The Measures for the Implementation of the Scientific Research and Production Licensing of Arms and Equipment, as deliberated and adopted at the 7th executive meeting of the Ministry of Industry and Information Technology of the People's Republic of China on November 12, 2009 and deliberated and adopted by the General Armament Department of the People's Liberation Army, are hereby promulgated and shall come into force on May 10, 2010. The Measures for the License Administration of License for the Scientific Research and Production of Military Electronic Equipment (Order No.32 of the Ministry of Information Industry of the People's Republic of China) promulgated by the former Ministry of Information Industry of the People's Republic of China on December 14, 2004 and the Measures for the Implementation of the Scientific Research and Production Licensing of Weapons and Outfits (Order No.15 of the National Defense Commission of Science, Technology and Industry of the People's Republic of China) Promulgated by the former National Defense Commission of Science, Technology and Industry of the People's Republic of China on May 26, 2005 shall be abolished simultaneously. | |

| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 To regulate the licensing administration of scientific research and production licensing administration of arms and equipment, these Measures are formulated in accordance with the Regulation on Licensing Administration of Scientific Research and Production of Arms and Equipment. | | 第一条 为了规范武器装备科研生产许可管理，根据《武器装备科研生产许可管理条例》，制定本办法。 |

| Article 2 Anyone engaged in the activities of scientific research and production of arms and equipment as listed in the licensing list of scientific research and production of arms and equipment subject to license (hereinafter referred to as the “licensing list”) shall apply for a license for the scientific research and production of arms and equipment in accordance with these Measures; No one may, without the a license for the scientific research and production of arms and equipment, engage in the activities of scientific research and production of arms and equipment listed in the licensing list, however, those approved by the State Council and the Central Military Commission as well as those activities of special scientific research of arms and equipment shall be excluded. | | 第二条 从事武器装备科研生产许可目录（以下简称许可目录）所列的武器装备科研生产活动，应当依照本办法申请取得武器装备科研生产许可；未取得武器装备科研生产许可的，不得从事许可目录所列的武器装备科研生产活动。但是，经国务院、中央军委批准的，以及专门的武器装备科学研究活动除外。 |
The term “activities of scientific research and production of arms and equipment” as mentioned in these Measures refers to the scientific research and production activities on the complete sets, systems and special accessory products of the arms and equipment. | |

| Article 3 The licenseing administration of scientific research and production of arms and equipment shall be based on the demands of national defense construction and the development of arms and equipment, and observe the principle of making overall plans and taking with all factors consideredinto consideration, making reasonable arrangements, encouraging competition, being safe and confidential, strict administration, fairness and impartiality. | | 第三条 武器装备科研生产许可管理，应当根据国防建设和武器装备发展需要，遵循统筹兼顾、合理布局、鼓励竞争、安全保密、严格管理、公平公正的原则。 |

| Article 4 The licensing of scientific research and production of arms and equipment shall be classified into Class A licenseing and Class B licenseing according to the importance of the arms and equipment as well as their special accessory products, and the specific classification of the licensing of scientific research and production of arms and equipment shall be prescribed in the licensing list. The licensing list shall be formulated and promulgated by the State Administration of Science, Technology and Industry for National Defense (hereinafter referred to as the “SASTIND”) jointly with the General Armament Department of the People's Liberation Army (hereinafter referred to as the “GAD”) and shall be adjusted in due time. | | 第四条 武器装备科研生产许可根据武器装备及其专用配套产品的重要程度，分为第一类许可和第二类许可，武器装备科研生产许可的具体分类在许可目录中规定。许可目录由国家国防科技工业局（以下简称国防科工局）会同中国人民解放军总装备部（以下简称总装备部）共同制定和发布，并适时调整。 |

| Article 5 The SASTIND shall be responsible for the scientific research and production licensing administration of arms and equipment throughout the country, and perform the following duties: | | 第五条 国防科工局负责全国的武器装备科研生产许可管理，履行下列职责： |

|
| 1. Formulating the policies and provisions on the scientific research and production licensing administration of arms and equipment; | | （一）制定武器装备科研生产许可管理的政策、规定； |
| |
|
| 2. Formulating the licensing list jointly with the GAD; | | （二）会同总装备部制定许可目录； |
| |
|
| 3. Accepting and examining the applications for Class A licensesing, approving, issuing, canceling and revoking the licenses for the scientific research and production of arms and equipment, and handling the alteration, extension and removal of the licenses; and | | （三）受理、审查第一类许可的申请，审批、颁发、撤销、吊销武器装备科研生产许可证，办理武器装备科研生产许可证的变更、延续及注销； |
| |
|
| 4. Organizing to carry out the supervision and inspection over the licensing of scientific research and production of arms and equipment. | | （四）组织开展武器装备科研生产许可监督检查。 |
The office for scientific research and production licensing administration of arms and equipment under the SASTIND shall be responsible for the routine work. | |
国防科工局武器装备科研生产许可管理办公室负责日常工作。 |

| Article 6 The GAD shall be responsible for the joint administration of the licensing of the scientific research and production of arms and equipment throughout the country. The department for the joint administration of the licensing of scientific research and production of arms and equipment under the GAD (hereinafter referred to as the “department for the joint licensing administration under the GAD”) shall perform the following duties: | | 第六条 总装备部负责全国武器装备科研生产许可的协同管理。总装备部武器装备科研生产许可协同管理部门（以下简称总装备部许可协同管理部门）履行下列职责： |

| 1. Participating in the formulation of the policies and provisions on the scientific research and production licensing administration of arms and equipment; | | （一）参与制定武器装备科研生产许可管理的政策、规定； |
| |
|
| 2. Jointly formulating the licensing list; | | （二）会同编制许可目录； |
| |
|
| 3. Jointly examining the applications for licensesing, the issuing, alteration, extension, cancellation and removal of the licenses for scientific research and production of arms and equipment, and putting forward opinions on administrative penaltiesy; | | （三）协同审查武器装备科研生产许可的申请、发放、变更、延续、撤销和注销，对行政处罚提出意见； |
| |
|
| 4. Organizing the military representative offices dispatched by the People's Liberation Army to relevant entities or regions (hereinafter referred to as the “dispatched military representative offices”) to participate in the on-site examination on of the licensing of scientific research and production of arms and equipment; and | | （四）组织中国人民解放军派出的驻相关单位或者地区的军事代表机构（以下简称派驻军事代表机构）参与武器装备科研生产许可现场审查； |
| |
|
| 5. Jointly carrying out the supervision and inspection over the licensing of scientific research and production of arms and equipment. | | （五）协同开展武器装备科研生产许可监督检查。 |

|
| Article 7 The administrative departments of science, technology and industry for national defense of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the “local administrative departments of science, technology and industry for national defense”) shall perform the following duties: | | 第七条 省、自治区、直辖市人民政府国防科技工业管理部门（以下称地方国防科技工业管理部门）履行下列职责： |

| 1. Accepting and examining the applications for Class B licensesing within their respective administrative regions, and putting forward the examination opinions; | | （一）受理、审查本行政区域内的第二类许可申请，并提出审查意见； |
| |
|
| 2. Being responsible for the supervision and administration of the entities of scientific research and production of arms and equipment obtaining Class B licensesing within their respective administrative regions; investigating and verifying the entities and acts engaging in illegal scientific research and production of arms and equipment, and putting forward handling suggestions to the SASTIND; | | （二）负责本行政区域内取得第二类许可的武器装备科研生产单位的监督管理；调查核实本行政区域内违法从事武器装备科研生产的单位和行为，并向国防科工局提出处理建议； |
| |
|
| 3. Assisting the SASTIND in the on-site examination on the entities that apply for class A licensesing within their respective administrative regions; and | | （三）协助国防科工局对本行政区域内申请第一类许可的单位进行现场审查； |
| |
|
| 4. Assisting the SASTIND in the supervision and administration of the entities of scientific research and production of arms and equipment obtaining Class A licenses within their respective administrative regions. | | （四）协助国防科工局对本行政区域内取得第一类许可的武器装备科研生产单位进行监督管理。 |
| |
|
| Article 8 The dispatched military representative offices shall, pursuant to the internal division of responsibilities of the army and jointly with the local administrative departments of science, technology and industry for national defense, carry out the examination, supervision and administration of the licenses of scientific research and production of arms and equipment of the dispatched regions. | | 第八条 派驻军事代表机构按照军队内部职责分工协同地方国防科技工业管理部门开展派驻地区的武器装备科研生产许可审查和监督管理工作。 |

| Article 9 The SASTIND shall, according to the state's requirements of the state for distribution of capabilities of scientific research and production of arms and equipment and the actual needs of scientific research and production of arms and equipment, implements the quantitative restriction to the Class A licenses for the scientific research and production of arms and equipment after soliciting the opinions of the GAD. The specific specialties or products subject to the quantitative restriction and the restricted number shall be separately determined. | | 第九条 国防科工局按照国家武器装备科研生产能力布局要求，根据武器装备科研生产的实际需要，经征求总装备部意见，对第一类许可实行数量限制。实行数量限制的具体专业或者产品和限制数量另行规定。 |

| Chapter II Application and Acceptance | | 第二章 申请与受理 |

|
| Article 10 To apply for a license for the scientific research and production of arms and equipment, an entity shall have the conditions as prescribed in Article 7 of the Regulation on Licensing Administration of Scientific Research and Production of Arms and Equipment. Among themIn particular, an entity that applies for the licenseing of scientific research and production of complete sets and systems of arms and equipment shall also have the corresponding engineering organization and coordination abilities. | | 第十条 申请武器装备科研生产许可的单位，应当具备《武器装备科研生产许可管理条例》第七条规定的条件。其中，申请武器装备总体和系统科研生产许可的，还应当具有相应的工程组织、协调能力。 |

| Article 11 An entity that applies for a license for scientific research and production of arms and equipment shall submit an Application Form for Licenses for the Scientific Research and Production of Arms and Equipment, and the following documents and materials shall be simultaneously submitted (in photocopyies): | | 第十一条 申请武器装备科研生产许可的单位，应当提交《武器装备科研生产许可证申请书》，同时提交以下文件、材料（复印件）： |

|
| 1. the business license of an enterprise legal person or the legal person certificate of a public institution; | | （一）企业法人营业执照或者事业单位法人证书； |
| |
|
| 2. the corresponding accreditation certificate of quality management system; | | （二）相应的质量管理体系认证证书； |
| |
|
| 3. the certification document on reaching the production safety standards (the production safety license or an appraisal report on the production safety for an application for engaging in the production of dangerous hazardous articles); | | （三）安全生产达标证明文件（其中申请从事危险品生产的，提交安全生产许可证或者安全生产评价报告）； |
| |
|
| 4. the confidentiality qualification certificate; | | （四）保密资格证书； |
| |
|
| 5. the documents on passing the acceptance check on or reaching the standards of environmental protection and fire control as prescribed by laws and administrative regulations; and | | （五）法律、行政法规规定的环保、消防验收文件或者达标文件； |
| |
|
| 6. other documents and materials that the applying applicant entity deems believes that may prove its abilities and qualifications. | | （六）申请单位认为可以证明其能力条件的其他文件、材料。 |
| |
|
| Article 12 An entity that applies for a license for scientific research and production of arms and equipment shall file an application in accordance with the following provisions: | | 第十二条 申请武器装备科研生产许可的单位，按照下列规定提出申请： |
| |
|
| 1. An application for Class A licenseing or an application for both Class A licenseing and Class B licenseing shall be filed to the SASTIND, and the application materials shall be submitted in triplicate (including an electronic text in a compact disc). | | （一）申请第一类许可的，或者同时申请第一类、第二类许可的，向国防科工局提出申请，并提交申请材料一式三份（含电子版光盘）。 |
| |
|
| 2. An application for Class B license shall be filed to the local administrative department of science, technology and industry for national defense of the province, autonomous region or municipality directly under the Central Government at its locality, and the application materials shall be submitted in triplicate (including an electronic text in a compact disc). | | （二）申请第二类许可的，向其所在省、自治区、直辖市的国防科技工业管理部门提出申请，并提交申请材料一式三份（含电子版光盘）。 |
One copy of the application materials (including an electronic text in a compact disc) of Class A license and Class B license shall be submitted to the department for the joint licensing administration under the GAD simultaneously. | |
第一类许可、第二类许可的申请材料（含电子版光盘）应当同时报送总装备部许可协同管理部门一份。 |

|
| Article 13 The SASTIND and the local administrative departments of science, technology and industry for national defense shall conduct the examination in accordance with Article 32 of the Administrative License Law of the People's Republic of China, make an acceptance decision within 5 days for those that conforming to the acceptance conditions, or notify the applying entity applicant of all necessary supplements and corrections at the same time on the spot or within 5 days if the application materials are incomplete or not in the statutory form, or notify the applying entity applicant and give the reasons in writing if a decision on non-acceptance is to be made. | | 第十三条 国防科工局和地方国防科技工业管理部门应当依照《中华人民共和国行政许可法》第三十二条的规定进行审查，符合受理条件的，应当在5日内作出受理决定。申请材料不齐全或者不符合法定形式的，应当当场或者在5日内一次告知申请单位需要补正的全部内容。作出不予受理决定的，应当书面告知并说明理由。 |

| Article 14 The department for joint licensing administration under the GAD shall, within 4 days after receiving the application materials, feed its examination opinions on the licensing application materials back to the SASTIND or the local administrative departments of science, technology and industry for national defense. | | 第十四条 总装备部许可协同管理部门对许可申请材料的审查意见，应当自收到申请材料之日起4日内向国防科工局或者地方国防科技工业管理部门反馈。 |

| Chapter III Examination and Approval | | 第三章 审查与批准 |

|
Article 15 The SASTIND and the local administrative departments of science, technology and industry for national defense shall, after accepting the applications, organize experts to conduct an on-site examination on the applications for a licenseing for scientific research and production of arms and equipment, and the department for joint licensing administration under the GAD shall designate the dispatched military representative offices to participate in such the examination. Where it is unsuitable to conduct an on-site examination because it involves any core secret of the state, a written examination may be conducted in light of the actual situation. The time needed by experts to conduct the on-site examination shall not be included in the time limit for licensing as prescribed in this Chapter.
．．．．．． | | 第十五条 国防科工局和地方国防科技工业管理部门受理申请后，应当组织专家对武器装备科研生产许可申请进行现场审查，总装备部许可协同管理部门指派派驻军事代表机构参加。对因涉及国家核心机密不宜进行现场审查的，可以根据实际情况进行书面审查。专家现场审查所需时间不计算在本章规定的许可时限内。
