The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Financial consumers are both important participants in the financial markets and promoters for the sustainable and sound development of the financial industry. Strengthening the protection of financial consumers' rights and interests, as an important content for preventing and resolving financial risks, has a positive meaning for increasing the confidence of financial consumers, maintaining financial security and stability, and promoting social justice and social harmony. As the reform and development of the financial market is constantly deepened, financial products and services become increasingly abundant. Despite the convenience brought about by financial products and services to financial consumers, there are such problems as illegal provision of financial products and services, frequent occurrence of financial consumer disputes, weak rights and interests protection awareness of financial consumers, and to-be-improved capacity to identify risks. For the purpose of regulating and guiding financial institutions' provision of financial products and services, building a fair and equitable market environment, and strengthening the protection of financial consumers' rights and interests, upon the consent of the State Council, these opinions are hereby offered as follows: 金融消费者是金融市场的重要参与者,也是金融业持续健康发展的推动者。加强金融消费者权益保护工作,是防范和化解金融风险的重要内容,对提升金融消费者信心、维护金融安全与稳定、促进社会公平正义和社会和谐具有积极意义。随着我国金融市场改革发展不断深化,金融产品与服务日趋丰富,在为金融消费者带来便利的同时,也存在提供金融产品与服务的行为不规范,金融消费纠纷频发,金融消费者权益保护意识不强、识别风险能力亟待提高等问题。为规范和引导金融机构提供金融产品和服务的行为,构建公平、公正的市场环境,加强金融消费者权益保护工作,经国务院同意,现提出如下意见:
I. Guiding Thought   一、指导思想
Under the guidance of the spirit of the 18th National Congress of the Communist Party of China (CPC), and the Third, Fourth and Fifth Plenary Sessions of the 18th CPC Central Committee and under the principles of marketization and legalization, the decisions and deployments of the CPC Central Committee and the State Council shall be diligently implemented, the combination of prudent supervision and behavior supervision shall be adhered to, the supervision mechanism and guarantee mechanism for the protection of financial consumers' rights and interests shall be established and improved, the behaviors of financial institutions shall be regulated, a market environment featuring fair competition and integrity shall be created, the financial consumers' lawful rights and interests shall be effectively protected, and the financial risks shall be prevented and eliminated, to promote the sustainable and sound development of the financial industry. 以党的十八大和十八届三中、四中、五中全会精神为指导,认真落实党中央、国务院决策部署,坚持市场化和法治化原则,坚持审慎监管与行为监管相结合,建立健全金融消费者权益保护监管机制和保障机制,规范金融机构行为,培育公平竞争和诚信的市场环境,切实保护金融消费者合法权益,防范和化解金融风险,促进金融业持续健康发展。
II. Work Requirements   二、工作要求
1. The People's Bank of China, the China Banking Regulatory Commission, the China Securities Regulatory Commission, and the China Insurance Regulatory Commission (hereinafter collectively referred to as “financial management departments”) shall, according to the division of responsibilities, act in close cooperation and effectively protect the financial consumers' rights and interests. Financial management departments and local people's governments shall strengthen cooperation, and explore and establish coordination mechanisms under the Central Government and the local people's governments for the protection of financial consumers' rights and interests. (一)人民银行、银监会、证监会、保监会(以下统称金融管理部门)要按照职责分工,密切配合,切实做好金融消费者权益保护工作。金融管理部门和地方人民政府要加强合作,探索建立中央和地方人民政府金融消费者权益保护协调机制。
2. Banking institutions, securities institutions, insurance institutions and other institutions that are engaged in finance or provide services concerning finance (hereinafter collectively referred to as “financial institutions”) shall, under the principles of equality, free will, and good faith, fully respect and consciously protect financial consumers' right of property safety, right of information, right of choice, right of fair trade, right of claim according to the law, right to education, right to be respected, and right of information safety, among others, and carry out business activities by law. (二)银行业机构、证券业机构、保险业机构以及其他从事金融或与金融相关业务的机构(以下统称金融机构)应当遵循平等自愿、诚实守信等原则,充分尊重并自觉保障金融消费者的财产安全权、知情权、自主选择权、公平交易权、依法求偿权、受教育权、受尊重权、信息安全权等基本权利,依法、合规开展经营活动。
3. Relevant social organizations in the financial field shall maximize their own advantages, actively participate in the protection of the rights and interests of financial consumers, assist in financial consumers' lawful protection of rights, promote the popularization of financial knowledge, and play an important role in the protection of financial consumers' rights and interests. (三)金融领域相关社会组织应当发挥自身优势,积极参与金融消费者权益保护工作,协助金融消费者依法维权,推动金融知识普及,在金融消费者权益保护中发挥重要作用。
III. Regulating the acts of financial institutions   三、规范金融机构行为
1. Improving the mechanism for the protection of financial consumers' rights and interests. Financial institutions shall incorporate the protection of financial consumers' lawful rights and interests into the overall planning for corporate governance, enterprise cultural construction, and business development strategies, implementation staffing and appropriation budget, and improve the working mechanism for the protection of financial consumers' rights and interests. (一)健全金融消费者权益保护机制。金融机构应当将保护金融消费者合法权益纳入公司治理、企业文化建设和经营发展战略中统筹规划,落实人员配备和经费预算,完善金融消费者权益保护工作机制。
2. Establishing financial consumer suitability management rules. Financial institutions shall assess the risks and complexity of specialty of financial products and services and implement hierarchical dynamic management, improve the evaluation system for risk preference, risk perception, and risk tolerance of financial consumers, and provide appropriate financial products and services to appropriate financial consumers. (二)建立金融消费者适当性制度。金融机构应当对金融产品和服务的风险及专业复杂程度进行评估并实施分级动态管理,完善金融消费者风险偏好、风险认知和风险承受能力测评制度,将合适的金融产品和服务提供给适当的金融消费者。
