With the approval of the State Council and the Central Military Commission, the Measures for the Administration of Overseas Monuments for Chinese Martyrs, as deliberated and adopted by the Ministry of Veterans Affairs, the Ministry of Foreign Affairs, the Ministry of Finance, and the Political Work Department of the Central Military Commission, are hereby issued and shall come into force on April 1, 2020. 《境外烈士纪念设施保护管理办法》已经退役军人事务部、外交部、财政部、中央军委政治工作部审议通过。经国务院、中央军委同意,现予公布,自2020年4月1日起施行。

Measures for the Administration of Overseas Monuments for Chinese Martyrs 境外烈士纪念设施保护管理办法
Article 1 For purposes of upholding and passing on the spirit of martyrs, strengthening the protection and management of overseas monuments for Chinese martyrs, and highlighting China's good national image, these Measures are developed in accordance with the Law of the People's Republic of China on the Protection of Heroes and Martyrs, the Regulation on Honoring Martyrs and the relevant provisions of the state.   第一条 为了传承和弘扬烈士精神,加强境外烈士纪念设施保护管理,彰显我国良好国家形象,根据《中华人民共和国英雄烈士保护法》、《烈士褒扬条例》和国家有关规定,制定本办法。
Article 2 For the purpose of these Measures, “overseas monuments for Chinese martyrs” means the martyrs cemeteries, memorial halls, monuments or memorial pavilions, memorial towers or temples, memorial statues, columbarium or tombs of martyrs, and other monuments built outside the territory of China to commemorate Chinese martyrs.   第二条 本办法所称境外烈士纪念设施,是指在中华人民共和国境外为纪念中国烈士修建的烈士陵园、纪念堂馆、纪念碑亭、纪念塔祠、纪念塑像、烈士骨灰堂、烈士墓等设施。
Article 3 The Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs shall, in an overall manner, coordinate the protection and management of overseas monuments for Chinese martyrs.   第三条 境外烈士纪念设施保护管理领导小组统筹协调境外烈士纪念设施保护管理工作。
The Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs consist of the Ministry of Retired Military Affairs, the Ministry of Foreign Affairs, the Ministry of Finance, and the Political Work Department of the Central Military Commission. The Ministry of Veterans Affairs shall be responsible for leading the routine affairs of the leading group, and Chinese embassies and consulates stationed abroad shall assist in handling specific relevant work. 境外烈士纪念设施保护管理领导小组由退役军人事务部会同外交部、财政部、中央军委政治工作部等部门组成。退役军人事务部负责领导小组日常事务,驻外使领馆协助处理有关具体工作。
Article 4 In the protection and management of an overseas monument for Chinese martyrs, history shall be respected based on reality, and according to the current status of the monument, the circumstances of the country where the monument is located, and the bilateral relationship between China and that country, the specific matters concerning protection and management of the monument shall be specified in consultation with the relevant government departments of that county by such means as the conclusion of a bilateral cooperation agreement.   第四条 境外烈士纪念设施保护管理应当尊重历史、结合现实,根据纪念设施现状、所在国情况以及双边关系,经与所在国政府有关部门协商,通过签署双边合作协议等方式,明确保护管理具体事项。
Article 5 The protection and management of overseas monuments for Chinese martyrs shall include:   第五条 境外烈士纪念设施保护管理工作包括下列事项:
(1) investigating and verifying monuments for martyrs to search for and collect the remains and relics of martyrs; (一)调查核实烈士纪念设施,查找、收集烈士遗骸、遗物;
(2) repairing, protecting, building and relocating overseas monuments for Chinese martyrs; (二)修缮保护、新建迁建烈士纪念设施;
(3) taking charge of the daily maintenance and management of overseas monuments for Chinese martyrs; (三)负责烈士纪念设施日常维护管理;
(4) collecting, sorting out, compiling, displaying, exhibiting, and preserving the deeds, relics and historical materials of martyrs; (四)搜集、整理、编纂、陈列、展示、保管烈士事迹和遗物史料;
(5) organizing and conducting tomb-sweeping activities and publicity and commemoration activities for martyrs; and (五)组织开展烈士祭扫和宣传纪念活动;
(6) other related matters. (六)其他相关事项。
Article 6 The funds required for the protection and management of overseas monuments for Chinese martyrs shall be arranged by the Central Treasury and included in the departmental budget.   第六条 境外烈士纪念设施保护管理工作所需经费,由中央财政安排,列入部门预算。
Article 7 The Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs shall obtain the basic information on overseas monuments for Chinese martyrs and establish archives for them.   第七条 境外烈士纪念设施保护管理领导小组应当掌握境外烈士纪念设施基本情况并建立档案。
The Ministry of Veterans Affairs and the employer of martyrs or the competent authorities of the employers shall, based on historical clues and materials, investigate and verify overseas monuments for Chinese martyrs to search for and find out the remains of martyrs, and Chinese embassies and consulates stationed abroad shall provide assistance. 退役军人事务部、烈士生前所在工作单位或其主管部门应当根据历史线索和资料,调查核实境外烈士纪念设施,搜寻查找烈士遗骸,驻外使领馆提供协助。
Article 8 Overseas monuments for Chinese martyrs shall generally be repaired and protected locally. Chinese martyrs' tombs scattered abroad may be protected and managed in a centralized manner by relying on existing local monuments for Chinese martyrs.   第八条 境外烈士纪念设施一般就地修缮保护。对于散落在境外的烈士墓,可以依托当地现有境外烈士纪念设施集中保护管理。
Article 9 If any overseas monument for Chinese martyrs indeed needs to be newly constructed because of its historical significance, or if any overseas monument for Chinese martyrs indeed needs to be relocated as required for maintenance or protection or due to the construction plan of the country where it is located and other reasons, it shall be newly constructed or relocated upon approval in accordance with relevant provisions.   第九条 具有重大历史意义、确需新建境外烈士纪念设施的,以及因修缮保护需要或者因所在国建设规划等原因确需迁建境外烈士纪念设施的,应当按照有关规定经批准后实施。
Article 10 The Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs shall delimit the protection scope of an overseas monument for Chinese martyrs in consultation with the relevant government departments of the country where the monument is located, and specify that no entity or individual may encroach upon any land and facility within the protection scope, or unilaterally demolish, change or relocate any monument, or engage in any activity not related to the commemoration of martyrs within the protection scope.   第十条 境外烈士纪念设施保护管理领导小组应当与所在国政府有关部门协商划定境外烈士纪念设施保护范围,明确不得侵占保护范围内的土地和设施,不得单方面拆除、变更、迁移纪念设施,在保护范围内不得从事与纪念烈士无关的活动。
Article 11 The Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs shall determine the management methods for overseas monuments for Chinese martyrs in consultation with the relevant government departments of the countries where the monuments are located, and Chinese embassies and consulates stationed abroad may make recommendations based on the status of the overseas monuments for Chinese martyrs and the circumstances of the countries where the monuments are located.   第十一条哎哟不错哦 境外烈士纪念设施保护管理领导小组与所在国政府有关部门协商确定境外烈士纪念设施管理方式,驻外使领馆可以根据纪念设施现状、所在国情况提出建议。
Where it is determined that an overseas monument for Chinese martyrs is under the charge of the government of the country where it is located, the Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs shall coordinate with the relevant government department of the country to designate a special agency in charge of it. 确定由所在国政府负责管理的,境外烈士纪念设施保护管理领导小组应当协调所在国政府有关部门指定专门机构进行管理。
Where it is determined that an overseas monument for Chinese martyrs is under the charge of the Chinese government, the Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs or the authorized Chinese embassy or consulate stationed abroad shall, by means of signing an authorization agreement, authorize a Chinese-funded enterprise (institution) or an overseas Chinese' friendship association, among others, in the country where the monument is located to manage the monument, or authorize overseas Chinese in that country to manage the monument. 确定由我国政府负责管理的,由境外烈士纪念设施保护管理领导小组或授权驻外使领馆通过签署委托协议的方式,委托中资企业(机构)、所在国华侨华人友好社团等进行管理,也可以委托所在国华侨华人进行管理。
Article 12 All relevant departments and entities shall conduct activities such as collecting and sorting out martyrs' historical materials, compiling martyrs' deeds, and displaying and exhibiting them, publicize the heroic deeds of martyrs, honor the heroic styles of martyrs, and deepen the friendship between China and the countries where overseas monuments for Chinese martyrs are located.   第十二条 各有关部门和单位应当开展烈士史料收集整理、事迹编纂和陈列展示工作,宣传烈士英雄事迹,褒扬英烈风范,加深我国同所在国的友谊。
Martyrs' historical materials and others materials that belong to cultural relics shall be protected in accordance with the provisions of relevant laws and regulations. 烈士史料等属于文物的,依照有关法律法规的规定予以保护。
Article 13 On the occasion of the Martyrs' Day, the Tomb-sweeping Day and other important memorial days, Chinese embassies and consulates stationed abroad shall organize the public commemoration of martyrs in light of the circumstances of the countries where they are located.   第十三条 在烈士纪念日、清明节或者其他重要纪念日期间,驻外使领馆应当结合所在国情况组织烈士公祭活动。
The government of the country where any public commemoration of martyrs is held and Chinese-funded enterprises (institutions), overseas Chinese, and representatives from all sectors of society in that country may be invited to attend the public commemoration of martyrs based on the actual circumstances. 烈士公祭活动可以根据实际情况邀请所在国政府、中资企业(机构)、华侨华人和社会各界代表参加。
Article 14 Chinese embassies or consulates stationed abroad may, based on actual circumstances, provide assistance to the surviving family members of martyrs who conduct tomb-sweeping activities in countries where the corresponding overseas monuments are located, and guide Chinese delegations and tourists visiting those countries and overseas Chinese and Chinese students residing in those countries in paying respects to overseas monuments for Chinese martyrs and conducting tomb-sweeping activities there.   第十四条 驻外使领馆可以结合实际,为赴所在国祭扫的烈士家属提供协助,引导赴所在国参观访问的我国代表团、旅游者及旅居所在国我国侨民、留学生前往境外烈士纪念设施瞻仰祭扫。
The activities in commemoration of martyrs shall be held in a solemn manner and comply with the custom of tomb-sweeping in China and the custom of the countries where overseas monuments for Chinese martyrs are located. 烈士纪念活动应当庄严、肃穆,符合我国祭扫习惯和境外烈士纪念设施所在国习俗。
Article 15 Chinese embassies and consulates stationed abroad shall urge the institutions or persons in charge of overseas monuments for Chinese martyrs to register various tomb-sweeping and commemoration activities held at overseas monuments for Chinese martyrs.   第十五条 驻外使领馆应当敦促境外烈士纪念设施管理机构或者人员对在境外烈士纪念设施举行的各项祭扫纪念活动进行登记。
Article 16 Chinese embassies and consulates stationed abroad shall urge the institutions or persons in charge of overseas monuments for Chinese martyrs to effectively conduct the work on maintenance, security, greening and beautification, and environmental sanitation, among others, within the protection scope of the monuments.   第十六条 驻外使领馆应当敦促境外烈士纪念设施管理机构或者人员做好纪念设施保护范围内的设施维护、安全保卫、绿化美化、环境卫生等工作。
Article 17 Where any entity or individual encroaches upon any land or facility within the protection scope of an overseas monument for Chinese martyrs, or damages or defaces the overseas monument for Chinese martyrs, or conducts any activity not related to the commemoration of martyrs within the protection scope, the Chinese embassy or consulate stationed abroad shall urge the institution or person in charge of the overseas monument for Chinese martyrs to cease such conduct or activity in a timely manner. If the circumstances are serious and any damage is caused, the Chinese embassy or consulate stationed abroad shall make representations to the government of the country where the said monument is located through diplomatic channels and urge it to seriously punish the entity or individual; if any Chinese citizen involved has returned to China, the Chinese embassy or consulate stationed abroad shall urge the relevant departments of that country to transfer relevant materials to the Leading Group for the Protection and Management of Overseas Monuments for Chinese Martyrs, and China's relevant departments shall handle related matters in accordance with the law.   第十七条 侵占境外烈士纪念设施保护范围内土地、设施,破坏、污损境外烈士纪念设施,在保护范围内从事与纪念活动无关的活动的,驻外使领馆应当敦促境外烈士纪念设施管理机构或者人员及时制止。情节严重、造成损害后果的,驻外使领馆应当通过外交途径向所在国政府提出交涉,敦促其严肃处理;涉及已返回境内中国公民的,驻外使领馆应当敦促所在国相关部门将相关材料移交境外烈士纪念设施保护管理领导小组,由有关部门依法处理。
Article 18 The protection and management of China's other overseas monuments for persons who have died while on duty shall be governed mutatis mutandis by these Measures.   第十八条 我国在境外的其他因公牺牲人员纪念设施保护管理工作,参照本办法执行。
Article 19 The protection and management of monuments for martyrs in the Hong Kong Special Administrative Region, the Macao Special Administrative Region and Taiwan Region shall be governed mutatis mutandis by the relevant provisions of the state.   第十九条 香港特别行政区、澳门特别行政区和台湾地区烈士纪念设施的保护管理,参照国家有关规定执行。
Article 20 These Measures shall come into force on April 1, 2020,人丑就要多读书   第二十条 本办法自2020年4月1日起施行。
