| The advancement of the supply-side structural reform put forward at the Central Economic Work Conference is a major strategic arrangement suited to the new normal of China's economic development. Providing strong judicial guarantees for the supply-side structural reform is an important task of people's courts at present and in the future. Bankruptcy trials play a unique role in promoting the regeneration or orderly exit of market participants in accordance with the law, optimizing the allocation of social resources, and improving the mechanism for the survival of the fittest and is an important route for people's courts to support the supply-side structural reform and promote the resolution of overcapacity. Therefore, courts at all levels shall attach great importance to and vigorously strengthen bankruptcy trials and conscientiously research and solve institutional obstacles to the performance of the bankruptcy trial function. At present, courts at all levels shall especially effectively file and accept bankruptcy cases, which is the primary step in strengthening bankruptcy trials. For the purpose of the foregoing, you are hereby notified of issues concerning the filing and acceptance of bankruptcy cases by people's courts as follows: | | 中央经济工作会议提出推进供给侧结构性改革，这是适应我国经济发展新常态作出的重大战略部署。为供给侧结构性改革提供有力的司法保障，是当前和今后一段时期人民法院的重要任务。破产审判工作具有依法促进市场主体再生或有序退出，优化社会资源配置、完善优胜劣汰机制的独特功能，是人民法院保障供给侧结构性改革、推动过剩产能化解的重要途径。因此，各级法院要高度重视、大力加强破产审判工作，认真研究解决影响破产审判职能发挥的体制性、机制性障碍。当前，尤其要做好破产案件的立案受理工作，这是加强破产审判工作的首要环节。为此，特就人民法院破产案件立案受理的有关问题通知如下： |
| I. As the filing and acceptance of bankruptcy cases is related to the protection of the parties' right to bankruptcy petition, determines whether the bankruptcy proceedings can be successfully initiated, and is the basic work in the trial of bankruptcy cases, courts at all levels shall fully understand its significance and effectively conduct relevant work as required by this Notice, and may not impose conditions in addition to the statutory conditions, restrict or preclude the parties' right to bankruptcy petition, prevent the filing and acceptance of bankruptcy cases, or affect the normal commencement of the bankruptcy proceedings. | | 一、破产案件的立案受理事关当事人破产申请权保障，决定破产程序能否顺利启动，是审理破产案件的基础性工作，各级法院要充分认识其重要意义，依照本通知要求，切实做好相关工作，不得在法定条件之外设置附加条件，限制剥夺当事人的破产申请权，阻止破产案件立案受理，影响破产程序正常启动。 |
II. As from August 1, 2016, the case filing department of a people's court shall accept any bankruptcy petition materials submitted by a creditor, debtor, or any other statutory party, issue a written acknowledgment, and conduct a formal examination in accordance with the provisions of Article 8 of the Enterprise Bankruptcy Law of the People's Republic of China. If the case filing department deems upon examination that the materials submitted by the petitioner conform to the law, it shall, in accordance with the Types and Code Word Standards for Compulsory Liquidation and Bankruptcy Cases, effective on August 1, 2016, prepare a case number with "bankruptcy petition" as the code word for the case type and register and file a case. In case of non-compliance with the law, the case filing department shall provide an explanation and give written notification of the required supplements and corrections at one time, and the period of supplements and corrections shall not be included in the examination period. If the petitioner makes supplements and corrections as required, a case shall be registered and filed.
．．．．．． | | 二、自2016年8月1日起，对于债权人、债务人等法定主体提出的破产申请材料，人民法院立案部门应一律接收并出具书面凭证，然后根据《中华人民共和国企业破产法》第八条的规定进行形式审查。立案部门经审查认为申请人提交的材料符合法律规定的，应按2016年8月1日起实施的《强制清算与破产案件类型及代字标准》，以“破申”作为案件类型代字编制案号，当场登记立案。不符合法律规定的，应予释明，并以书面形式一次性告知应当补充、补正的材料，补充、补正期间不计入审查期限。申请人按要求补充、补正的，应当登记立案。
