| As decided at the 14th session of the Standing Committee of the Twelfth National People's Congress, the provisions of the following laws on administrative examination and approval, pre-approval for industrial and commercial registration, or price administration shall be amended as follows: | | 第十二届全国人民代表大会常务委员会第十四次会议决定，对下列法律中有关行政审批、工商登记前置审批或者价格管理的规定作出修改： |
| I. The Metrology Law of the People's Republic of China shall be amended as follows: | | 一、对《中华人民共和国计量法》作出修改 |
| (1) Paragraph 2 of Article 12 is deleted. | | （一）删去第十二条第二款。 |
| (2) Article 16 is deleted. | | （二）删去第十六条。 |
| (3) Article 18 is renumbered as Article 17 and paragraph 2 thereof is amended to read: “Any individual industrial and commercial household that is to engage in the manufacture or repair of measuring instruments shall pass the examination of the metrological administrative department of the people's government at the county level, and be issued a License for Manufacturing Measuring Instruments or a License for Repairing Measuring Instruments.” | | （三）将第十八条改为第十七条，第二款修改为：“制造、修理计量器具的个体工商户，必须经县级人民政府计量行政部门考核合格，发给《制造计量器具许可证》或者《修理计量器具许可证》。” |
| II. The Law of the People's Republic of China on Tobacco Monopoly shall be amended as follows: | | 二、对《中华人民共和国烟草专卖法》作出修改 |
| (1) Paragraph 2 of Article 9 is amended to read: “Tobacco companies or the entities they authorize shall conclude leaf tobacco purchasing contracts with tobacco growers. A leaf tobacco purchasing contract shall specify the agreed area for leaf tobacco plantation and the purchasing price of leaf tobacco.” | | （一）将第九条第二款修改为：“烟草公司或者其委托单位应当与烟叶种植者签订烟叶收购合同。烟叶收购合同应当约定烟叶种植面积、烟叶收购价格。” |
| Paragraph 3 is deleted. | | 删去第三款。 |
| (2) “Price” in paragraph 1 of Article 10 is deleted. | | （二）删去第十条第一款中的“价格”。 |
| In paragraph 2, “setting price on a grading basis and according to the standards prescribed by the State” is replaced by “contractual purchasing price.” | | 将第二款中的“国家规定的标准分等定价”修改为“合同约定的收购价格”。 |
| (3) Article 17 is deleted. | | （三）删去第十七条。 |
| (4) Article 29 is deleted. | | （四）删去第二十九条。 |
| (5) Article 30 is renumbered as Article 28 and amended to read: “Whoever, in violation of this Law, purchases leaf tobacco without authorization shall be fined by the tobacco monopoly administrative department, and the leaf tobacco illegally purchased shall be repurchased by the said department at the price of 70% average purchasing price of leaf tobacco in the previous year as determined by the tobacco monopoly administrative department at the provincial level at the place where he or she is seized; if the illegal purchase involves large quantities, the leaf tobacco purchased and the illegal income derived therefrom shall be confiscated.” | | （五）将第三十条改为第二十八条，修改为：“违反本法规定擅自收购烟叶的，由烟草专卖行政主管部门处以罚款，并按照查获地省级烟草专卖行政主管部门出具的上年度烟叶平均收购价格的百分之七十收购违法收购的烟叶；数量巨大的，没收违法收购的烟叶和违法所得。” |
(6) Article 31 is renumbered as Article 29 and paragraph 1 thereof is amended to read: “Whoever consigns or transports tobacco monopoly commodities without a transportation permit or in excess of the quantity specified in the transportation permit shall be fined by the tobacco monopoly administrative department, and the tobacco monopoly commodities illegally transported may be repurchased by the said department at the price of 70% average purchasing price of leaf tobacco in the previous year as determined by the tobacco monopoly administrative department at the provincial level at the place where he or she is seized and other tobacco monopoly commodities other than tobacco leaf illegally transported shall be repurchased by the said department at the price of 70% market wholesale price; and if the circumstances are serious, the tobacco monopoly commodities illegally transported and the illegal income derived therefrom shall be confiscated.”
