
Article 2 Scope (四)有效解决各缔约方贸易中出现的问题。
This Chapter shall apply to all technical regulations, standards and conformity assessment procedures of each Party that may, directly or indirectly, affect trade in goods between the Parties. It shall exclude:

1. SPS measures which are covered in Chapter II of this Protocol; and 本章适用于各缔约方所实施的,直接或间接影响货物贸易的全部技术法规、标准与合格评定程序,不适用于:
2. purchasing specifications prepared by governmental bodies for production or consumption requirements of governmental bodies. (一)本议定书第二章的卫生与植物卫生措施;
Article 3 Definitions (二)政府机构为政府机构的生产或消费要求制订的采购规格。
For the purposes of this Protocol, the definitions set out in Annex 1 to the Agreement on Technical Barriers to Trade in Annex 1A to the WTO Agreement (hereinafter referred to as "TBT Agreement") shall apply. 
   第三条 定义
Article 4 Affirmation of the TBT Agreement 就本议定书而言,世贸协定附件1A中《技术性贸易壁垒协定》(以下简称技术性贸易壁垒协定)附件1中的定义应适用。
The Parties affirm their rights and obligations with respect to each of the other Party under the TBT Agreement. 
   第四条 技术性贸易壁垒协定的确认
Article 5 Technical Regulations 各缔约方确认各自在技术性贸易壁垒协定下的权利和义务。
1. Where relevant international standards exist or their completion is imminent, each Party shall use them, or relevant parts of them, as a basis for their technical regulations except when such international standards or relevant parts would be an ineffective or inappropriate means for the fulfilment of the legitimate objectives pursued, for instance, due to fundamental climatic or geographical factors or fundamental technological problems.   第五条 技术法规
2. Each Party shall give positive consideration to accepting as equivalent, technical regulations of another Party, even if these regulations differ from its own, provided it is satisfied that these regulations adequately fulfill the objectives of its own regulations. 一、当相关国际标准已经存在,或者即将拟就,各缔约方应使用这些国际标准或其中的相关部分,作为其技术法规的基础,除非这些国际标准或其中的相关部分对达到其追求的合法目标无效或不适当,例如由于基本的气候因素、地理因素或技术问题等。
3. Where a Party does not accept a technical regulation of another Party as equivalent to its own, it shall, upon request of the other Party, explain the reasons for its decision. 二、一缔约方应积极考虑将对方的技术法规作为等效法规加以接受,即使这些法规不同于该缔约方的法规,只要其确信这些技术法规足以实现与其法规相同的目标。
Article 6 Standards 三、如果一缔约方不能等效接受对方的技术法规,应对方的要求,该缔约方应作出解释。
1. With respect to the preparation, adoption and application of standards, each Party shall ensure that its standardising body or bodies accept and comply with Annex 3 to the TBT Agreement.   第六条 标准
2. Each Party shall encourage the standardising body or bodies in its territory to cooperate with the standardising body or bodies of other Parties. Such cooperation shall include, but is not limited to: 一、在制订、采用和实施标准时,各缔约方应确保各自的标准化机构接受和遵守技术性贸易壁垒协定附件3的规定。
(1) exchange of information on standards; 二、各缔约方应鼓励各自领土内的标准化机构与对方标准化机构合作。这些合作应当包括,但不仅限于:
(2) exchange of information relating to standard setting procedures; and (一)标准的信息交换;
(3) cooperation in the work of international standardising bodies in areas of mutual interest. (二)标准制订过程的信息交换;
Article 7 Conformity Assessment Procedures (三)在国际标准化机构中针对有共同利益的领域进行合作。
1. Each Party shall seek to enhance the acceptance of the results of conformity assessment procedures conducted in the territories of other Parties with a view to increasing efficiency and ensuring cost effectiveness of the conformity assessments.   第七条 合格评定程序
2. The Parties recognise that a broad range of mechanisms exists to facilitate the acceptance of conformity assessment procedures and the results thereof. 一、各缔约方须致力于促进接受在其他各缔约方境内开展的合格评定程序的结果,以提高合格评定的效率,保证合格评定的成本效益。
3. The Parties agree to exchange information on conformity assessment procedures, including testing, inspection, certification, accreditation and metrology, with a view to negotiating cooperation agreements in the field of conformity assessment procedures in a manner consistent with the provisions of the TBT Agreement and the relevant domestic legislation of the Parties. 二、各缔约方认识到,有诸多机制可以便利承认合格评定程序和结果。
4. When cooperating in conformity assessment, the Parties shall take into consideration their participation in the applicable regional and/or international organisations such as International Accreditation Forum (IAF), International Laboratory Accreditation Cooperation (ILAC), the International Bureau of Weights and Measures (BIPM), the International Organisation of Legal Metrology (OIML) and other relevant international organisations. 三、各缔约方同意就合格评定程序包括测试、检验、认证、认可以及计量等进行信息交流,以便在符合技术性贸易壁垒协定规定及各缔约方有关国内法律法规规定的情况下,协商签署合格评定领域的合作协议。
5. The Parties agree to encourage their conformity assessment bodies to work closer with a view to facilitating the acceptance of conformity assessment results between both Parties. 四、各缔约方在开展合格评定合作时,应考虑各自机构参加相关的地区或国际组织,如国际认可论坛(IAF)、国际实验室认可合作组织(ILAC)、国际计量局(BIPM)和国际法制计量组织(OIML)和其他有关国际组织的情况。
6. A Party shall, upon request of another Party, provide its reasons for not accepting the results of any conformity assessment procedure performed in the territory of that other Party. 五、各缔约方同意鼓励合格评定机构开展更密切的合作,以推动各缔约方合格评定结果的接受。
Article 8 Transparency 六、一缔约方应另一方请求,须提供不接受在另一方境内开展的合格评定程序结果的理由。
1. Each Party affirms its commitment to ensuring that information regarding proposed new or amended technical regulations, standards and conformity assessment procedures is made available in accordance with the relevant requirements of the TBT Agreement.   第八条 透明度
2. Each Party shall make available the full text of its notified technical regulations and conformity assessment procedures to the requesting Party within 15 working days after receiving the written request. 一、各缔约方承诺按照技术性贸易壁垒协定的相关要求,使自己新制订或修改技术法规、标准与合格评定程序的信息可获取。
3. Each Party shall allow at least 60 days for the other Party to present comments except where risks to health, safety and the environment arising or threatening to arise warrant urgent actions.

 二、一缔约方应在收到书面要求后的15个工作日内,向请求方提供其通报的技术法规和合格评定程序的全文。
