| Article 1 To maintain state sovereignty and interests, promote the opening up of China, and strengthen the supervision and administration of transit goods by the Customs, these Measures are developed in accordance with the Customs Law of the People's Republic of China . | | 第一条 为维护国家的主权和利益，促进我国对外开放，加强海关对过境货物的监督管理，根据《中华人民共和国海关法》，特制定本办法。 |
| Article 2 For the purposes of these Measures, “transit goods” means goods loaded outside China and continuing to be transported to a place outside China by passing through China by land. | | 第二条 本办法所称“过境货物”系指由境外启运，通过中国境内陆路继续运往境外的货物。 |
| “Operator” means an enterprise which has the right to operate the international freight forwarding agent business and whose business scope includes the transit goods forwarding agent business (international multimodal transportation) as approved or recognized by the economic and trade administrative department of the state. | | “经营人”指经国家经贸主管部门批准、认可具有国际货物运输代理业务经营权并拥有过境货物运输代理业务经营范围（国际多式联运）的企业。 |
| “Carrier” means an enterprise which engages in the transit goods transportation business as approved by the transport administrative department of the state. | | “承运人”指经国家运输主管部门批准从事过境货物运输业务的企业。 |
| Article 3 Transit goods from countries which have entered into agreements on transit goods with China or transit goods shipped from or to countries which have entered into agreements on international railroad through transport with China shall be allowed to pass through China according to the provisions of the relevant agreements; and transit goods of countries which have not entered into the aforesaid agreements with China shall be allowed to pass through China upon approval from the economic and trade and the transport administrative departments of the state and recordation with the customs office at the place of entry. | | 第三条 对同我国签有过境货物协定的国家的过境货物，或属于同我国签有铁路联运协定国家收、发货的，按有关协定准予过境；对于同我国未签有上述协定国家的过境货物，应当经国家经贸、运输主管部门批准并向入境地海关备案后准予过境。 |
| Article 4 Throughout the period from the time of entry into China to the time of departure from China, transit goods shall be subject to customs supervision as goods under customs supervision. Without the permission of the Customs, no entities or individuals may open, collect, deliver, forward, replace, refit, mortgage, transfer, or change the markers of transit goods. | | 第四条 过境货物自进境起到出境止属海关监管货物，应当接受海关监管。未经海关许可，任何单位和个人不得开拆、提取、交付、发运、调换、改装、抵押、转让，或者更换标记。 |
| Article 5 The means of transport for carrying transit goods shall meet the sealing conditions and have devices recognized by the Customs. The Customs may, as deeming it necessary, seal the transit goods and loaders. The transport administrative departments and operators shall protect the intactness of the seals affixed by the Customs, and no one may open or break the seals without permission. | | 第五条 装载过境货物的运输工具，应当具有海关认可的加封条件和装置。海关认为必要时，可以对过境货物及其装载装置加封。运输部门和经营人，应当负责保护海关封志的完整，任何人不得擅自开启或损毁。 |
| Article 6 An operator shall, upon the strength of the approval document of the competent department, apply to the Customs for undergoing the customs declaration registration formalities, and may not be responsible for handling the matters concerning customs declaration until it is approved by the Customs. | | 第六条 经营人应当凭主管部门的批准文件，向海关申请办理报关注册登记手续。经海关核准后，才能负责办理报关事宜。 |
| Article 7 The following goods shall be prohibited from passing through China: | | 第七条 下列货物禁止过境： |
(1) Goods shipped from or to countries or regions with which China has ceased or prohibited trade.
