| Since the year 2000, after the investigation and supervision departments of all provincial procuratorial organs applied the provisions of Article 124 of the Criminal Procedure Law, there has been a significant increase in the number of applications to the Supreme People's Procuratorate for approval of the extension of the custody period for criminal investigation. Although the overall situation of case handling is good in all localities, there are some problems such as late application for approval of extension of the custody period for criminal investigation and some of the materials are not submitted in proper form. In order to strictly implement the Criminal Procedure Law and Criminal Procedure Rules for People's Procuratorates, regulate the handling of the cases of application for approval of the extension of the custody period for criminal investigation, strengthen supervision over criminal investigation and supervision after arrest, the following opinions are hereby put forward and issued to all localities for your strict compliance and implementation. | | 2000年以来，各省级检察机关侦查监督部门适用《刑事诉讼法》第一百二十四条的规定，提请高检院批准延长侦查羁押期限案件大量增加。各地办案总体情况是好的，但也存在一些超期提请批准延长侦查羁押期限、报送材料不规范等问题。为了严格执行《刑事诉讼法》、《人民检察院刑事诉讼规则》，规范提请批准延长侦查羁押期限案件的办理，强化侦查监督、捕后监督，现提出以下意见下发各地，请严格遵照执行。 |
| I. In handling the applications to the Supreme People's Procuratorate for approval of the extension of the custody period for criminal investigation, all relevant authorities shall effectively attach great attention to thoughts, conduct serious review and strict control, and in consideration of the spirit of the first investigation supervision meeting of the procuratorial organs throughout the country on strengthening supervision after arrest, take the handling of such cases as an important task of this year for effectively conducting supervision after arrest. The connection and cooperation of the investigation organs and the procuratorates' self-investigation departments shall be strengthened, and the investigation and supervision functions shall be fully performed. The applications that do not meet the conditions for extending the custody period for criminal investigation shall not be submitted, while investigation organs or self-investigation departments shall diligently provide the materials about the cases of application for approval of the extension of the custody period for criminal investigation in a timely manner. | | 一、办理提请高检院批准延长侦查羁押期限案件，应当切实在思想上高度重视；认真审查，严格把关；结合全国检察机关第一次侦查监督会议关于加强捕后监督工作的精神，把办理提请批准延长侦查羁押期限案件作为切实落实捕后监督的一项重要工作来抓。既要加强与侦查机关和检察院自侦部门的联系和配合，丈要充分履行侦查监督职能，对不符合延长侦查羁押期限条件的不得报请，同时要督促侦查机关或自侦部门认真、及时提供提请批准延长侦查羁押期限所需的案件材料。 |

For a application to the Supreme People's Procuratorate for approval of extending the custody period for criminal investigation, it shall be handled in strict accordance with the relevant provisions of Criminal Procedure Law and Criminal Procedure Rules for People's Procuratorates, so as to eliminate the phenomenon of late application for approval.
