| Measures for the Administration of the Issuance of the Bidding Announcements and Publication Information | | 招标公告和公示信息发布管理办法 |
| Article 1 For the purposes of regulating the activities of issuing bidding announcements and publication information and ensuring various market participants' and the public's equal, convenient and accurate access to the bidding information, these Measures are developed in accordance with the Bidding Law of the People's Republic of China, the Regulation on the Implementation of the Bidding Law of the People's Republic of China and other relevant laws and regulations. | | 第一条 为规范招标公告和公示信息发布活动，保证各类市场主体和社会公众平等、便捷、准确地获取招标信息，根据《中华人民共和国招标投标法》《中华人民共和国招标投标法实施条例》等有关法律法规规定，制定本办法。 |
| Article 2 For the purpose of these Measures, bidding announcement and publication information means the pre-qualification announcement, bidding announcement, announcement of bid winner candidates, announcement of bid winning results and other information. | | 第二条 本办法所称招标公告和公示信息，是指招标项目的资格预审公告、招标公告、中标候选人公示、中标结果公示等信息。 |
| Article 3 Except the contents required to be kept confidential according to the law or involving trade secrets, the bidding announcement and publication information on projects for which bidding is required according to the law shall be announced to the public according to the law under the principles of public service, openness and transparency, efficiency, convenience and centralized sharing. | | 第三条 依法必须招标项目的招标公告和公示信息，除依法需要保密或者涉及商业秘密的内容外，应当按照公益服务、公开透明、高效便捷、集中共享的原则，依法向社会公开。 |
| Article 4 The National Development and Reform Commission (“NDRC”) shall, according to the laws and regulations on bidding, supervise and manage the issuance of the information through the media issuing the bidding announcement and publication information on projects for which bidding is required according to the law. | | 第四条 国家发展改革委根据招标投标法律法规规定，对依法必须招标项目招标公告和公示信息发布媒介的信息发布活动进行监督管理。 |
| The development and reform departments at the provincial level shall supervise and manage the issuance of the bidding announcement and publication information within their respective administrative regions according to the law, except as otherwise prescribed by the provincial people's governments. | | 省级发展改革部门对本行政区域内招标公告和公示信息发布活动依法进行监督管理。省级人民政府另有规定的，从其规定。 |
| Article 5 The pre-qualification announcement and bidding announcement of the projects for which bidding is required according to the law shall specify the following contents: | | 第五条 依法必须招标项目的资格预审公告和招标公告，应当载明以下内容： |
| (1) the name, contents, scope, scale and source of funds of a bidding project; | | （一）招标项目名称、内容、范围、规模、资金来源； |
| (2) the requirements for bidding qualification and whether to accept bidding of a consortium; | | （二）投标资格能力要求，以及是否接受联合体投标； |
| (3) the time and method of obtaining pre-qualification documents or bidding documents; | | （三）获取资格预审文件或招标文件的时间、方式； |
| (4) the deadline and method of submitting the pre-qualification documents and bids; | | （四）递交资格预审文件或投标文件的截止时间、方式； |
| (5) the name, address, contact person and contact information of the employer and its bidding agency; | | （五）招标人及其招标代理机构的名称、地址、联系人及联系方式； |
| (6) the website and method that a potential bidder visits the electronic bidding transaction platform by electronic bidding; and | | （六）采用电子招标投标方式的，潜在投标人访问电子招标投标交易平台的网址和方法； |
| (7) other contents to be specified according to the law. | | （七）其他依法应当载明的内容。 |
| Article 6 An announcement of bid winner candidates for a project for which bidding is required according to the law shall specify the following contents: | | 第六条 依法必须招标项目的中标候选人公示应当载明以下内容： |
| (1) the ranking, names, bid offers, quality, construction period (delivery period) and bid evaluation situation of bid winner candidates; | | （一）中标候选人排序、名称、投标报价、质量、工期（交货期），以及评标情况； |
| (2) the names of persons in charge of project pledged by bid winner candidates as required by bidding documents, and the names and numbers of their relevant certificates; | | （二）中标候选人按照招标文件要求承诺的项目负责人姓名及其相关证书名称和编号； |
| (3) the qualifications and capacities of bid winner candidates for responding to the requirements of the bidding documents; | | （三）中标候选人响应招标文件要求的资格能力条件； |
| (4) channels and methods of raising objections; and | | （四）提出异议的渠道和方式； |
| (5) other contents required to be announced by the bidding documents. | | （五）招标文件规定公示的其他内容。 |
| An announcement of bid winning results for a project for which bidding is required according to the law shall specify the name of the bid winner. | | 依法必须招标项目的中标结果公示应当载明中标人名称。 |
| Article 7 The bidding announcement and publication information on a project for which bidding is required according to the law shall be developed according to the relevant laws and regulations on bidding and the standard documents developed by the NDRC in conjunction with the relevant departments in a standard and model manner. | | 第七条 依法必须招标项目的招标公告和公示信息应当根据招标投标法律法规，以及国家发展改革委会同有关部门制定的标准文件编制，实现标准化、格式化。 |
| Article 8 The bidding announcement and publication information on a project for which bidding is required according to the law shall be issued on the “China Tendering and Bidding Public Service Platform” or the provincial public service platform for electronic bidding in the place where the project is located (hereinafter collectively referred to as the “issuance media”). | | 第八条 依法必须招标项目的招标公告和公示信息应当在“中国招标投标公共服务平台”或者项目所在地省级电子招标投标公共服务平台（以下统一简称“发布媒介”）发布。 |
Article 9 The provincial public service platform for electronic bidding shall be connected with the “China Tendering and Bidding Public Service Platform,” and concurrently exchange bidding announcement and publication information as required. For bidding announcement and publication information on a project for which bidding is required according to the law, the issuance media shall share information with the corresponding platform for transaction of public resources.
