To further regulate community correction and strengthen and innovate on the management of particular groups, in accordance with the overall arrangements made by the CPC Central Committee on deepening the reform of the judicial system and the work mechanism, and through conducting in-depth investigations, research and demonstration, and extensively soliciting opinions, the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security and the Ministry of Justice jointly formulated the Measures for the Implementation of Community Correction, which are hereby issued for your diligent implementation. Please report in a timely manner the implementation circumstances and the problems encountered to the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security and the Ministry of Justice respectively. | |

| Article 1 To regulate the implementation of community correction pursuant to law and transform persons subject to community correction into law-abiding citizens, these Measures are formulated in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China and other relevant legal provisions, and in consideration of the actual circumstances of community correction. | | 第一条 为依法规范实施社区矫正，将社区矫正人员改造成为守法公民，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》等有关法律规定，结合社区矫正工作实际，制定本办法。 |

| Article 2 Administrative organs of justice shall be responsible for guiding, managing and organizing the implementation of community correction. | | 第二条 司法行政机关负责指导管理、组织实施社区矫正工作。 |
The people's courts shall, pursuant to law, make judgments, rulings or decisions against the defendants and convicts who meet the applicable conditions for community correction. | |
人民法院对符合社区矫正适用条件的被告人、罪犯依法作出判决、裁定或者决定。 |
The people's procuratorates shall, pursuant to law, conduct legal supervision over all law enforcement links of community correction. | |

Public security organs shall, in a timely manner and pursuant to law, punish persons subject to community correction who violate any provision on public security administration or commit new crimes. | |

| Article 3 Community correction institutions under administrative organs of justice at the county level shall supervise, manage, educate and assist persons subject to community correction. Justice offices shall undertake routine work on community correction. | | 第三条 县级司法行政机关社区矫正机构对社区矫正人员进行监督管理和教育帮助。司法所承担社区矫正日常工作。 |
Social workers and volunteers shall participate in community correction under the organization and guidance of community correction institutions. | |
社会工作者和志愿者在社区矫正机构的组织指导下参与社区矫正工作。 |
The relevant departments, villagers' (residents') committees, entities where persons subject to community correction work, schools where such persons study and their family members, guardians or sureties shall assist community correction institutions in conducting community correction. | |
有关部门、村（居）民委员会、社区矫正人员所在单位、就读学校、家庭成员或者监护人、保证人等协助社区矫正机构进行社区矫正。 |

| Article 4 Where any people's court, people's procuratorate, public security organ or prison needs to investigate the effect of a defendant or convict to whom community correction applies on the community where such defendant or convict resides, the said organ may delegate the administrative organ of justice at the county level to conduct investigation and appraisal. | | 第四条 人民法院、人民检察院、公安机关、监狱对拟适用社区矫正的被告人、罪犯，需要调查其对所居住社区影响的，可以委托县级司法行政机关进行调查评估。 |
The delegated administrative organ of justice shall, in accordance with the requirements of the delegating organ, investigate and obtain information on the defendant or convict's residence, family and social relations, consistent performance, consequences and effects of criminal acts, the opinions of the victim and the residents' (villagers') committee where the defendant or convict resides, and the matters to be prohibited, form appraisal opinions, and report such opinions to the delegating organ in a timely manner. | |
受委托的司法行政机关应当根据委托机关的要求，对被告人或者罪犯的居所情况、家庭和社会关系、一贯表现、犯罪行为的后果和影响、居住地村（居）民委员会和被害人意见、拟禁止的事项等进行调查了解，形成评估意见，及时提交委托机关。 |

| Article 5 For a convict to whom community correction applies, the people's court, public security organ or prison shall verify his or her residence, and before pronouncing the judgment or before the convict leaves prison, notify the convict in writing of the time limit for registering at the county-level administrative organ of justice at the place where the convict resides and the consequences of registration beyond the time limit, and notify the county-level administrative organ of justice at the place where the convict resides; and within three working days after the judgment or ruling comes into force, serve the duplicates of the written judgment, written ruling, written decision, enforcement notice, parole certificate or any other legal documentation, and at the same time, send a copy thereof to the county-level people's procuratorate and public security organ at the place where the convict resides. The administrative organ of justice at the county level shall serve a return of service within three working days after receiving such legal documentation. | | 第五条 对于适用社区矫正的罪犯，人民法院、公安机关、监狱应当核实其居住地，在向其宣判时或者在其离开监所之前，书面告知其到居住地县级司法行政机关报到的时间期限以及逾期报到的后果，并通知居住地县级司法行政机关；在判决、裁定生效起三个工作日内，送达判决书、裁定书、决定书、执行通知书、假释证明书副本等法律文书，同时抄送其居住地县级人民检察院和公安机关。县级司法行政机关收到法律文书后，应当在三个工作日内送达回执。 |

| Article 6 The person subject to community correction shall register at the county-level administrative organ of justice at the place where the person resides within 10 days from the date when the judgment or ruling of the people's court comes into force or the person leaves the prison. The administrative organ of justice at the county level shall handle registration and reception formalities for the person in a timely manner and notify the person to receive community correction at the designated office of justice within three days. Where the administrative organ of justice finds that the person subject to community correction fails to register within the prescribed time limit, it shall organize a search in a timely manner, and notify the decision-making organ. | | 第六条 社区矫正人员应当自人民法院判决、裁定生效之日或者离开监所之日起十日内到居住地县级司法行政机关报到。县级司法行政机关应当及时为其办理登记接收手续，并告知其三日内到指定的司法所接受社区矫正。发现社区矫正人员未按规定时间报到的，县级司法行政机关应当及时组织查找，并通报决定机关。 |
The person subject to community correction who is temporarily approved to serve a sentence outside of prison shall be escorted to his or her residence by the prison or detention house in charge of delivering the person for enforcement, and the prison or detention house shall handle hand-over formalities with the administrative organ of justice at the county level. Where the person serves a sentence and resides in a different province, autonomous region or municipality directly under the Central Government, and it is necessary to subject the person to temporary service of a sentence outside of prison at the place of his or her residence, the provincial prison administrative organ or the prison administrative department of the public security organ at the place where the person is serving the sentence shall notify in writing the prison administrative organ or the prison administrative department of the public security organ at the same level where the convict resides, asking the latter to designate a prison or detention house to receive the convict's files and be responsible for handling the formalities for taking into custody or releasing the convict. Where the people's court decides to subject the person to temporary service of a sentence outside of prison, it shall notify the county-level administrative organ of justice at the place where the convict resides to dispatch a person to handle hand-over formalities at the court. | |
暂予监外执行的社区矫正人员，由交付执行的监狱、看守所将其押送至居住地，与县级司法行政机关办理交接手续。罪犯服刑地与居住地不在同一省、自治区、直辖市，需要回居住地暂予监外执行的，服刑地的省级监狱管理机关、公安机关监所管理部门应当书面通知罪犯居住地的同级监狱管理机关、公安机关监所管理部门，指定一所监狱、看守所接收罪犯档案，负责办理罪犯收监、释放等手续。人民法院决定暂予监外执行的，应当通知其居住地县级司法行政机关派员到庭办理交接手续。 |

| Article 7 The office of justice shall, after accepting the person subject to community correction, announce in a timely manner to the person subject to community correction the main content of the written judgment, written ruling, written decision, enforcement notice and other relevant legal documentation; the time limit for community correction; the provisions that the person subject to community correction shall abide by, the matters to be prohibited and the legal consequences of violations; the legal and restricted rights of the person subject to community correction; the composition and functions of the members of the community correction team, and other relevant matters. | | 第七条 司法所接收社区矫正人员后，应当及时向社区矫正人员宣告判决书、裁定书、决定书、执行通知书等有关法律文书的主要内容；社区矫正期限；社区矫正人员应当遵守的规定、被禁止的事项以及违反规定的法律后果；社区矫正人员依法享有的权利和被限制行使的权利；矫正小组人员组成及职责等有关事项。 |
The announcement shall be presided over by the personnel of the office of justice and proceed under the prescribed procedures with the presence of the members of the community correction team and other relevant personnel. | |

| Article 8 The office of justice shall determine a special community correction team for the persons subject to community correction. The correction team shall be led by the personnel of the office of justice as the team leader and consist of the relevant personnel listed in paragraphs 2 and 3 of Article 3 of these Measures. Where the person subject to community correction is female, there shall be a female member(s) in the correction team. | | 第八条 司法所应当为社区矫正人员确定专门的矫正小组。矫正小组由司法所工作人员担任组长，由本办法第三条第二、第三款所列相关人员组成。社区矫正人员为女性的，矫正小组应当有女性成员。 |
The office of justice shall sign a community correction responsibility statement with the community correction team, and according to the entities and the status of team members, specify their respective responsibilities and obligations, so as to ensure the implementation of all correction measures. | |
司法所应当与矫正小组签订矫正责任书，根据小组成员所在单位和身份，明确各自的责任和义务，确保各项矫正措施落实。 |

| Article 9 The office of justice shall make a correction plan for the persons subject to community correction, and on the basis of the comprehensive analysis of the type of sentence imposed, the criminal acts, displays of remorse, personality traits and living environment of the persons subject to community correction, formulate relevant supervision, education and assistance measures; and make adjustments at appropriate times according to the results from the implementation of the correction plan. | | 第九条 司法所应当为社区矫正人员制定矫正方案，在对社区矫正人员被判处的刑罚种类、犯罪情况、悔罪表现、个性特征和生活环境等情况进行综合评估的基础上，制定有针对性的监管、教育和帮助措施。根据矫正方案的实施效果，适时予以调整。 |

| Article 10 The administrative organ of justice at the county level shall keep files on the implementation of community correction for the persons subject to community correction, including legal documentation on the application of community correction, and relevant legal documentation on the implementation of community correction such as that on reception, supervision, examination and approval, punishment, commitment to custody and cancellation of community correction. | | 第十条 县级司法行政机关应当为社区矫正人员建立社区矫正执行档案，包括适用社区矫正的法律文书，以及接收、监管审批、处罚、收监执行、解除矫正等有关社区矫正执行活动的法律文书。 |
The office of justice shall keep files on community correction, including the work records of the office of justice and the correction team on community correction and the relevant materials on the acceptance of community correction by the persons subject to community correction. Duplicates of the files on community correction shall be concurrently kept. | |
司法所应当建立社区矫正工作档案，包括司法所和矫正小组进行社区矫正的工作记录，社区矫正人员接受社区矫正的相关材料等。同时留存社区矫正执行档案副本。 |

| Article 11 The persons subject to community correction shall, on a regular basis, report to the office of justice information on the compliance with discipline and laws, the acceptance of supervision and administration, as well as the participation in education and study, community services and social activities. In the case of any change in residence, work change, a major family change or contact with any person that may have adverse effects on the correction thereof, the person subject to community correction shall make reports in a timely manner. | | 第十一条 社区矫正人员应当定期向司法所报告遵纪守法、接受监督管理、参加教育学习、社区服务和社会活动的情况。发生居所变化、工作变动、家庭重大变故以及接触对其矫正产生不利影响人员的，社区矫正人员应当及时报告。 |
The person subject to community correction who is released on bail for medical treatment shall report to the office of justice his or her health conditions on a monthly basis, and submit the illness reexamination information to the office of justice every three months. | |
保外就医的社区矫正人员还应当每个月向司法所报告本人身体情况，每三个月向司法所提交病情复查情况。 |

| Article 12 Where the person subject to community correction needs to enter a particular region or place to which access is subject to approval as determined in an order of the people's court, approval must be obtained from the administrative organ of justice at the county level and the people's procuratorate shall be notified. | | 第十二条 对于人民法院禁止令确定需经批准才能进入的特定区域或者场所，社区矫正人员确需进入的，应当经县级司法行政机关批准，并告知人民检察院。 |
