| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 These Provisions are formulated for the purpose of strengthening the administration of old transport vessels, optimizing the waterborne transport structure, enhancing the technical level of vessels, safeguarding the waterborne transport safety, and promoting the sound development of the waterborne transport undertaking. | | 第一条 为加强老旧运输船舶管理，优化水路运力结构，提高船舶技术水平，保障水路运输安全，促进水路运输事业健康发展，制定本规定。 |

|
| Article 2 These Provisions shall be applicable to sea vessels and river vessels that have the nationality of the People's Republic of China and are used for the waterborne transport. | | 第二条 本规定适用于拥有中华人民共和国国籍，从事水路运输的海船和河船。 |
| |
|
| Article 3 The following terms shall mean as follows when they are used in these Provisions: | | 第三条 本规定中下列用语的含义是： |
| |
|
| (1)The “age of a vessel” refers to the number of years of a vessel from the date of completion of its construction up to the present; | | （一）船龄，是指船舶自建造完工之日起至现今的年限； |
| |
|
| (2)The “age of a vessel of foreign nationality as purchased or chartered by demise” refers to the number of years from the date of completion of its construction to the date when the competent commercial administrative department under the State Council or the department or organ it authorizes issues a License for Import of Mechanical and Electrical Products or an Automatic Import License; | | （二）购置、光租外国籍船船龄，是指船舶自建造完工之日起至国务院商务主管部门或其授权的部门和机构签发的《机电产品进口许可证》或《自动进口许可证》签发之日的年限； |

|
| (3)The “old transport vessel” refers to a transport vessel whose age has reached the minimum age as prescribed in Article 4 or 5 of these Provisions; | | （三）老旧运输船舶，是指船龄在本规定第四条、第五条规定的最低船龄以上的运输船舶； |
| |
|
| (4)The “discarded vessel” refers to a vessel that is discarded forever and can not be used for the waterborne transport any more; | | （四）报废船舶，是指永久不能从事水路运输的船舶； |
| |
|
| (5)The “discarded steel vessel” refers to a steel vessel that is discarded forever and can not be used for the waterborne transport any more; and | | （五）废钢船，是指永久不能从事水路运输的钢质船舶； |
| |
|
| (6)The term “single-hull oil tanker” means an oil tanker (including oil barge) that does not have double bottom tanks and double side tanks in compliance with the domestic vessel inspection specifications. | | （六）单壳油船，是指未设有符合国内船舶检验规范规定的双层底舱和双层边舱的油船（含油驳）。 |

|
| Article 4 Old sea vessels can be divided into the following types: | | 第四条 老旧海船分为以下类型： |
| |
|
| (1)High-speed passenger vessels with the age of ten years or more are the first class of old sea vessels; | | （一）船龄在10年以上的高速客船，为一类老旧海船； |
| |
|
| (2)Wheel-driven passenger vessels, passenger cargo vessels, passenger ferries, and passenger cargo ferries (including passenger train ferries), tourist vessels and passenger vessels with the age of ten years or more are the second class of old sea vessels; | | （二）船龄在10年以上的客滚船、客货船、客渡船、客货渡船（包括旅客列车轮渡）、旅游船、客船，为二类老旧海船； |
| |
|
| (3)Oil tankers (including asphalt vessels), bulk chemicals vessels and liquefied gas vessels with the age of twelve years or more are the third class of old sea vessels; | | （三）船龄在12年以上的油船（包括沥青船）、散装化学品船、液化气船，为三类老旧海船； |
| |
|
| (4)Bulk vessels and ore vessels with the age of eighteen years or more are the fourth class of old sea vessels; and | | （四）船龄在18年以上的散货船、矿砂船，为四类老旧海船； |
| |
|
| (5)Rolling cargo vessels, bulk cement vessels, refrigeration vessels, groceries vessels, multi-purpose vessels, container vessels, wood vessels, tug boats, push vessels and barge vessels with the age of twenty years or more are the fifth class of old sea vessels. | | （五）船龄在20年以上的货滚船、散装水泥船、冷藏船、杂货船、多用途船、集装箱船、木材船、拖轮、推轮、驳船等，为五类老旧海船。 |

|
| Article 5 Old river vessels can be classified into the following types: | | 第五条 老旧河船分为以下类型： |
| |
|
| (1)High-speed passenger vessels with the age of 10 years or more are the first class of old river vessels; | | （一）船龄在10年以上的高速客船，为一类老旧河船； |
| |
|
| (2)Wheel-driven passenger vessels, passenger cargo vessels, passenger ferries, and passenger cargo ferries (including passenger train ferries), tourist vessels and passenger vessels with the age of 10 years or more are the second class of old river vessels; | | （二）船龄在10年以上的客滚船、客货船、客渡船、客货渡船（包括旅客列车轮渡）、旅游船、客船，为二类老旧河船； |
| |
|
| (3)Oil tankers (including asphalt boats), bulk chemicals vessels and liquefied gas vessels with the age of 16 years or more are the third class of old river vessels; | | （三）船龄在16年以上的油船（包括沥青船）、散装化学品船、液化气船，为三类老旧河船； |
| |
|
| (4)Bulk vessels and ore vessels with the age of 18 years or more are the fourth class of old river vessels; and | | （四）船龄在18年以上的散货船、矿砂船，为四类老旧河船； |
| |
|
| (5)Rolling cargo vessels, bulk cement vessels, refrigeration vessels, groceries vessels, multi-purpose vessels, container vessels, wood vessels, tug boats, push vessels and barge vessels with the age of 20 years or more are the fifth class of old river vessels. | | （五）船龄在20年以上的货滚船、散装水泥船、冷藏船、杂货船、多用途船、集装箱船、木材船、拖轮、推轮、驳船（包括油驳）等，为五类老旧河船。 |
| |
|
| Article 6 The State shall implement a classified technical supervisory and administrative system for old transport vessels, and implement a system of mandatory discarding to the transport vessels that have reached the age for mandatory discarding. | | 第六条 国家对老旧运输船舶实行分类技术监督管理制度，对已达到强制报废船龄的运输船舶实施强制报废制度。 |

| Article 7 The competent communications administrative department of the local people's government at or above the county level can, according to these Provisions and other relevant provisions, administrate the market access and operation of old transport vessels, and can entrust the vessel administrative organs it has established to take charge of the specific administration of old transport vessels. | | 第七条 县级以上人民政府交通运输主管部门根据本规定和其他有关规定对老旧运输船舶的市场准入和营运进行管理，并可委托其设置的航运管理机构负责老旧运输船舶管理的具体工作。 |
The maritime affairs administrative department shall implement the safety supervision and administration of old transport vessels according to the relevant laws, administrative regulations and these Provisions. | |
海事管理机构根据有关法律、行政法规和本规定对老旧运输船舶实施安全监督管理。 |

| Chapter II Management on the Purchase, Bareboat Charter and Rebuilding of Vessels | | 第二章 船舶购置、光租、改建管理 |
| |
|
| Article 8 Where any vessels of foreign nationality are purchased or chartered under the conditions of bareboat charter for engaging in waterborne transport, they shall meet the requirements regarding the age of the vessels of foreign nationality purchased or chartered by demise as prescribed in the Annexes of these Provisions, and the hulls, main electromechanical equipment and safety and pollution prevention equipment of the vessels shall meet the technical rules for statutory testing of vessels. | | 第八条 购置外国籍船舶或者以光船租赁条件租赁外国籍船舶从事水路运输，船舶必须符合本规定附录规定的购置、光租外国籍船舶的船龄要求，其船体、主要机电设备和安全、防污染设备等应当符合船舶法定检验技术规则。 |
With respect to the vessels of foreign nationality as purchased or chartered by demise, the hulls thereof shall meet the requirements prescribed in the Regulations for the Prevention of Pollution by Oil, Annex I of the Protocol of 1978 Relating to the 1973 International Convention for the Prevention of Pollution From Vessels. | |
购置、光租外国籍油船，其船体应当符合《经1978年议定书修订的1973年国际防止船舶造成污染公约》附则I《防止油类污染规则》规定的要求。 |

| Article 9 The “vessels of foreign nationality purchased or chartered under the conditions of bareboat charter” as mentioned in these Provisions shall include the vessels of foreign nationality that have been purchased from abroad or chartered under the conditions of bareboat charter but for which no lawful vessel inspection certificate or certificate of nationality has not been obtained in China, as well as the vessels of foreign nationality that are purchased by way of auction. | | 第九条 本规定所称购置外国籍船舶、以光船租赁条件租赁外国籍船舶，包括已经从国外购置或者以光船租赁条件租赁，但尚未在中国取得合法船舶检验证书、船舶国籍证书的外国籍船舶，以及通过拍卖方式购置的外国籍船舶。 |

| Article 10 No organization or individual can purchase any discarded steel vessel of foreign nationality for waterborne transport, nor may it charter any discarded steel vessel of foreign nationality under the conditions of bareboat charter for waterborne transport. | | 第十条 任何组织和个人不得购置外国籍废钢船从事水路运输，也不得以光船租赁条件租赁外国籍废钢船从事水路运输。 |
| |
|
| Article 11 Those vessels of foreign nationality that exceed the age for discarding as prescribed in these Provisions shall not be used for waterborne transport. | | 第十一条 超过本规定报废船龄的外国籍船舶不得从事国内水路运输。 |
| |
|
| Article 12 Where a vessel of foreign nationality that is purchased or chartered under the condition of bareboat charter is changed into a vessel of Chinese nationality for waterborne transport, the purchaser or charterer shall know the age and technical situation of the vessel, and shall go through the relevant formalities according to the following procedures: | | 第十二条 购置外国籍船舶或者以光船租赁条件租赁外国籍船舶改为中国籍船舶经营水路运输，购置人、承租人应当了解船舶的船龄和技术状况，并按下列程序办理有关手续： |

| (1)Before the purchase or bareboat charter of a vessel of foreign nationality that is classified into Class I, II or III, the purchaser or charterer shall file an application for enhancing transport capacity with the competent communications administrative department of the local people's government at or above the county level, and report the application to the Ministry of Communications for approval; | | （一）购置或光租外国籍一、二、三类船舶前，应当按照国家有关规定向县级以上地方人民政府交通运输主管部门提出增加运力的申请，并报经交通运输部批准； |
| |
|
| (2)After the purchase or bareboat charter of a vessel of foreign nationality under the conditions of bareboat charter, the purchaser or charterer shall apply for initial inspection to the vessel inspection institution as recognized by the maritime affairs administrative department, and obtain a vessel inspection certificate; | | （二）购置外国籍船舶或者以光船租赁条件租赁外国籍船舶后，应依法向海事管理机构认可的船舶检验机构申请初次检验，取得其签发的船舶检验证书； |

(3)After a vessel inspection certificate is obtained for the vessel of foreign nationality as purchased or chartered by demise under the conditions of bareboat charter, the purchaser or charterer shall apply to the maritime affairs administrative department for registration of the vessel or bareboat charter, obtain a vessel title registration certificate, a certificate of nationality of the vessel or registration certificate of bareboat charter and an interim certificate of nationality of the vessel; and
