| The Republic of Kazakhstan, the People`s Republic of China, the Kyrgyz Republic, the Russian Federation, the Republic of Tajikistan, and the Republic of Uzbekistan (hereinafter referred to as "the Parties"), | | 哈萨克斯坦共和国、中华人民共和国、吉尔吉斯共和国、俄罗斯联邦、塔吉克斯坦共和国和乌兹别克斯坦共和国（以下简称“各方”）， |
| guided by the purposes and principles of the Charter of the United Nations concerning primarily the maintenance of international peace and security and the promotion of friendly relations and cooperation among States; | | 遵循联合国宪章，特别是有关维护国际和平与安全和发展国家间友好关系与合作的宗旨和原则； |
| aware of the fact that terrorism, separatism and extremism constitute a threat to international peace and security, the promotion of friendly relations among States | | 认识到恐怖主义、分裂主义和极端主义对国际和平与安全，发展国家间友好关系和实现人的基本权利和自由构成威胁； |
| | 认为上述现象对各方的领土完整和国家安全以及政治、经济和社会稳定构成严重威胁； |
| | 遵循一九九八年七月三日阿拉木图联合声明、一九九九年八月二十五日比什凯克声明和二０００年七月五日杜尚别声明及二００一年六月十五日《“上海合作组织”成立宣言》的原则； |
| racism, separatism and extremism, as defined in this Convention, regardless their motives, cannot be justified under any circumstances, and that the perpetrators of such acts should be prosecuted under the law; | | 确信本公约确定的恐怖主义、分裂主义和极端主义，无论其动机如何，在任何情况下不得为其开脱罪责，从事此类行为的人员应被绳之以法； |
| believing that joint efforts by the Parties within the framework of this Convention are an effective form of combating terrorism, separatism and extremism, | | 深信在本公约框架内进行共同努力是打击恐怖主义、分裂主义和极端主义的有效方式； |
| have agreed as follows: | | 达成协议如下： |
| Article 1 | | 第一条 |
| 1. For the purposes of this Convention, the terms used in it shall have the following meaning: | | 一、为本公约的目的，所使用的专门名词系指： |
| 1) "terrorism" means: | | （一）恐怖主义是指： |
| a. any act recognized as an offence in one of the treaties listed in the Annex to this Convention (hereinafter referred to as "the Annex") and as defined in this Treaty; | | １、为本公约附件（以下简称“附件”）所列条约之一所认定并经其定义为犯罪的任何行为； |
| b. other act intended to cause death or serious bodily injury to a civilian, or any other person not taking an active part in the hostilities in a situation of armed conflict or to cause major damage to any material facility, as well as to organize, plan, aid and abet such act, when the purpose of such act, by its nature or context, is to intimidate a population, violate public security or to compel public authorities or an international organization to do or to abstain from doing any act, and prosecuted in accordance with the national laws of the Parties; | | ２、致使平民或武装冲突情况下未积极参与军事行动的任何其他人员死亡或对其造成重大人身伤害、对物质目标造成重大损失的任何其它行为，以及组织、策划、共谋、教唆上述活动的行为，而此类行为因其性质或背景可认定为恐吓居民、破坏公共安全或强制政权机关或国际组织以实施或不实施某种行为，并且是依各方国内法应追究刑事责任的任何行为。 |
| 2) "separatism" means any act intended to violate territorial integrity of a State including by annexation of any part of its territory or to disintegrate a State, committed in a violent manner, as well as planning and preparing, and abetting such act, and subject to criminal prosecuting in accordance with the national laws of the Parties; | | （二）分裂主义是指旨在破坏国家领土完整，包括把国家领土的一部分分裂出去或分解国家而使用暴力，以及策划、准备、共谋和教唆从事上述活动的行为，并且是依据各方国内法应追究刑事责任的任何行为。 |
| 3) "Extremism" is an act aimed at seizing or keeping power through the use of violence or changing violently the constitutional regime of a State, as well as a violent encroachment upon public security, including organization, for the above purposes, of illegal armed formations and participation in them, criminally prosecuted in conformity with the national laws of the Parties. | | （三）极端主义是指旨在使用暴力夺取政权、执掌政权或改变国家宪法体制，通过暴力手段侵犯公共安全，包括为达到上述目的组织或参加非法武装团伙，并且依各方国内法应追究刑事责任的任何行为。 |
| 2. This Article shall not affect any international treaty or any national law of the Parties, provides or may provide for a broader application of the terms used in this Article. | | 二、本条不妨碍载有或可能载有比本条所使用专门名词适用范围更广规定的任何国际条约或各方的国内法。 |
| Article 2 | | 第二条 |
| 1. The Parties, in accordance with this Convention and other international obligations and with due regard for their national legislations, shall cooperate in the area of prevention, identification and suppression of acts referred to in Article 1 (1) of this Convention. | | 一、各方根据本公约及其所承担的其它国际义务，以及考虑到各自国内法，在预防、查明和惩治本公约第一条第一款所指行为的方面进行合作。 |
| 2. In their mutual relations, the Parties shall consider acts referred to in Article 1 (1) of this Convention as extraditable offences. | | 二、各方应将本公约第一条第一款所指行为视为可相互引渡的犯罪行为。 |
| 3. In the course of implementation of this Convention with regard to issues concerning extradition and legal assistance in criminal cases, the Parties shall cooperate in conformity with international treaties to which they are parties and national laws of the Parties. | | 三、在实施本公约时，对涉及与引渡和刑事司法协助有关的事项，各方根据其参加的国际条约并考虑到各方国内法开展合作。 |
| Article 3 The Parties shall take such measures as can prove necessary, including, as appropriate, in the field of their domestic legislation, in order to ensure that in no circumstances acts referred to in Article 1 (1) of this Convention should be subject to acquittal based upon exclusively political, philosophical, ideological, racial, ethnic, religious or any other similar considerations and that they should entail punishment proportionate to their gravity. | | 第三条 各方应采取必要措施，包括适当时制定国内立法，以使本公约第一条第一款所指行为在任何情况下不得仅由于政治、思想、意识形态、人种、民族、宗教及其它相似性质的原因而被开脱罪责，并使其受到与其性质相符的处罚。 |
| Article 4 | | 第四条 |
| 1. Within 60 days after the Depositary has been notified about the completion of internal procedures necessary for the entry into force of this Convention, a Party shall provide to the Depositary, through diplomatic channels, in writing a list of its central competent authorities responsible for the implementation of this Convention, and the Depositary shall transmit the above list to other Parties. | | 一、一方在通知保存国完成为使本公约生效所必须的国内程序后六十天内，应将其负责执行本公约的中央主管机关名单通过外交途径书面提交保存国，保存国应周知其它各方。 |
| 2. Neutral competent authorities of the Parties in charge of issues relating to implementation of the provisions of this Convention shall directly communicate and interact with each other. | | 二、各方中央主管机关就执行本公约规定的有关事项直接相互联系和协作。 |
| 3. In case of any amendments to the list of central competent authorities of a Party, that Party shall send an appropriate notification to the Depositary who shall inform the other Parties accordingly. | | 三、如任何一方对其中央主管机关名单作出变更，应通知保存国，由保存国周知其它各方。 |
| Article 5 Upon mutual consent, the Parties can hold consultations, exchange views and coordinate their positions on issues of combating acts referred to in Article 1 (1) of this Convention, including within international organizations and at international forums. | | 第五条 各方经协商一致，可就打击本公约第一条第一款所指行为的事项进行磋商、交换意见、协调立场，包括在国际组织和国际论坛从事上述活动。 |
| Article 6 In accordance with this Convention, the central competent authorities of the Parties shall cooperate and assist each other through: | | 第六条 各方中央主管机关根据本公约进行下列合作并相互提供协助： |
| 1) Exchange of information; | | （一）交流信息； |
| 2) Execution of requests concerning operational search actions; | | （二）执行关于进行快速侦查行动的请求； |
| 3) Development and implementation of agreed measures to prevent, identify and suppress acts referred to in Article 1 (1) of this Convention, as well as mutual information on the results of their implementation; | | （三）制定并采取协商一致的措施，以预防、查明和惩治本公约第一条第一款所指行为，并相互通报实施上述行动的结果； |
| 4) Implementation of measures to prevent, identify and suppress, in their territories, acts referred to in Article 1 (1) of this Convention, that are aimed against other Parties; | | （四）采取措施预防、查明和惩治在本国领土上针对其它各方实施的本公约第一条第一款所指行为； |
| 5) Implementation of measures to prevent, identify and suppress financing, supplies of weapons and ammunition or any other forms of assistance to any person and/or organization for the purpose of committing acts referred to in Article 1 (1) of this Convention; | | （五）采取措施预防、查明和阻止向任何人员和组织提供用于实施本公约第一条第一款所指行为的资金、武器、弹药和其它协助； |
| 6) Implementation of measures to prevent, identify, suppress, prohibit or put an end to the activities aimed at training individuals for the purpose of committing acts referred to in Article 1 (1) of this Convention; | | （六）采取措施预防、查明、阻止、禁止并取缔训练从事本公约第一条第一款所指行为人员的活动； |
| 7) Exchange of regulatory legal acts and information concerning practical implementation thereof; | | （七）交换法律法规及其实施情况的材料； |
| 8) Exchange of experience in the field of prevention, identification or suppression of acts referred to in Article 1 (1) of this Convention; | | （八）就预防、查明和惩治本公约第一条第一款所指行为交流经验； |
| 9) Various forms of training, retraining or upgrading of their experts; | | （九）通过各种形式，培训、再培训各自专家并提高其专业素质； |
10) Conclusion, upon mutual consent of the Parties, of agreements on other forms of cooperation, including, as appropriate, practical assistance in suppressing acts referred to in Article 1 (1) of this Convention and mitigating consequences thereof. Such agreements shall be formalized in appropriate protocols that shall form an integral part of this Convention.
