The Regulation on the Administration of Administrative Divisions, as adopted at the 193rd executive meeting of the State Council on November 22, 2017, is hereby issued, and shall come into force on January 1, 2019. 《行政区划管理条例》已经2017年11月22日国务院第193次常务会议通过,现予公布,自2019年1月1日起施行。

Regulation on the Administration of Administrative Divisions 行政区划管理条例
Article 1 This Regulation is developed in accordance with the Constitution of the People's Republic of China, and the relevant provisions of the Organic Law of the Local People's Congresses at All Levels and Local People's Governments at All Levels of the People's Republic of China and the Law of the People's Republic of China on Regional National Autonomy for the purpose of strengthening the administration of administrative divisions.   第一条 为了加强行政区划的管理,根据《中华人民共和国宪法》和《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》、《中华人民共和国民族区域自治法》的有关规定,制定本条例。
Article 2 The administration of administrative divisions shall strengthen the leadership of the Communist Party of China and reinforce the top-level planning. The administrative divisions shall remain stable on the whole. When it is necessary to make alterations thereto, the principles of being conducive to the construction of socialist modernization, the promotion of national governance system and modernized governance capabilities, administrative management, ethnic solidarity, and the consolidation of national defense shall be centered on, the guidelines of complying with the national development strategy and economic and social development, focusing on the overall plan of the rural and urban areas and the regional coordination, pushing forward the integration of rural and urban development, and advancing the harmonious relationship between humans and nature shall be upheld, and plans for alteration shall be made and reported level by level for approval. The major adjustment to administrative divisions shall be reported to the CPC Central Committee in a timely manner.   第二条 行政区划管理工作应当加强党的领导,加强顶层规划。行政区划应当保持总体稳定,必须变更时,应当本着有利于社会主义现代化建设、有利于推进国家治理体系和治理能力现代化、有利于行政管理、有利于民族团结、有利于巩固国防的原则,坚持与国家发展战略和经济社会发展水平相适应、注重城乡统筹和区域协调、推进城乡发展一体化、促进人与自然和谐发展的方针,制订变更方案,逐级上报审批。行政区划的重大调整应当及时报告党中央。
Article 3 The establishment and cancellation of administrative divisions, and the alteration of subordination relationship or administrative boundaries shall take into consideration economic development, resources and environment, culture and history, topography and landforms, governance capabilities, and other conditions; when the location of a people's government is altered, the allocation of resources shall be optimized and the provision of public services shall be facilitated; when the names of administrative divisions are altered, the new names shall embody the characteristics of local history, culture and geography.   第三条 行政区划的设立、撤销以及变更隶属关系或者行政区域界线时,应当考虑经济发展、资源环境、人文历史、地形地貌、治理能力等情况;变更人民政府驻地时,应当优化资源配置、便于提供公共服务;变更行政区划名称时,应当体现当地历史、文化和地理特征。
Article 4 The civil affairs department of the State Council shall be responsible for the specific administration of administrative divisions throughout the country, and other relevant departments of the State Council shall perform the administration in relation to the administrative divisions nationwide according to their respective functions and duties.   第四条 国务院民政部门负责全国行政区划的具体管理工作。国务院其他有关部门按照各自职责做好全国行政区划相关的管理工作。
The civil affairs departments of local people's governments at the county level or above shall be responsible for the specific administration of administrative divisions within their respective administrative regions, and other relevant departments of local people's governments at the county level or above shall perform the administration in relation to the administrative divisions within their respective regions according to their respective functions and duties. 县级以上地方人民政府民政部门负责本行政区域行政区划的具体管理工作。县级以上地方人民政府其他有关部门按照各自职责做好本行政区域行政区划相关的管理工作。
Article 5 The people's government at the county level or above shall strengthen its leadership in the administration of administrative divisions, include the administrative division tasks in the national economic and social development plan, and incorporate the administration cost of administrative divisions in its budget.   第五条 县级以上人民政府应当加强对行政区划管理工作的领导,将行政区划工作纳入国民经济和社会发展规划,将行政区划的管理工作经费纳入预算。
Article 6 The establishment, cancellation and renaming of a province, an autonomous region or a municipality directly under the Central Government shall be reported to the National People's Congress for approval.   第六条 省、自治区、直辖市的设立、撤销、更名,报全国人民代表大会批准。
Article 7 The alteration of the following administrative divisions shall be subject to the approval by the State Council:   第七条 下列行政区划的变更由国务院审批:
1. The alteration of administrative boundaries of a province, an autonomous region or a municipality directly under the Central Government, relocation of a people's government, and alteration of abbreviation and ranking order of administrative divisions.
