For purposes of implementing the arrangements and requirements of the CPC Central Committee and the State Council for advancing law-based administration and building a law-based government and further improving the drafting, examination, and development of administrative normative documents for securities and futures, in accordance with the Legislation Law, the Notice by the General Office of the State Council of Strengthening the Development and Supervisory Administration of Administrative Regulatory Documents | | 为落实党中央、国务院关于推进依法行政、建设法治政府的部署和要求，进一步做好证券期货行政规范性文件起草审查制定工作，根据《立法法》《国务院办公厅关于加强行政规范性文件制定和监督管理工作的通知》（国办发〔2018〕37号）、《国务院办公厅关于全面推行行政规范性文件合法性审核机制的指导意见》（国办发〔2018〕115号）等规定，现将有关事项通知如下： |
| I. The development of administrative normative documents shall comply with the provisions of the superordinate law, control the number of the documents issued, proceed based on the actual situation of China's securities and futures markets, and focus on pertinence and operability. The China Securities Regulatory Commission (“CSRC”) shall uniformly register, number and issue administrative normative documents, and announce them to the public in the form of announcement by the CSRC. | | 一、制定行政规范性文件，应当符合上位法规定，控制发文数量，立足我国证券期货市场的发展实际，注重针对性和可操作性。证监会对行政规范性文件进行统一登记、统一编号、统一印发，并以证监会公告形式向社会公布。 |
| II. All departments of the CSRC shall be responsible for the drafting of administrative normative documents within the scope of their functions and duties. Where an administrative normative document involves the functions and duties of multiple departments or has comprehensive contents, the leaders of the CSRC shall designate the leading drafting department or set up a special working group to jointly draft it. No internal department or local office of the CSRC may issue administrative normative documents in its own name. | | 二、证监会各部门负责其职责范围内的行政规范性文件起草工作；行政规范性文件涉及多个部门职责或者内容综合性较强的，由会领导指定主要起草部门，或者成立专门的工作小组共同负责起草。证监会内设部门、派出机构不得以自己名义制发行政规范性文件。 |
III. The drafting departments shall conduct a comprehensive demonstration of the necessity, feasibility, and rationality of an administrative normative document, explain the actual situation in the regulated field, the problems needed to be solved and main institutional measures to be regulated, assess the expected effect of the relevant measures and possible impact, and check whether the administrative normative document conforms to laws, regulations and national policies.
