Your Request for Instructions on Issues concerning Immunities in the Case of Disputes over a House Lease Contract between Li Xiaobo and the Regional Delegation for East Asia of the International Committee of the Red Cross (No. 238 [2009]) has been received. Upon deliberation, the following reply is hereby made: 你院[2009]238号《关于李晓波诉红十字国际委员会东亚地区代表处房屋租赁合同纠纷一案豁免问题的请示》收悉。经研究,答复如下:
Li Xiaobo, a Chinese citizen, filed a lawsuit with the Chaoyang District People's Court of Beijing Municipality against the Regional Delegation for East Asia of the International Committee of the Red Cross (hereinafter referred to as the “Regional Delegation for East Asia”) for disputes over a house lease contract, and the Regional Delegation for East Asia applied to the people's court for its immunities. In accordance with Paragraph 1 of Article 4 in the Treaties between the Government of the People's Republic of China and the International Committee of the Red Cross, the International Committee of the Red Cross (“ICRC”) and its property and assets shall enjoy immunity from every form of legal process, including being immune from search, requisition, confiscation and expropriation, except insofar as in any particular case the ICRC has expressly waived its immunity. The Regional Delegation for East Asia, as a representative body set up by the ICRC in China, shall enjoy immunity from legal process as set forth in this Article. What both parties have agreed upon in Article 10 of the lease contract is the agreement in respect of the governing law, which does not constitute the waiver of the Regional Delegation for East Asia of its immunity, and there is no other evidence to indicate that the ICRC would be willing to accept the jurisdiction of any China's court. The handling opinions stated in your Request for Instructions are hereby approved.

 中国公民李晓波因与红十字国际委员会东亚地区代表处(以下简称东亚地区代表处)就房屋租赁合同产生纠纷,以东亚地区代表处为被告向北京市朝阳区人民法院提起诉讼,东亚地区代表处向人民法院提出豁免申请。《中华人民共和国政府和红十字国际委员会协议》第四条第一款规定,红十字国际委员会及其财产和资产享有法律程序豁免,包括免受搜查、征用、没收、征收。在特殊情况下,经红十字国际委员会明示放弃其豁免时,不在此限。东亚地区代表处作为红十字国际委员会在我国境内设立的代表机构,享有该条规定的法律程序豁免。双方当事人在租赁合同第十条中的约定系对准据法的约定,并不构成东亚地区代表处对豁免权的放弃,也没有其他证据证实该会愿意接受我国法院的管辖。同意你院请示报告的处理意见。
