| Measures for the Self-Monitoring and Information Disclosure by the Enterprises subject to Intensive Monitoring and Control of the State (for Trial Implementation) | | 第一条 为规范企业自行监测及信息公开，督促企业自觉履行法定义务和社会责任，推动公众参与，根据《中华人民共和国环境保护法》、《中华人民共和国水污染防治法》、《“十二五”主要污染物总量减排考核办法》、《“十二五”主要污染物总量减排监测办法》、《环境监测管理办法》等有关规定，制定本办法。 |
| Chapter I General Provisions | | 第二条 本办法适用于国家重点监控企业、以及纳入各地年度减排计划且向水体集中直接排放污水的规模化畜禽养殖场（小区）。其他企业可参照执行。 |
| | 本办法所称的企业自行监测，是指企业按照环境保护法律法规要求，为掌握本单位的污染物排放状况及其对周边环境质量的影响等情况，组织开展的环境监测活动。 |
| Article 1 In order to regulate the self-monitoring and information disclosure by enterprises, urge enterprises to conscientiously fulfill their legal obligations and social responsibilities, and promote public participation, these Measures are formulated in accordance with the Environmental Protection Law of the People's Republic of China, the Water Pollution Prevention and Control Law of the People's Republic of China, the Measures for the Assessment of Reduction of the Total Emission of Major Pollutants during the “Twelfth Five-Year Plan” Period, the Measures for the Monitoring of Reduction of Total Emission of Major Pollutants during the “Twelfth Five-Year Plan” Period, the Measures for the Administration of Environmental Surveillance and other relevant provisions. | | |
| | 第三条 企业可依托自有人员、场所、设备开展自行监测，也可委托其他检（监）测机构代其开展自行监测。 |
| Article 2 These Measures shall apply to the enterprises subject to intensive monitoring and control of the state and the large-scale livestock and poultry farms (breeding farms) incorporated into annual pollutant discharge reduction plans in all localities and directly discharging sewage to waters in a concentrated manner. Other enterprises may be analogically governed by these Measures. | | 企业对其自行监测结果及信息公开内容的真实性、准确性、完整性负责。 |
For the purpose of these Measures, “self-monitoring by enterprises” means the environmental surveillance activities organized and implemented by enterprises in accordance with the requirements of the laws and regulations on environmental protection to get information on the discharge of pollutants by these entities and its impacts on the quality of surrounding environment and other circumstances. | | 第二章 监测与报告 |
| Article 3 Enterprises may rely on the self-owned personnel, places and equipment to conduct self-monitoring or engage other inspection (monitoring) institutions to conduct self-monitoring on their behalves. | | 第四条 企业应当按照国家或地方污染物排放（控制）标准、环境影响评价报告书（表）及其批复、环境监测技术规范的要求，制定自行监测方案。 |
Enterprises shall be responsible for the authenticity, accuracy and completeness of the results of self-monitoring and the contents of information disclosure thereof. | | 自行监测方案内容应包括企业基本情况、监测点位、监测频次、监测指标、执行排放标准及其限值、监测方法和仪器、监测质量控制、监测点位示意图、监测结果公开时限等。 |
| | 自行监测方案及其调整、变化情况应及时向社会公开，并报地市级环境保护主管部门备案，其中装机总容量30万千瓦以上火电厂向省级环境保护主管部门备案。 |
| Chapter II Monitoring and Reporting | | |
| | 第五条 企业自行监测内容应当包括： |
| Article 4 Enterprises shall formulate self-monitoring plans in accordance with the requirements of the national or local pollutant discharge (control) standards, environmental impact assessment reports (tables) and the official approval documents thereof and the environmental monitoring technical specifications. | | （一）水污染物排放监测； |
The contents of self-monitoring plans shall include enterprises' basic information, monitoring sites, monitoring frequencies, monitoring indexes, implementation of discharge standards and the limits thereof, monitoring methods and instruments, monitoring quality control, monitoring site schematic diagrams, and the time limits for disclosure of monitoring results, among others. | | （二）大气污染物排放监测； |
The self-monitoring plans and the adjustments and changes thereof shall be publicized to the general public in a timely manner, and be reported to the competent departments of environmental protection at the prefecture level for recordation. The thermal power plants with the total installed capacity of 300,000 kilowatts or more shall report to the competent department of environmental protection at the provincial level for recordation. | | （三）厂界噪声监测； |
| | （四）环境影响评价报告书（表）及其批复有要求的，开展周边环境质量监测。 |
| Article 5 The contents of self-monitoring by enterprises shall include: | | |
| | 第六条 企业应当按照环境保护主管部门的要求，加强对其排放的特征污染物的监测。 |
| (1) water pollutant discharge monitoring; | | |
| | 第七条 企业应当按照环境监测管理规定和技术规范的要求，设计、建设、维护污染物排放口和监测点位，并安装统一的标识牌。 |
| (2) air pollutant discharge monitoring; | | |
| | 第八条 企业自行监测应当遵守国家环境监测技术规范和方法。国家环境监测技术规范和方法中未作规定的，可以采用国际标准和国外先进标准。 |
| (3) monitoring of environmental noise within the boundary of an industrial enterprise; and | | 自行监测活动可以采用手工监测、自动监测或者手工监测与自动监测相结合的技术手段。环境保护主管部门对监测指标有自动监测要求的，企业应当安装相应的自动监测设备。 |
| (4) surrounding environment quality monitoring as required by environmental impact assessment reports (tables) and the approval documents thereof. | | 第九条 采用自动监测的，全天连续监测；采用手工监测的，应当按以下要求频次开展监测，其中，国家或地方发布的规范性文件、规划、标准中对监测指标的监测频次有明确规定的，按规定执行： |
| | （一）化学需氧量、氨氮每日开展监测，废水中其他污染物每月至少开展一次监测； |
| Article 6 Enterprises shall strengthen the monitoring of their discharge of characteristic pollutants in accordance with the requirements of the competent departments of environmental protection. | | （二）二氧化硫、氮氧化物每周至少开展一次监测，颗粒物每月至少开展一次监测，废气中其他污染物每季度至少开展一次监测； |
| | （三）纳入年度减排计划且向水体集中直接排放污水的规模化畜禽养殖场（小区），每月至少开展一次监测； |
| Article 7 Enterprises shall, in accordance with the requirements of the environmental monitoring administration provisions and technical specifications, design, construct and maintain the pollutant discharge outlets and monitoring sites, and install unified signboards. | | （四）厂界噪声每季度至少开展一次监测； |
| | （五）企业周边环境质量监测，按照环境影响评价报告书（表）及其批复要求执行。 |
| Article 8 The self-monitoring by enterprises shall follow the national environmental monitoring technical specifications and methods. Where there is no corresponding provision in the national environmental monitoring technical specifications and methods, international standards and advanced foreign standards may apply. | | |
The self-monitoring activities may adopt manual monitoring, automatic monitoring or the technological means which integrates manual monitoring and automatic monitoring. Where the competent departments of environmental protection have requirements for the automatic monitoring of monitoring indexes, enterprises shall install corresponding automatic monitoring equipment. | | 第十条 以手工监测方式开展自行监测的，应当具备以下条件： |
| | （一）具有固定的工作场所和必要的工作条件； |
| Article 9 Where automatic monitoring is adopted, continuous monitoring throughout the day shall be conducted; where manual monitoring is adopted, monitoring shall be conducted according to the following frequencies. If there is any express provision on monitoring frequency in the normative documents, plans and standards issued by the state or local areas, such a provision shall apply: | | （二）具有与监测本单位排放污染物相适应的采样、分析等专业设备、设施； |
| | （三）具有两名以上持有省级环境保护主管部门组织培训的、与监测事项相符的培训证书的人员； |
| (1) Monitoring shall be conducted on a daily basis for chemical oxygen demand and ammonia nitrogen, and at a minimum once a month for other pollutants in wastewater. | | （四）具有健全的环境监测工作和质量管理制度； |
| | （五）符合环境保护主管部门规定的其他条件。 |
| (2) Monitoring shall be conducted at a minimum once a week for sulfur dioxide and nitrogen oxides, at a minimum once a month for particulate matters, and at a minimum once a quarter for other pollutants in waste gas. | | 以自动监测方式开展自行监测的，应当具备以下条件： |
| | （一）按照环境监测技术规范和自动监控技术规范的要求安装自动监测设备，与环境保护主管部门联网，并通过环境保护主管部门验收； |
| (3) The large-scale livestock and poultry farms (breeding farms) incorporated into annual discharge reduction plans and directly discharging sewage to waters in a concentrated manner shall be monitored at a minimum once a month. | | （二）具有两名以上持有省级环境保护主管部门颁发的污染源自动监测数据有效性审核培训证书的人员，对自动监测设备进行日常运行维护； |
| | （三）具有健全的自动监测设备运行管理工作和质量管理制度； |
| (4) Monitoring of environmental noise within the boundary of an industrial enterprise shall be monitored at a minimum once a quarter. | | （四）符合环境保护主管部门规定的其他条件。 |
| (5) The monitoring of an enterprise's surrounding environment quality shall be conducted in accordance with the requirements of the environmental impact assessment report (table) and approval documents thereof. | | 第十一条 企业自行监测采用委托监测的，应当委托经省级环境保护主管部门认定的社会检测机构或环境保护主管部门所属环境监测机构进行监测。 |
| | 承担监督性监测任务的环境保护主管部门所属环境监测机构不得承担所监督企业的自行监测委托业务。 |
| Article 10 To conduct self-monitoring by manual monitoring means, enterprises shall meet the following conditions: | | |
| | 第十二条 自行监测记录包含监测各环节的原始记录、委托监测相关记录、自动监测设备运维记录，各类原始记录内容应完整并有相关人员签字，保存三年。 |
| (1) Having fixed workplaces and the necessary working conditions. | | |
| | 第十三条 企业应当定期参加环境监测管理和相关技术业务培训。 |
| (2) Having the sampling, analysis and other professional equipment and facilities appropriate for the monitoring of pollutants discharge by these entities. | | |
| | 第十四条 企业自行监测应当遵守国务院环境保护主管部门颁布的环境监测质量管理规定，确保监测数据科学、准确。 |
| (3) Having two or more personnel who hold the training certificates for the trainings organized by the competent departments of environmental protection at the provincial level and consistent with the monitoring matters. | | |
| | 第十五条 企业应当使用自行监测数据，按照国务院环境保护主管部门有关规定计算污染物排放量，在每月初的7个工作日内向环境保护主管部门报告上月主要污染物排放量，并提供有关资料。 |
| (4) Having sound environmental monitoring work and quality management systems. | | |
| | 第十六条 企业自行监测发现污染物排放超标的，应当及时采取防止或减轻污染的措施，分析原因，并向负责备案的环境保护主管部门报告。 |
| (5) Complying with other conditions as prescribed by the competent departments of environmental protection. | | |
