Notice by the Supreme People's Court of Amending or Repealing Certain Regulatory Documents 

最高人民法院关于对部分规范性文件予以修改或废止的通知

(No. 10 [2020] of the Supreme People's Court) (法发〔2020〕10号)

The higher people's courts of all provinces, autonomous regions, and municipalities directly under the Central Government; the Military Court of the People's Liberation Army; and the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region: 各省、自治区、直辖市高级人民法院,解放军军事法院,新疆维吾尔自治区高级人民法院生产建设兵团分院:
For the purpose of thoroughly implementing the spirit of the important speeches delivered by General Secretary Xi Jinping at the first meeting of the State Commission Office of Public Sectors Reform and the relevant requirements of the Regulation on the Institutional Staffing Work of the Communist Party of China, the Supreme People's Court has conducted a special review of regulatory documents developed and issued by the Supreme People's Court. Upon review, it is decided to amend or repeal 11 regulatory documents involving institutions, functions and staffing of courts at lower levels. You are hereby notified as follows: 为深入贯彻落实习近平总书记在中央机构编制委员会第一次会议上的重要讲话精神和《中国共产党机构编制工作条例》的有关要求,最高人民法院对本院制定下发的规范性文件进行了专项清理。经过清理,决定对11个涉及下级法院机构、职能配置和编制配备的规范性文件予以修改或废止。现通知如下:
I. Several Provisions on the Information Work of the People's Courts (No. 35 [2008], SPC)   一、人民法院信息工作的若干规定》(法发〔2008〕35号)
Article 21 A higher people's court at any level shall set up a special institution for its information work. An intermediate or basic people's court may set up a special institution for its information work. A people's court without conditions shall appoint one or two full-time information officers.” is amended to read: “Article 21 The local people's courts at all levels shall designate special institutions and personnel to be responsible for information work. The people's courts where conditions permit may, as needed for work, set up special institutions for information work within internal institution quotas.” 第二十一条:“各高级人民法院应当设立信息工作专门机构。中级人民法院、基层人民法院可以设立信息工作专门机构;尚不具备条件的人民法院应当配备1至2名专职信息员。”修改为:“地方各级人民法院应当明确专门机构和人员负责信息工作。有条件的人民法院,根据工作需要,可以在内设机构限额内设立信息工作专门机构。”
II. Several Opinions on Fully Strengthening the Acceptance of Supervision (No. 14 [2011], SPC)   二、关于全面加强接受监督工作的若干意见》(法发〔2011〕14号)
In Part IV (4), “All higher people's courts and intermediate people's courts where conditions permit shall establish corresponding working institutions, and basic people's courts and intermediate people's courts which do not have conditions for independently establishing special working institutions shall have full-time personnel responsible for the acceptance of supervision.” is amended to read: “The local people's courts at all levels shall designate special institutions and personnel to be responsible for the acceptance of supervision. The people's courts where conditions permit may, as needed for work, set up special institutions for the acceptance of supervision within internal institution quotas.” 第四部分第四条:“各高级人民法院和有条件的中级人民法院应当设立相应工作机构,基层人民法院和不具备单独设立专门工作机构的中级人民法院应当配备专职人员,具体负责接受监督工作。”修改为:“地方各级人民法院应当明确专门机构和人员负责接受监督工作。有条件的人民法院,根据工作需要,可以在内设机构限额内设立接受监督工作专门机构。”
III. Provisions on the Archival Work of the People's Courts (No. 11 [2012], SPC)   三、人民法院档案工作规定》(法发〔2012〕11号)
Article 9 The people's courts at all levels shall establish archives institutions commensurate with their functions and tasks. The higher people's courts shall generally establish archives divisions; the intermediate people's courts shall establish archives departments; and basic people's courts shall establish archives departments (offices). The people's courts where conditions permit may establish archives repositories in accordance with the relevant provisions of the Establishment Principles and Layout Plans for Archival Facilities Nationwide.” is amended to read: “Article 9 The people's courts at all levels shall establish archives institutions commensurate with their functions and tasks, and the people's courts where conditions permit may establish archives repositories in accordance with the relevant provisions of the Establishment Principles and Layout Plans for Archival Facilities Nationwide. The people's courts which do not have the conditions for establishing archives institutions shall designate special institutions to be responsible for the archival work.” 第九条:“各级人民法院应当设立与其职能、任务相适应的档案机构。高级人民法院一般应当设立档案处;中级人民法院设立档案科;基层人民法院设立档案科(室)。具备条件的人民法院可以根据《全国档案馆设置原则和布局方案》的有关规定设立档案馆。”修改为:“各级人民法院应当设立与其职能、任务相适应的档案机构,具备条件的人民法院可以根据《全国档案馆设置原则和布局方案》的有关规定设立档案馆。不具备档案机构设立条件的人民法院,应当明确专门机构负责档案工作。”
Article 11 The people's courts at all levels shall be staffed with full-time archivists according to the actual needs of the archival work of these courts, that is, at least five for a higher people's court, at least three for an intermediate people's court, and at least one for a basic people's court. At the same time, personnel may be increased appropriately according to the volumes of the archives kept. The standard for increasing personnel is that one person shall be increased for every additional 20,000 volumes beyond the base number of 10,000 volumes of archives which shall be kept by one full-time archivist.” is amended to read: “Article 11 The people's courts at all levels may appoint full-time archivists according to the actual needs of the archival work of these courts, and appropriately increase personnel according to the volumes of the archives kept.” 第十一条:“各级人民法院应当根据本院档案工作的实际需要配备专职档案工作人员,高级人民法院不少于五人,中级人民法院不少于三人,基层人民法院不少于一人。同时可以根据保管档案的数量适当增配人员,增配人员的标准为,以保管档案一万卷设专职档案工作人员一人为基数,每超过二万卷增配一人。”修改为:“各级人民法院可以根据本院档案工作的实际需要配备专职档案工作人员,并根据保管档案的数量适当增配。”
IV. Standards for the Allocation of Security Guards and Equipment of the People's Courts (No. 216 [2012], SPC)   四、《人民法院安全保卫工作人员和装备配置标准》(法〔2012〕216号)
Article 2 The higher people's courts and the intermediate people's courts of provincial capital cities and cities under separate state planning shall establish special working institutions for security protection, and appoint full-time security protection cadres.” is amended to read: “Article 2 The higher people's courts and the intermediate people's courts of provincial capital cities and cities under separate state planning shall designate special institutions to be responsible for the security protection work. The people's courts where conditions permit may, as needed for work, set up special institutions for security protection within internal institution quotas.” 第二条:“高级人民法院、省会城市和计划单列市中级人民法院应设立专门安全保卫工作机构,配置专职安全保卫工作干部。”修改为:“高级人民法院、省会城市和计划单列市中级人民法院应当明确专门机构负责安全保卫工作。有条件的人民法院,根据工作需要,可以在内设机构限额内设立安全保卫工作专门机构。”
Article 3 A people's court shall be staffed with at least one security guard.” is amended to read: “Article 3 A people's court may, as needed, be staffed with the corresponding number of security guards.” 第三条:“人民法庭至少应配备1名安全保卫工作人员。”修改为:“人民法庭可以根据需要配备相应数量的安全保卫工作人员。”
