| Article 1 This Law is formulated to inherit and carry forward the fine traditional culture of the Chinese nation, promote the building of the socialist spiritual civilization, and strengthen the protection and preservation of intangible cultural heritage. | | 第一条 为了继承和弘扬中华民族优秀传统文化，促进社会主义精神文明建设，加强非物质文化遗产保护、保存工作，制定本法。 |

| Article 2 The term “intangible cultural heritage” (“ICH”) as mentioned in this Law shall refer to various traditional cultural manifestations which are handed down by the people of all nationalities from generation to generation and regarded as part of their cultural heritage, and objects and spaces relevant to traditional cultural manifestations, including: | | 第二条 本法所称非物质文化遗产，是指各族人民世代相传并视为其文化遗产组成部分的各种传统文化表现形式，以及与传统文化表现形式相关的实物和场所。包括： |

| 1. traditional oral literature and the language as a vehicle thereof; | | （一）传统口头文学以及作为其载体的语言； |
| |
|
| 2. traditional fine arts, calligraphy, music, dance, drama, quyi and acrobatics; | | （二）传统美术、书法、音乐、舞蹈、戏剧、曲艺和杂技； |
| |
|
| 3. traditional techniques, medicine and calendar; | | （三）传统技艺、医药和历法； |
| |
|
| 4. traditional rituals, festivals and other folk customs; | | （四）传统礼仪、节庆等民俗； |

| 5. traditional sports and entertainment; and | | （五）传统体育和游艺； |

For the objects and spaces forming part of the ICH and falling under the category of cultural relics, the relevant provisions of the Cultural Relics Protection Law of the People's Republic of China shall apply. | |
属于非物质文化遗产组成部分的实物和场所，凡属文物的，适用《中华人民共和国文物保护法》的有关规定。 |

| Article 3 The state shall preserve the ICH by determination, recording, filing, etc. and protect the ICH which reflects the fine traditional culture of the Chinese nation and has historical, literary, artistic or scientific value by inheritance, spread, etc. | | 第三条 国家对非物质文化遗产采取认定、记录、建档等措施予以保存，对体现中华民族优秀传统文化，具有历史、文学、艺术、科学价值的非物质文化遗产采取传承、传播等措施予以保护。 |

| Article 4 The authenticity, integrity and inheritance of the ICH shall be attached importance to in the protection thereof, which shall be favorable for enhancing the cultural identity of the Chinese nation, safeguarding national unity and ethnic solidarity and promoting the harmonious and sustainable development of the society. | | 第四条 保护非物质文化遗产，应当注重其真实性、整体性和传承性，有利于增强中华民族的文化认同，有利于维护国家统一和民族团结，有利于促进社会和谐和可持续发展。 |

| Article 5 Both the ICH forms and connotations shall be respected in their usage. | | 第五条 使用非物质文化遗产，应当尊重其形式和内涵。 |
The ICH shall not be used in the form of distortion, derogation, etc. | |
禁止以歪曲、贬损等方式使用非物质文化遗产。 |

| Article 6 The people's government at or above the county level shall include ICH protection and preservation in the national economic and social development planning at the same level and include the funds for ICH protection and preservation in the financial budget at the same level. | | 第六条 县级以上人民政府应当将非物质文化遗产保护、保存工作纳入本级国民经济和社会发展规划，并将保护、保存经费列入本级财政预算。 |
The state shall provide support for ICH protection and preservation in the ethnic regions, remote and border areas and poverty-stricken areas. | |
国家扶持民族地区、边远地区、贫困地区的非物质文化遗产保护、保存工作。 |

| Article 7 The competent culture department of the State Council shall be responsible for ICH protection and preservation across the country; and the competent culture department of the local people's government at or above the county level shall be responsible for ICH protection and preservation within its administrative region. | | 第七条 国务院文化主管部门负责全国非物质文化遗产的保护、保存工作；县级以上地方人民政府文化主管部门负责本行政区域内非物质文化遗产的保护、保存工作。 |
Other relevant departments of the people's government at or above the county level shall be responsible for ICH protection and preservation within the scope of their respective functions. | |
县级以上人民政府其他有关部门在各自职责范围内，负责有关非物质文化遗产的保护、保存工作。 |

| Article 8 The people's government at or above the county level shall strengthen the publicity of ICH protection, and enhance the awareness of the whole society on ICH protection. | | 第八条 县级以上人民政府应当加强对非物质文化遗产保护工作的宣传，提高全社会保护非物质文化遗产的意识。 |
| |
|
| Article 9 The state shall encourage and support the participation of citizens, legal persons and other organizations in ICH protection. | | 第九条 国家鼓励和支持公民、法人和其他组织参与非物质文化遗产保护工作。 |
| |
|
| Article 10 The organizations and individuals that have made remarkable contributions in ICH protection shall be commended and rewarded according to the relevant provisions of the state. | | 第十条 对在非物质文化遗产保护工作中做出显著贡献的组织和个人，按照国家有关规定予以表彰、奖励。 |
| |
|
| Chapter II Investigation of Intangible Cultural Heritage | | 第二章 非物质文化遗产的调查 |

|
| Article 11 The people's government at or above the county level shall organize ICH investigations as required for ICH protection and preservation. The competent culture department shall be responsible for conducting ICH investigations. | | 第十一条 县级以上人民政府根据非物质文化遗产保护、保存工作需要，组织非物质文化遗产调查。非物质文化遗产调查由文化主管部门负责进行。 |
Other relevant departments of the people's government at or above the county level may conduct ICH investigations within their respective work fields. | |
县级以上人民政府其他有关部门可以对其工作领域内的非物质文化遗产进行调查。 |

| Article 12 When conducting ICH investigations, the competent culture department and other relevant departments shall determine, record and file the ICH and establish a sound investigation information sharing mechanism. | | 第十二条 文化主管部门和其他有关部门进行非物质文化遗产调查，应当对非物质文化遗产予以认定、记录、建档，建立健全调查信息共享机制。 |
When conducting ICH investigations, the competent culture department and other relevant departments shall collect the representative objects forming part of the ICH, classify and properly keep the materials obtained in investigation, and prevent the destruction or loss thereof. The duplicates of photos of and materials on the objects obtained by other relevant departments shall be summarized and submitted to the competent culture department at the same level. | |
文化主管部门和其他有关部门进行非物质文化遗产调查，应当收集属于非物质文化遗产组成部分的代表性实物，整理调查工作中取得的资料，并妥善保存，防止损毁、流失。其他有关部门取得的实物图片、资料复制件，应当汇交给同级文化主管部门。 |

| Article 13 The competent culture department shall fully understand the relevant ICH information, create ICH files and establish the relevant databases. The ICH files and the relevant data shall be made public for consultation, except for those that shall be kept confidential according to law. | | 第十三条 文化主管部门应当全面了解非物质文化遗产有关情况，建立非物质文化遗产档案及相关数据库。除依法应当保密的外，非物质文化遗产档案及相关数据信息应当公开，便于公众查阅。 |

| Article 14 Citizens, legal persons and other organizations may conduct ICH investigations according to law. | | 第十四条 公民、法人和其他组织可以依法进行非物质文化遗产调查。 |

Article 15 To conduct an ICH investigation within the territory of the People's Republic of China, an overseas organization or individual shall report to the competent culture department of the people's government of the province, autonomous region or municipality directly under the Central Government for approval; where the investigation will be conducted in two or more provinces, autonomous regions and municipalities directly under the Central Government, it/he shall report to the competent culture department of the State Council for approval; and after the completion of the investigation, submit the investigation report and the duplicates of photos of and materials on the objects obtained during investigation to the competent culture department which approves the investigation.
