| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of regulating the use of civil unmanned aerial vehicles (“UAV”) to carry out operational flight activities, strengthening market supervision, and promoting the safe, orderly and sound development of the UAV industry, these Measures are developed in accordance with the Civil Aviation Law and the relevant provisions on the administration of UAV. | | 第一条 为了规范使用民用无人驾驶航空器（以下简称"无人驾驶航空器"）从事经营性飞行活动，加强市场监管，促进无人驾驶航空器产业安全、有序、健康发展，依据《民航法》及无人驾驶航空器管理的有关规定，制定本办法。 |
| Article 2 These measures shall be applied to aerial spraying (sprinkling), aerophotography, aerial photography, show flights and other operational and UAV pilots training activities carried out within the territory of the People's Republic of China (excluding Hong Kong, Macao and Taiwan) with UAVs of maximum empty weight of 250 grams or more. These measures shall not be applied to the passenger- and cargo-carrying operational flight activities carried out with UAVs. | | 第二条 本办法适用于在中华人民共和国境内（港澳台地区除外）使用最大空机重量为250克以上（含250克）的无人驾驶航空器开展航空喷洒（撒）、航空摄影、空中拍照、表演飞行等作业类和无人机驾驶员培训类的经营活动。无人驾驶航空器开展载客类和载货类经营性飞行活动不适用本办法。 |
| Article 3 An operation permit shall be obtained for carrying out the operational flight activities set out in Article 2 of these Measures with UAVs, and no operational flight activities shall be carried out without an operation permit. | | 第三条 使用无人驾驶航空器开展本办法第二条所列的经营性飞行活动应当取得经营许可证，未取得经营许可证的，不得开展经营性飞行活动。 |
| Article 4 The Civil Aviation Administration of China (“CAAC”) shall implement unified supervision and administration of the operation permits of UAVs. The CAAC regional administrations shall be responsible for the issuance, supervision and administration of operation permits of UAVs within their jurisdictions. | | 第四条 中国民用航空局（以下简称民航局）对无人驾驶航空器经营许可证实施统一监督管理。中国民用航空地区管理局（以下简称民航地区管理局）负责实施辖区内的无人驾驶航空器经营许可证颁发及监管管理工作。 |
| Chapter II Conditions and Procedures for the Application for Permits | | 第二章 许可证申请条件及程序 |
| Article 5 An applicant for an operation permit of UAVs shall meet the following basic conditions: | | 第五条 取得无人驾驶航空器经营许可证，应当具备下列基本条件： |
| (1) The entity engaging in business activities shall be an enterprise legal person, and the legal representative shall be a Chinese citizen. | | （一）从事经营活动的主体应当为企业法人，法定代表人为中国籍公民； |
| (2) The enterprise shall have one UAV at a minimum, and undergo the formalities of real name registration in the “real-name registration information system of the CAAC for civil UAVs.” | | （二）企业应至少拥有一架无人驾驶航空器，且以该企业名称在中国民用航空局"民用无人驾驶航空器实名登记信息系统"中完成实名登记； |
| (3) The enterprise has the training ability recognized by the competent department of the industry or an institution authorized thereby (this paragraph shall only be applied to training activities). | | （三）具有行业主管部门或经其授权机构认可的培训能力（此款仅适用从事培训类经营活动）； |
| (4) It has purchased third-party ground liability insurance for UAVs. | | （四）投保无人驾驶航空器地面第三人责任险。 |
| Article 6 Under one of the following circumstances, no application for an operation permit of UAVs shall be accepted: | | 第六条 具有下列情形之一的，不予受理无人驾驶航空器经营许可证申请： |
| (1) An applicant re-files an application within one year, after the application is rejected for provision of false materials. | | （一）申请人提供虚假材料被驳回，一年内再次申请的； |
| (2) An applicant re-files an application within three year, after the operation permit obtained by such improper means as fraud and bribery is revoked. | | （二）申请人以欺骗、贿赂等不正当手段取得经营许可证后被撤销，三年内再次申请的； |
(3) An enterprise is included in the “blacklist” of credit management in the civil aviation industry due to seriously dishonest acts.
