| The Plan for Establishing the Beijing Internet Court and the Guangzhou Internet Court, as approved by the leaders of the CPC Central Committee, is hereby issued. You are requested to organize the implementation thereof as soon as possible after submitting it to the Beijing Municipal Committee of the CPC and the Guangdong Provincial Committee of the CPC in a timely manner. | For purposes of thoroughly implementing Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, implementing the spirit of the 19th CPC National Congress and the Second and Third Plenary Sessions of the 19th CPC Central Committee, adhering to the people-centered development concept, deepening the comprehensive supporting reform of the judicial system, maintaining network security and order, and meeting the diverse judicial needs of the people in a new era, the following plan for establishing the Beijing Internet Court and the Guangzhou Internet Court is hereby put forward on the basis of summarizing the pilot experience of the Hangzhou Internet Court and in consideration of the actual work circumstances of people's courts. | | 为深入贯彻习近平新时代中国特色社会主义思想，贯彻党的十九大和十九届二中、三中全会精神，坚持以人民为中心发展思想，深化司法体制综合配套改革，维护网络安全和秩序，满足新时代人民群众多元司法需求，在总结杭州互联网法院试点经验基础上，结合人民法院工作实际，就增设北京互联网法院、广州互联网法院提出如下方案。 |

| Summarizing and promoting the new trial mechanism of “online trial of online cases” to ensure impartial, efficient and convenient handling of various Internet-related disputes; exploring the construction of new litigation rules that meet the needs of the Internet era; improving professional trial mechanisms, and, through the legal trial of various new Internet-related cases, summarizing and extracting legal rules, promoting the rule of law in cyberspace governance, and strengthening the international discourse power and rulemaking power of China in cyberspace governance. | | 总结推广“网上案件网上审理”的新型审理机制，确保公正、高效、便捷处理各类涉互联网纠纷；探索构建适应互联网时代需求的新型诉讼规则；健全完善专业化审判机制，通过依法审理各类新型涉互联网案件，总结提炼法律规则，推动网络空间治理法治化，强化我国在网络空间治理的国际话语权和规则制定权。 |

| Under the principles of “basing on reality, being lawful and orderly, making overall planning and taking all factors into consideration, and advancing step by step,” comprehensively considering the development of the Internet industry, the quantity and types of Internet-related cases, the software and hardware foundation of judicial adjudication and other factors, and steadily and properly advancing the establishment of Internet courts: First, responding to the judicial needs in the society. Giving priority to the areas where the Internet industry is prosperous, there are many Internet -related cases, technical conditions are available, and talent reserves are sufficient in respect of the establishment of Internet courts, which shall accept in a centralized manner specific types of first-instance Internet-related cases within their respective jurisdictions. Second, determining the scope of jurisdiction in a scientific manner. Accepting in a centralized manner the cases with obvious Internet characteristics and suitable to be heard online; and boosting and prospering digital economy, promoting cyberspace governance, and establishing Internet judicial rules. Third, improving the litigation rules. Standardizing the online trial mechanism, expanding the innovation space of Internet courts, and boosting the in-depth integration of judicial trials, litigation mechanisms and Internet technologies. Fourth, exploring the building of a unified litigation platform. Promoting the interaction and sharing of information between Internet courts and relevant state organs, organizations, and major e-commerce platforms, and breaking down information barriers. | | 按照“立足实际、依法有序、统筹兼顾、分步推进”的原则，综合考虑互联网产业发展、涉互联网案件数量类型、司法审判软硬件基础等因素，稳妥推进增设互联网法院工作：一是回应社会司法需求。优先选择互联网产业发达、涉网案件较多、技术条件具备、人才储备充分的地区增设互联网法院，集中受理辖区内特定类型第一审涉互联网案件。二是科学确定管辖范围。集中受理互联网特性突出、适宜在线审理的案件，推动繁荣数字经济、促进网络空间治理、确立互联网司法规则。三是健全完善诉讼规则。规范在线审理机制，拓展互联网法院创新空间，推动司法审判、诉讼机制与互联网技术深度融合。四是探索构建统一诉讼平台。推动互联网法院与相关国家机关、组织机构、主要电子商务平台信息交互共享，打破信息壁垒。 |
