| These Guiding Opinions are developed in accordance with the Decision of the Standing Committee of the National People's Congress on Issues concerning the Administration of Forensic Identification and Evaluation and the relevant laws and regulations for the purposes of regulating and guiding the testifying in court of forensic experts registered and administered by the judicial administrative organs, and ensuring smoothness of legal proceedings. | | 为了规范和指导司法行政机关登记管理的司法鉴定人出庭作证活动，保障诉讼活动的顺利进行，根据《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》和有关法律、法规的规定，制定本指导意见。 |
| I. For the purpose of these Guiding Opinions, “testifying of forensic experts in court” means the activities of forensic experts who are registered upon examination of the judicial administrative organs and have received practicing licenses for forensic expertise to, upon a legal notice by a people's court, interpret and explain their expert opinions in court in terms of identification basis, identification steps, identification methods and reliability of opinions, and answer inquiries and questions raised in court. | | 一、本指导意见所称的司法鉴定人出庭作证是指经司法行政机关审核登记，取得《司法鉴定人执业证》的司法鉴定人经人民法院依法通知，在法庭上对自己作出的鉴定意见，从鉴定依据、鉴定步骤、鉴定方法、可靠程度等方面进行解释和说明，并在法庭上当面回答质询和提问的行为。 |
| II. Where a people's court has appointed a forensic expert to testify in court on its legal notice, the appointed forensic expert shall appear in court to offer testimony; and where no forensic expert is appointed, a forensic identification body shall appoint one or more experts signing on the relevant forensic identification report to testify in court in that capacity. | | 二、人民法院出庭通知已指定出庭作证鉴定人的，要由被指定的鉴定人出庭作证；未指定出庭作证的鉴定人时，由鉴定机构指定一名或多名在司法鉴定意见书上签名的鉴定人出庭作证。 |
| The forensic identification body shall provide necessary conditions for the forensic expert to appear in court. | | 司法鉴定机构要为鉴定人出庭提供必要条件。 |
| III. After a people's court notifies a forensic expert of testifying in court, the forensic expert may submit a written application to the people's court for not appearing in court under any of the following circumstances: | | 三、人民法院通知鉴定人到庭作证后，有下列情形之一的，鉴定人可以向人民法院提出不到庭书面申请： |
| 1. The forensic expert is not notified within the statutory time limit. | | （一）未按照法定时限通知到庭的； |
| 2. The forensic expert is unable to appear in court due to a health problem. | | （二）因健康原因不能到庭的； |
| 3. The forensic expert is unable to appear in court for remote residence and travel difficulty. | | （三）路途特别遥远，交通不便难以到庭的； |
| 4. The forensic expert is unable to appear in court for a force majeure such as a natural disaster. | | （四）因自然灾害等不可抗力不能到庭的； |
| 5. The forensic expert is unable to appear in court for any other justifiable reason. | | （五）有其他正当理由不能到庭的。 |
| With the consent of the people's court, the absent forensic expert may submit a written response or explanation, or use video transmission technology or other technical means to offer testimony. | | 经人民法院同意，未到庭的鉴定人可以提交书面答复或者说明，或者使用视频传输等技术作证。 |
