| Article 1 These Regulations are formulated in order to protect the safety of computer information systems, promote the application and development of computers and safeguard the smooth progress of the construction of socialist modernization. | | 第一条 为了保护计算机信息系统的安全，促进计算机的应用和发展，保障社会主义现代化建设的顺利进行，制定本条例。 |
| Article 2 A computer information system referred to in these Regulations means a man-machine system composed of a computer and its related and complementary sets of equipment and facilities (including network) which carry out collection, processing, storage, transmission, retrieval and other operations of information in accordance with specific application aims and rules. | | 第二条 本条例所称的计算机信息系统，是指由计算机及其相关的和配套的设备、设施（含网络）构成的，按照一定的应用目标和规则对信息进行采集、加工、存储、传输、检索等处理的人机系统。 |
| Article 3 Protection of the safety of computer information systems shall safeguard the safety of the computer and its related and complementary sets of equipment and facilities (including network), the safety of operating environment, the safety of information, and the normal performance of computer functions so as to maintain the safe operation of computer information systems. | | 第三条 计算机信息系统的安全保护，应当保障计算机及其相关的和配套的设备、设施（含网络）的安全，运行环境的安全，保障信息的安全，保障计算机功能的正常发挥，以维护计算机信息系统的安全运行。 |
| Article 4 With regard to the safety protection for computer information systems, the emphasis shall be laid on the maintenance of the safety of computer information systems in such important fields as State affairs, economic development, national defense and top science and technology. | | 第四条 计算机信息系统的安全保护工作，重点维护国家事务、经济建设、国防建设、尖端科学技术等重要领域的计算机信息系统的安全。 |
| Article 5 These Regulations shall be applicable to the protection of the safety of computer information systems within the territory of the. People's Republic of China. | | 第五条 中华人民共和国境内的计算机信息系统的安全保护，适用本条例。 |
| The measures for the protection of the safety of microcomputers not yet connected to the network shall be formulated separately. | | 未联网的微型计算机的安全保护办法，另行制定。 |
| Article 6 The Ministry of Public Security shall be in charge of the nationwide safety protection work of computer information systems. | | 第六条 公安部主管全国计算机信息系统安全保护工作。 |
| The Ministry of State Security, the National Administration for the Protection of State Secrets and other departments concerned under the State Council shall properly perform the relevant functions related to the safe protection of computer information systems within the scope of their competence and responsibilities stipulated by the State Council. | | 国家安全部、国家保密局和国务院其他有关部门，在国务院规定的职责范围内做好计算机信息系统安全保护的有关工作。 |
| Article 7 No organization or individual may make use of computer information systems to engage in activities harmful to the interests of the State or collectives, or the legitimate rights of the citizens, nor endanger the safety of computer information systems. | | 第七条 任何组织或者个人，不得利用计算机信息系统从事危害国家利益、集体利益和公民合法利益的活动，不得危害计算机信息系统的安全。 |
| Chapter II System of Safety Protection | | 第二章 安全保护制度 |
| Article 8 The establishment and application of computer information systems shall abide by laws, administrative regulations and other relevant State provisions. | | 第八条 计算机信息系统的建设和应用，应当遵守法律、行政法规和国家其他有关规定。 |
| Article 9 The safety grading protection shall be enforced in respect of computer information systems. The standards for safety grades and specific measures for safety grading protection shall be formulated by the Ministry of Public Security in conjunction with other relevant departments. | | 第九条 计算机信息系统实行安全等级保护。安全等级的划分标准和安全等级保护的具体办法，由公安部会同有关部门制定。 |
| Article 10 A computer room shall be in conformity with the State standards and relevant State provisions. | | 第十条 计算机机房应当符合国家标准和国家有关规定。 |
| The construction project near a computer room may not endanger the safety of computer information system. | | 在计算机机房附近施工，不得危害计算机信息系统的安全。 |
Article 11 A computer information system to be connected to the international network shall be reported by its user to the public security organs of the people's government at or above the provincial level for the record.
