| Decision of the Ministry of Transport on Amending the Provisions on the Administration of Motor Vehicle Maintenance | | 交通运输部关于修改《机动车维修管理规定》的决定 |
| As decided by the Ministry of Transport, the Provisions on the Administration of Motor Vehicle Maintenance (Order No. 37 [2016], Ministry of Transport) are amended as follows: | | 交通运输部决定对《机动车维修管理规定》（交通运输部令2016年第37号）作如下修改： |
| I. The heading of Chapter II“Business License” is replaced with “Business Recordation”. | | 一、第二章名称“经营许可”修改为“经营备案”。 |
| II. One article is added as Article 7: “Whoever engages in the business operation of motor vehicle maintenance shall, after completing the registration formalities at the market regulatory authority according to the law, undergo recordation formalities with the county-level road transport administrative department of the place where it is located. | | 二、增加一条，作为第七条：“从事机动车维修经营业务的，应当在依法向市场监督管理机构办理有关登记手续后，向所在地县级道路运输管理机构进行备案。 |
| The road transport administrative department shall handle the recordation of the business operations of motor vehicle maintenance in accordance with the Regulation of the People's Republic of China on Road Transport and these Provisions. The road transport administrative department shall not charge the business operators of motor vehicle maintenance for recordation.” | | 道路运输管理机构应当按照《中华人民共和国道路运输条例》和本规定实施机动车维修经营备案。道路运输管理机构不得向机动车维修经营者收取备案相关费用。” |
| III. Article 7 is renumbered as Article 8, and paragraph 1 thereof is amended to read: “The business operations of motor vehicle maintenance shall be subject to recordation by categories based on the vehicle models, service abilities and business items.” | | 三、将第七条改为第八条，第一款修改为：“机动车维修经营依据维修车型种类、服务能力和经营项目实行分类备案。” |
| IV. Article 8 is renumbered as Article 9 and amended to read: “Category I and II business operations of automobile maintenance or Category I and II business operations of maintenance of other motor vehicles may include whole-vehicle repair, assembly repair, whole-vehicle maintenance, current repair, maintenance assistance, special repair, and maintenance completion inspection of corresponding vehicle models; Category III business operations of automobile maintenance (including vehicle comprehensive current repair) and Category III business operations of maintenance of other motor vehicles may include vehicle comprehensive current repair, or vehicle maintenance and repair of special items such as maintenance of engines, maintenance of vehicle bodies, electric systems and automatic transmissions, tire dynamic balance and repair, four-wheel alignment inspection and adjustment, automobile lubrication and maintenance, maintenance of fuel injection pump and injector, crankshaft machining, cylinder canal-jet machining, radiator maintenance, repair of air-conditioners, automobile beauty and decoration, as well as installation and repair of auto glass. The specific business items shall be governed by the provisions of the relevant articles of the Certification Requirements for Motor Vehicle Maintenance and Repair Enterprise (GB/T 16739).” | | 四、将第八条改为第九条，修改为：“一类、二类汽车维修经营业务或者其他机动车维修经营业务，可以从事相应车型的整车修理、总成修理、整车维护、小修、维修救援、专项修理和维修竣工检验工作；三类汽车维修经营业务（含汽车综合小修）、三类其他机动车维修经营业务，可以分别从事汽车综合小修或者发动机维修、车身维修、电气系统维修、自动变速器维修、轮胎动平衡及修补、四轮定位检测调整、汽车润滑与养护、喷油泵和喷油器维修、曲轴修磨、气缸镗磨、散热器维修、空调维修、汽车美容装潢、汽车玻璃安装及修复等汽车专项维修工作。具体有关经营项目按照《汽车维修业开业条件》（GB/T 16739）相关条款的规定执行。” |
| V. Article 9 is renumbered as Article 10 and amended to read: “Category I business operations of motorcycle maintenance may include such services as whole-vehicle repair, assembly repair, whole-vehicle maintenance, current repair, special repair and maintenance completion inspection of motorcycles; Category II business operations of motorcycle maintenance may include maintenance, current repair and special repair of motorcycles.” | | 五、将第九条改为第十条，修改为：“一类摩托车维修经营业务，可以从事摩托车整车修理、总成修理、整车维护、小修、专项修理和竣工检验工作；二类摩托车维修经营业务，可以从事摩托车维护、小修和专项修理工作。” |
| VI. Article 10 is renumbered as Article 11 and amended to read: “The business operations of the maintenance of vehicles that transport dangerous goods may also include Category I business operations of automobile maintenance.” | | 六、将第十条改为第十一条，修改为：“危险货物运输车辆维修经营业务，除可以从事危险货物运输车辆维修经营业务外，还可以从事一类汽车维修经营业务。” |
| VII. Article 11 is renumbered as Article 12, Article 13 is renumbered as Article 14, and “apply for” therein is deleted. | | 七、将第十一条改为第十二条，第十三条改为第十四条，删去其中的“申请”。 |
| VIII. Article 12 is renumbered as Article 13 and “besides meeting the requirements for business start-up of Category I business operations of automobile maintenance” therein is replaced with “besides meeting the requirements for Category I business operations of automobile maintenance”. | | 八、将第十二条改为第十三条，将其中的“除具备汽车维修经营一类维修经营业务的开业条件外”修改为“除具备汽车维修经营一类维修经营业务的条件外”。 |
| IX. Article 14 is renumbered as Article 15 and amended to read: “Whoever engages in the business operations of motor vehicle maintenance shall undergo recordation formalities with the county-level road transport administrative department of the place where it is located, submit the Recordation Form for the Business Operation of Motor Vehicle Maintenance (see Annex 1), provide the following materials that meet the requirements prescribed in Articles 12 through 14 of these Provisions, and ensure that the materials are truthful and complete: | | 九、将第十四条改为第十五条，修改为：“从事机动车维修经营的，应当向所在地的县级道路运输管理机构进行备案，提交《机动车维修经营备案表》（见附件1），并附送符合本规定第十二条、第十三条、第十四条规定条件的下列材料，保证材料真实完整： |
| 1. A photocopy of the business license of the business operator of maintenance. | | （一）维修经营者的营业执照复印件； |
2. Materials on the areas of the business site (including workshop and business reception room) and the parking lot, the land use right and property right certificates, and other relevant materials.
