The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Specific Application of Law in the Handling of Criminal Cases about Disrupting Order of the Management of Military Uniforms and Vehicle License Plates of the Armed Forces, which was adopted at the 1516th session of the Judicial Committee of the Supreme People's Court on March 28, 2011 and the 60th meeting of the Eleventh Procuratorial Committee of the Supreme People's Procuratorate on April 13, 2011, is hereby issued and shall come into force on August 1, 2011. | |
《最高人民法院、最高人民检察院关于办理妨害武装部队制式服装、车辆号牌管理秩序等刑事案件具体应用法律若干问题的解释》已于2011年3月28日由最高人民法院审判委员会第1516次会议、2011年4月13日由最高人民检察院第十一届检察委员会第60次会议通过，现予公布，自2011年8月1日起施行。 |

To punish according to law the crimes of disrupting order of the management of military uniforms and vehicle license plates of the armed forces and safeguard national defense interests, and in accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the interpretations of several issues on the specific application of law in the handling of criminal cases regarding illegally producing and trading in military uniforms, and forging, stealing and trading in vehicle license plates of the armed forces are hereby made as follows: | |
为依法惩治妨害武装部队制式服装、车辆号牌管理秩序等犯罪活动，维护国防利益，根据《中华人民共和国刑法》有关规定，现就办理非法生产、买卖武装部队制式服装，伪造、盗窃、买卖武装部队车辆号牌等刑事案件的若干问题解释如下： |

| Article 1 Under any of the following circumstances, whoever forges, alters, trades in, steals or robs any official document, certificate or seal of the armed forces shall be convicted of and punished for the crime of forging, altering or trading in official documents, certificates or seals of the armed forces or for the crime of stealing or robbing official documents, certificates or seals of the armed forces in accordance with paragraph 1 of Article 375 of the Criminal Law: | | 第一条 伪造、变造、买卖或者盗窃、抢夺武装部队公文、证件、印章，具有下列情形之一的，应当依照刑法第三百七十五条第一款的规定，以伪造、变造、买卖武装部队公文、证件、印章罪或者盗窃、抢夺武装部队公文、证件、印章罪定罪处罚： |

| 1. forging, altering, trading in, stealing or robbing one or more official documents of the armed forces; | | （一）伪造、变造、买卖或者盗窃、抢夺武装部队公文一件以上的； |
| |
|
| 2. forging, altering, trading in, stealing or robbing two or more army ID cards for military officers or soldiers, vehicle driving permits, driving licenses or other certificates; or | | （二）伪造、变造、买卖或者盗窃、抢夺武装部队军官证、士兵证、车辆行驶证、车辆驾驶证或者其他证件二本以上的； |

| 3. forging, altering, trading in, stealing or robbing one or more seals, seals of vehicle license plates or other seals of the armed forces. | | （三）伪造、变造、买卖或者盗窃、抢夺武装部队机关印章、车辆牌证印章或者其他印章一枚以上的。 |
Where anyone commits any act as prescribed in the aforesaid paragraph and the quantity reaches five times the standard as prescribed in subparagraphs 1 to 3 or any other serious consequence has been caused, the act shall fall within the “serious circumstances” as mentioned in paragraph 1 of Article 375 of the Criminal Law.

实施前款规定的行为，数量达到第（一）至（三）项规定标准五倍以上或者造成严重后果的，应当认定为刑法第三百七十五条第一款规定的“情节严重”。 |
