| Article 1 For the purposes of regulating the hearing procedures for anti-dumping and countervailing investigations and guaranteeing the fairness and impartiality of anti-dumping and countervailing investigations, these Rules shall be developed according to the provisions of the Anti-dumping Regulation of the People's Republic of China and the Countervailing Regulation of the People's Republic of China. | | 第一条 为了规范反倾销和反补贴调查听证程序，保障反倾销和反补贴调查的公平、公正，根据《中华人民共和国反倾销条例》和《中华人民共和国反补贴条例》的规定，制定本规则。 |
| Article 2 The holding of hearings by the Ministry of Commerce (hereinafter referred to as the investigation authority) during the investigation procedures for anti-dumping and countervailing cases shall be governed by these Rules. | | 第二条 商务部（以下称调查机关）在反倾销和反补贴案件调查程序中举行听证会，适用本规则。 |
| Article 3 The investigation authority may hold hearings on the basis of the applications, to provide all interested parties with an opportunity of meeting with parties with opposite interests in order to present opposing views and contradictory arguments. | | 第三条 调查机关可以依申请举行听证会，以向所有利害关系方提供与具有相反利益的当事方见面的机会，以便陈述对立的观点和提出反驳的论据。 |
| Where the investigation authority deems necessary, it may decide to hold hearings on its own. | | 调查机关认为有必要时，可以自行决定举行听证会。 |
| Article 4 Interested parties set out in Article 19 of the Anti-dumping Regulation of the People's Republic of China and Article 19 of the Countervailing Regulation of the People's Republic of China, including the governments of the exporting countries (regions) in the countervailing investigations, may apply for hearings. | | 第四条 《中华人民共和国反倾销条例》第十九条和《中华人民共和国反补贴条例》第十九条规定的利害关系方，包括反补贴调查中的出口国（地区）政府，均可申请举行听证会。 |
Article 5 An interested party requiring to hold a hearing before the preliminary ruling shall file a written application with the investigation authority within four months of the date docketing.
