Notice of the State Council on Resolutely Curbing the Soaring of Housing Prices in Some Cities 

国务院关于坚决遏制部分城市房价过快上涨的通知

The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; all ministries and commissions of the State Council and all institutions directly under the State Council,
 
各省、自治区、直辖市人民政府,国务院各部委、各直属机构:

Since the issuance of the Notice of the General Office of the State Council on Promoting the Stable and Sound Development of the Real Estate Market (No. 4 [2010] of the General Office of the State Council), some positive changes have occurred in the real estate market throughout the country as a whole. However, there has emerged a momentum of excessive rise in housing and land prices in some cities recently, and speculative purchase of housing has become active again, to which we need pay great attention. To further ensure that all regions and all relevant departments effectively perform their responsibilities, resolutely curb the soaring of housing prices in some cities, and effectively solve the housing problems of urban residents, we hereby notify you of the relevant issues as follows:
 
国务院办公厅关于促进房地产市场平稳健康发展的通知》(国办发〔2010〕4号)印发后,全国房地产市场整体上出现了一些积极变化。但近期部分城市房价、地价又出现过快上涨势头,投机性购房再度活跃,需要引起高度重视。为进一步落实各地区、各有关部门的责任,坚决遏制部分城市房价过快上涨,切实解决城镇居民住房问题,现就有关问题通知如下:

 
I. All regions and all relevant departments shall effectively perform the duties of stabilization of housing prices and housing security   一、各地区、各有关部门要切实履行稳定房价和住房保障职责

 
(1) Unifying thoughts, and enhancing awareness. The housing issue concerns the national economy and the people's livelihood, which is not only an economic issue but also an important issue of people's livelihood affecting social stability. The housing prices has come to an overly high level and risen too fast, which has increased the difficulty for residents to solve the housing problems through market, brought more financial risks, and is not conducive to coordinated economic and social development. All regions and all relevant departments must fully understand the harmfulness of excessive rising in housing prices, seriously implement the real estate market regulation and control policies set by the Central Government, take resolute measures to curb housing prices from rising too fast, and promote the improvement of the people's livelihood and economic development. (一)统一思想,提高认识。住房问题关系国计民生,既是经济问题,更是影响社会稳定的重要民生问题。房价过高、上涨过快,加大了居民通过市场解决住房问题的难度,增加了金融风险,不利于经济社会协调发展。各地区、各有关部门必须充分认识房价过快上涨的危害性,认真落实中央确定的房地产市场调控政策,采取坚决的措施,遏制房价过快上涨,促进民生改善和经济发展。

 
(2) Establishing an assessment and accountability mechanism. A work responsibility system under which the provincial people's governments take overall charge and the urban people's governments are responsible for implementation shall be established for stabilizing housing prices and ensuring housing security. The Ministry of Housing and Urban-Rural Development, the Ministry of Supervision and other departments shall assess the relevant work of the provincial people's governments, strengthen supervision and inspection, and establish a system of interview, inspection and accountability. Those did a bad job in the work of stabilizing housing prices and promoting the construction of indemnificatory housing, and thus affecting the social development and stability shall be held liable. (二)建立考核问责机制。稳定房价和住房保障工作实行省级人民政府负总责、城市人民政府抓落实的工作责任制。住房城乡建设部、监察部等部门要对省级人民政府的相关工作进行考核,加强监督检查,建立约谈、巡查和问责制度。对稳定房价、推进保障性住房建设工作不力,影响社会发展和稳定的,要追究责任。

 
II. Resolutely curbing irrational demands for housing   二、坚决抑制不合理住房需求

 
(3) Implementing more strict differentiated housing credit policies. For families (including the borrower, the spouse and minor children, the same below) purchasing the first housing units for the owner's own use with a construction floor area of 90 sq.m. or more, the down payment of loan shall not be less than 30% of the total price; for families who purchase a second unit with mortgage, the down payment of loan shall not be less than 50%, and the mortgage rate shall not be less than 1.1 times of the benchmark rate; for families who purchase the third and ensuing housing unit with loans, the down payment ratio of loans and the loan rate shall be substantially increased, and the specific rates shall be determined independently by commercial banks according to the principle of risk management. The People's Bank of China and China Banking Regulatory Commission shall direct and supervise commercial banks to strictly manage the housing consumption loans. The Ministry of Housing and Urban-Rural Development shall step on formulating the standards for identification of the second housing units jointly with the People's Bank of China and China Banking Regulatory Commission. (三)实行更为严格的差别化住房信贷政策。对购买首套自住房且套型建筑面积在90平方米以上的家庭(包括借款人、配偶及未成年子女,下同),贷款首付款比例不得低于30%;对贷款购买第二套住房的家庭,贷款首付款比例不得低于50%,贷款利率不得低于基准利率的1.1倍;对贷款购买第三套及以上住房的,贷款首付款比例和贷款利率应大幅度提高,具体由商业银行根据风险管理原则自主确定。人民银行、银监会要指导和监督商业银行严格住房消费贷款管理。住房城乡建设部要会同人民银行、银监会抓紧制定第二套住房的认定标准。

Strictly restricting the various ways of speculation in housing and speculative purchase of housing units. In areas where the prices of commercial housing have risen to an overly high level or too fast, or the housing is in short supply, commercial banks may suspend the granting of housing loans for the third and ensuing housing units according to the risk status; commercial banks may also suspend the granting of housing loans to non-residents who can not provide local tax payment proof or proof of social insurance payment for a period of one year or longer. According to local conditions, local people's governments may adopt temporary measures to limit the number of housing units to be purchased within a certain period.

要严格限制各种名目的炒房和投机性购房。商品住房价格过高、上涨过快、供应紧张的地区,商业银行可根据风险状况,暂停发放购买第三套及以上住房贷款;对不能提供1年以上当地纳税证明或社会保险缴纳证明的非本地居民暂停发放购买住房贷款。地方人民政府可根据实际情况,采取临时性措施,在一定时期内限定购房套数。
