| The Notice of the Ministry of Commerce on Issues concerning Cross-Border Direct Investment in RMB (Letter No. 889 [2011], Ministry of Commerce, hereinafter referred to as the “Notice”) came into force on October 12, 2011. In order to effectively conduct the work on the cross-border direct investment in China in RMB, the Ministry of Commerce has upgraded the foreign investment approval management system by adding the relevant entry and review functions and the operating instructions thereof. You are hereby notified of the following issues, such as the submission and review process for the Statement on Cross-Border Direct Investment in RMB (hereinafter referred to as the “Statement”), notes added to approval certificates, and statistics of cross-border direct investment in RMB: | | 《商务部关于跨境人民币直接投资有关问题的通知》（商资函〔2011〕889号，以下简称《通知》）已于2011年10月12日起实施。为做好跨境人民币直接投资工作，我部已对外商投资审批管理系统进行了升级，增加了相关录入和审核功能，并编制了操作说明。现就《跨境人民币直接投资情况表》（以下简称《情况表》）报送审核流程、批准证书加注、跨境人民币直接投资数据统计等问题通知如下： |
| I. The submission and review process for the Statement on Cross-Border Direct Investment in RMB | | 一、关于《跨境人民币直接投资情况表》报送审核流程 |
| 1. Under any of the four circumstances as prescribed in Article 6 of the Notice, a local commerce department shall submit the Statement to the Ministry of Commerce for review. The specific process is as follows: | | （一）属于《通知》第六条规定的4种清醒的，地方商务主管部门应将《情况表》报商务部审核。具体流程是： |
(1) The local commerce department enters the Statement by using the “issuance →cross-border direct investment in RMB” function in the foreign investment approval management system. Under any of the four circumstances as prescribed in Article 6 of the Notice, the reviewing department will be automatically set as the Ministry of Commerce.
