| The 19th CPC National Congress made a major conclusion that socialism with Chinese characteristics entered a new era, proposed a strategic arrangement from building a well-off society in an all-round way to basically realizing modernization and to comprehensively building a socialist modern power, and emphasized the need to implement new development concepts, build a modern economic system, deepen the supply-side structural reform, stimulate and protect entrepreneurship, and encourage more social entities to participate in innovation and entrepreneurship. In September 2017, the CPC Central Committee and the State Council issued the Opinions on Creating a Sound Entrepreneur Growth Environment, Advocating Excellent Entrepreneurship and Better Using the Entrepreneurs' Role (hereinafter referred to as the "Opinions"), making a series of explicit requirements for making efforts to create a rule-of-law environment that protects the lawful rights and interests of entrepreneurs in accordance with the law, a market environment that promotes fair competition among entrepreneurs and honest operations, and a social atmosphere that respects and stimulates entrepreneurs' engagement in business and entrepreneurship, direct entrepreneurs to remain patriots and devoted to work, obey disciplines and laws, engage in innovation and entrepreneurship, and serve society, trigger the enthusiasm, initiative, and creativity of entrepreneurs, and give full play to the role of entrepreneurs. For the purposes of fully implementing the spirit of the 19th CPC National Congress, carrying out the requirements of the Opinions, creating a rule-of-law environment that protects the lawful rights and interests of entrepreneurs, and supporting the innovation and entrepreneurship of entrepreneurs, the following is hereby notified: | | 党的十九大作出了中国特色社会主义进入新时代的重大论断，提出了从全面建成小康社会到基本实现现代化，再到全面建成社会主义现代化强国的战略安排，强调要贯彻新发展理念，建设现代化经济体系，深化供给侧结构性改革，激发和保护企业家精神，鼓励更多社会主体投身创新创业。2017年9月，中共中央、国务院下发《关于营造企业家健康成长环境弘扬优秀企业家精神更好发挥企业家作用的意见》(以下简称《意见》)，就着力营造依法保护企业家合法权益的法治环境、促进企业家公平竞争、诚信经营的市场环境、尊重和激励企业家干事创业的社会氛围，引导企业家爱国敬业、遵纪守法、创新创业、服务社会，调动广大企业家积极性、主动性、创造性，充分发挥企业家作用，提出了一系列明确要求。为全面贯彻党的十九大精神，落实《意见》的要求，营造保护企业家合法权益的法治环境，支持企业家创新创业，现通知如下： |
| I. Studying and understanding in depth the spirit of the 19th CPC National Congress and fully recognizing the significance and general requirements of implementing the Opinions | | 一、深入学习领会党的十九大精神，充分认识贯彻落实《意见》的重要意义和总体要求 |
| According to the report of the 19th CPC National Congress, the principal contradiction in Chinese society has become the contradiction between people's ever-growing needs for a better life and unbalanced and inadequate development . In order to accomplish Two Centenary Goals, achieve the Chinese dream of the great rejuvenation of the Chinese nation, and constantly raise people's living standards, we must unswervingly regard development as the top priority of the party in governing and rejuvenating the country, adhere to emancipating and developing social productivity, and adhere to the reform direction of the socialist market economy and promotion of the sustained and robust economic development. At present, China's economy completes the shift from a high-speed growth stage to a quality development stage and is in the period for the effort to transform the development mode, optimize the economic structure, and convert growth momentum, making it necessary to deepen the supply-side structural reform and continuously enhance China's economic innovation and competitiveness. The reform of the economic system must focus on the improvement of the property rights system and the market-oriented allocation of factors, with the aim of achieving effective incentives for property rights, free flow of factors, flexible price response, fair and orderly competition, and survival of the fittest among enterprises. The reform of state-owned enterprises shall be deepened, a mixed ownership economy shall be developed, the development of private enterprises shall be supported, entrepreneurship shall be stimulated and protected, and more social entities shall be encouraged to participate in innovation and entrepreneurship. A close, clean, and new political and business relationship shall be established, so as to promote the sound development of the non-public economy and encourage people working in the non-public sector to achieve success. | | 十九大报告提出，我国社会主要矛盾已经转化为人民日益增长的美好生活需要和不平衡不充分的发展之间的矛盾。要实现“两个一百年”奋斗目标、实现中华民族伟大复兴的中国梦，不断提高人民生活水平，必须坚定不移把发展作为党执政兴国的第一要务，坚持解放和发展社会生产力，坚持社会主义市场经济改革方向，推动经济持续健康发展。当前，我国经济已由高速增长阶段转向高质量发展阶段，正处在转变发展方式、优化经济结构、转换增长动力的攻关期，要深化供给侧结构性改革，不断增强我国经济创新力和竞争力。经济体制改革必须以完善产权制度和要素市场化配置为重点，实现产权有效激励、要素自由流动、价格反应灵活、竞争公平有序、企业优胜劣汰。深化国有企业改革，发展混合所有制经济，支持民营企业发展，激发和保护企业家精神，鼓励更多社会主体投身创新创业。同时要构建亲清新型政商关系，促进非公有制经济健康发展和非公有制经济人士健康成长。 |
| Entrepreneurs are important subjects of economic activity. The vitality of entrepreneurs is key to sustained and sound economic development. In order to realize the grand goal of comprehensively building a socialist modern power put forward at the 19th CPC National Congress, the innovation and entrepreneurship of entrepreneurs must be fully mobilized. The Opinions focus on promoting entrepreneurship and developing entrepreneurial talents, lead and inspire the vitality of innovation and entrepreneurship in the whole society, closely center on the requirements of overall layout for "economic, political, cultural, social, and ecological progress" and the Four-Pronged Comprehensive Strategy, adapt to, grasp and guide the new normal in economic development, comprehensively implement the new development concept, and make comprehensive arrangements for creating an environment for the sound growth of entrepreneurs, advocating outstanding entrepreneurship, providing quality, efficient, and pragmatic services for entrepreneurs, cultivating outstanding entrepreneurs, and strengthening party leadership over building the entrepreneurs team, and give better play of the role of entrepreneurs. The Opinions require the property rights, innovative interests, and operating autonomy of entrepreneurs to be protected according to the law and a rule-of-law environment that protects the lawful rights and interests of entrepreneurs according to the law to be created. The protection of entrepreneurs' fair competition interests shall be strengthened, the incentive and restraint mechanism for the honest operations of entrepreneurs shall be improved, the fairness, standardization and simplicity of regulation shall be continuously improved, and a market environment that promotes fair competition and honest operation among entrepreneurs shall be created. A close, clean, and new political and business relationship shall be established, a positive incentive orientation for entrepreneurs shall be developed, a positive public opinion atmosphere shall be created, and entrepreneurs shall be encouraged to do business and create businesses. Entrepreneurs' spirit of remaining patriots and devoted to work, obeying disciplines and laws, and engaging in arduous struggle, that of innovative development, a focus on quality, the pursuit of excellence, and that of fulfilling responsibility, bravely shouldering duties, and serving society shall be actively advocated. | | 企业家是经济活动的重要主体。企业家是否有活力决定着经济能否持续健康发展。实现十九大提出的全面建成社会主义现代化强国的宏伟目标，必须充分调动企业家的创新创业创造活力。《意见》着眼于弘扬企业家精神、发挥企业家才能，引领和激发全社会创新创业创造活力，紧紧围绕“五位一体”总体布局和“四个全面”战略布局要求，适应把握引领经济发展新常态，全面贯彻落实新发展理念，对营造企业家健康成长环境、弘扬优秀企业家精神，为企业家提供优质高效务实服务、培育优秀企业家、加强党对企业家队伍建设的领导，更好发挥企业家作用作出了全面部署。《意见》要求，依法保护企业家财产权、创新权益及自主经营权，营造依法保护企业家合法权益的法治环境。强化企业家公平竞争权益保障，健全企业家诚信经营激励约束机制，持续提高监管的公平性、规范性、简约性，营造促进企业家公平竞争、诚信经营的市场环境。构建亲清新型政商关系，树立对企业家的正向激励导向，营造积极向上的舆论氛围，鼓励企业家干事创业。积极弘扬企业家爱国敬业、遵纪守法、艰苦奋斗的精神，创新发展、专注品质、追求卓越的精神和履行责任、敢于担当、服务社会的精神。 |
The above requirements of the Opinions are consistent with the spirit of the 19th CPC National Congress. The procuratorial agencies at all levels shall consolidate the study and implementation of the spirit of the 19th CPC National Congress and the understanding of the requirements of the Opinions, effectively improve their ideological understanding, and ensure understanding and implementation. The significance of respecting the values of entrepreneurs, advocating entrepreneurship, and creating a rule-of-law environment that protects the lawful rights and interests of entrepreneurs, promotes fair competition among entrepreneurs, and encourages entrepreneurs to do business and create businesses, for implementing the new development concept, promote sustained and sound economic development and social harmony and stability, and building a socialist modern power shall be profoundly understood. The actual procuratorial work shall be brought into close focus, procuratorial functions such as crackdown, prevention, supervision, education, and protection shall be comprehensively exploited, the entry points and focus points for protecting entrepreneurs' rights and interests in accordance with the law and serving entrepreneurs' innovation and entrepreneurship shall be accurately pinpointed, duties and responsibilities shall be actively performed, a relaxed environment for the robust growth and career development of entrepreneurs shall be created, entrepreneurs' sense of personal and wealth security shall be effectively strengthened, and entrepreneurs' confidence in innovation and entrepreneurship shall be heightened and stimulated, so as to contribute more to the sustained and sound economic and social development, securing a great victory in socialism with Chinese characteristics in the new era, and realizing the Chinese dream of the great rejuvenation of the Chinese nation.
