| Article 1 For the purposes of regulating the drug testing work of public security authorities and protecting the lawful rights and interests of the parties, these Provisions are developed in accordance with the Narcotics Control Law of the People's Republic of China, the Regulation on Drug Rehabilitation, and other relevant legislation. | | 第一条 为规范公安机关吸毒检测工作，保护当事人的合法权益，根据《中华人民共和国禁毒法》、《戒毒条例》等有关法律规定，制定本规定。 |
| Article 2 “Drug testing” means the biomedical testing of persons suspected of drug use by scientific and technical means to provide public security authorities with a scientific basis for determination of drug use. | | 第二条 吸毒检测是运用科学技术手段对涉嫌吸毒的人员进行生物医学检测，为公安机关认定吸毒行为提供科学依据的活动。 |
| The subjects of drug testing include the persons suspected of drug use, persons subjected to compulsory isolated drug rehabilitation as ordered, persons ordered by public security authorities to receive community-based drug rehabilitation and community-based recovery, and persons in drug rehabilitation and recovery at drug rehabilitation and recovery centers. | | 吸毒检测的对象，包括涉嫌吸毒的人员，被决定执行强制隔离戒毒的人员，被公安机关责令接受社区戒毒和社区康复的人员，以及戒毒康复场所内的戒毒康复人员。 |
| Article 3 Drug testing is categorized into on-site testing, laboratory testing, and laboratory re-testing. | | 第三条 吸毒检测分为现场检测、实验室检测、实验室复检。 |
| Article 4 The on-site testing shall be conducted by public security authorities at or above the county level or their local stations. | | 第四条 现场检测由县级以上公安机关或者其派出机构进行。 |
| Laboratory testing shall be conducted by laboratories qualified as inspection and identification institutions or by qualified medical institutions, as designated by public security authorities at or above the county level. | | 实验室检测由县级以上公安机关指定的取得检验鉴定机构资格的实验室或者有资质的医疗机构进行。 |
| Laboratory re-testing shall be conducted by laboratories qualified as inspection and identification institutions, as designated by public security authorities at or above the county level. | | 实验室复检由县级以上公安机关指定的取得检验鉴定机构资格的实验室进行。 |
| Laboratory testing and laboratory re-testing shall not be conducted by the same testing institution. | | 实验室检测和实验室复检不得由同一检测机构进行。 |
| Article 5 Specialized apparatuses shall be used in the collection of drug test samples. On-site testing equipment shall be products up to the standard manufactured or imported with the approval of the appropriate authorities of the state. | | 第五条 吸毒检测样本的采集应当使用专用器材。现场检测器材应当是国家主管部门批准生产或者进口的合格产品。 |
| Article 6 A test sample shall be a biological sample of the urine, blood, saliva, or hair, among others, collected from a subject of testing. | | 第六条 检测样本为采集的被检测人员的尿液、血液、唾液或者毛发等生物样本。 |
Article 7 A subject of testing who refuses to accept the testing may be forced to accept the testing with the approval of the person in charge of the public security authority at or above the county level or its local station.
