| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of regulating the management of non-main crop varieties and registering non-main crop varieties in a scientific, impartial and timely manner, these Measures are developed in accordance with the Seed Law of the People's Republic of China (hereinafter referred to as the “Seed Law”). | | 第一条 为了规范非主要农作物品种管理，科学、公正、及时地登记非主要农作物品种，根据《中华人民共和国种子法》（以下简称《种子法》），制定本办法。 |
| Article 2 The registration of the non-main crop varieties within the territory of the People's Republic of China shall be governed by these Measures, except as otherwise prescribed in the laws and administrative regulations and the rules of the Ministry of Agriculture (“MOA”) for the administration of non-main crop varieties. | | 第二条 在中华人民共和国境内的非主要农作物品种登记，适用本办法。法律、行政法规和农业部规章对非主要农作物品种管理另有规定的，依照其规定。 |
| Article 3 For the purpose of these Measures, non-main crops means other main crops other than five kinds of main crops including rice, wheat, corn, cotton and soybeans. | | 第三条 本办法所称非主要农作物，是指稻、小麦、玉米、棉花、大豆五种主要农作物以外的其他农作物。 |
| Article 4 The varieties listed in the registration catalogue of non-main crops shall be registered before promotion. | | 第四条 列入非主要农作物登记目录的品种，在推广前应当登记。 |
| The crops whose varieties are required to be registered but have not been registered shall not be advertised or promoted, or sold in the name of a registered variety. | | 应当登记的农作物品种未经登记的，不得发布广告、推广，不得以登记品种的名义销售。 |
| Article 5 The MOA shall be in charge of the registration of the non-main crop varieties across the country, the development of and adjustment to the registration catalogue of non-main crops and the guidelines for the registration of varieties, and the establishment of the national non-main crop varieties registration information platform (hereinafter referred to as the “varieties registration platform”). The specific work shall be assumed by the National Service Center for Promotion of Agricultural Technologies. | | 第五条 农业部主管全国非主要农作物品种登记工作，制定、调整非主要农作物登记目录和品种登记指南，建立全国非主要农作物品种登记信息平台（以下简称品种登记平台），具体工作由全国农业技术推广服务中心承担。 |
| Article 6 The competent agricultural departments of the people's governments at the provincial level shall be responsible for the specific implementation, supervision and administration of the registration of varieties, accept the applications for the registration of varieties, and conduct written examination of the application documents submitted by the applicants. | | 第六条 省级人民政府农业主管部门负责品种登记的具体实施和监督管理，受理品种登记申请，对申请者提交的申请文件进行书面审查。 |
| The competent agricultural departments of the people's governments at or above the provincial level shall take effective measures, strengthen the supervision and inspection of the registered varieties, fulfill the duties of supervising applicants and variety testing, and testing institutions, and ensure the safety of consumption and seeds. | | 省级以上人民政府农业主管部门应当采取有效措施，加强对已登记品种的监督检查，履行好对申请者和品种测试、试验机构的监管责任，保证消费安全和用种安全。 |
| Article 7 An applicant for the registration of varieties shall be responsible for the legalization and authenticity of the application documents and specimen of seeds, guarantee the traceability, and accept the supervision and inspection. Those who have caused losses to the users of seeds and other producer and dealer of seeds shall assume the liability for compensation according to the law. | | 第七条 申请者申请品种登记，应当对申请文件和种子样品的合法性、真实性负责，保证可追溯，接受监督检查。给种子使用者和其他种子生产经营者造成损失的，依法承担赔偿责任。 |
| Chapter II Application, Acceptance and Review | | 第二章 申请、受理与审查 |
| Article 8 The application for the registration of varieties shall be subject to territorial management. One variety is only required to be registered in one province. | | 第八条 品种登记申请实行属地管理。一个品种只需要在一个省份申请登记。 |
| Article 9 Where two or more applicants respectively apply for the variety registration of a same variety, the application firstly filed shall be preferentially accepted; and where applications are filed concurrently, the application filed by the breeder shall be preferentially accepted. | | 第九条 两个以上申请者分别就同一个品种申请品种登记的，优先受理最先提出的申请；同时申请的，优先受理该品种育种者的申请。 |
| Article 10 An applicant shall be registered in real name on the varieties registration platform, may file an application for registration through the varieties registration platform, and may file a written registration application with the competent agricultural department of the people's government at the provincial level where it is domiciled. | | 第十条 申请者应当在品种登记平台上实名注册，可以通过品种登记平台提出登记申请，也可以向住所地的省级人民政府农业主管部门提出书面登记申请。 |
| Article 11 An overseas institution or individual that has no permanent residence or business premise within the territory of China and applies for the registration of varieties within the territory of China shall entrust a domestic seeds enterprise with legal person qualification to act as its agent. | | 第十一条 在中国境内没有经常居所或者营业场所的境外机构、个人在境内申请品种登记的，应当委托具有法人资格的境内种子企业代理。 |
| Article 12 A variety for which an application is filed for the registration shall meet the following conditions: | | 第十二条 申请登记的品种应当具备下列条件： |
| (1) It has been selected, cultivated or found and improved by human. | | （一）人工选育或发现并经过改良； |
| (2) It has specificity, consistency and stability. | | （二）具备特异性、一致性、稳定性； |
(3) It has the name of variety in compliance with the Provisions on the Naming of Agricultural Plant Varieties.
