为依法惩治有关环境污染犯罪行为，根据刑法有关规定，现就审理这类刑事案件具体应用法律的若干问题解释如下： |
In order to punish the criminal activities of environmental pollution, the interpretation on some issues concerning the specific application of law in the trial of such criminal cases is hereby given as follows according to the relevant provisions of the Criminal Law: | |

| | 第一条 具有下列情形之一的，属于刑法第三百三十八条、第三百三十九条和第四百零八条规定的“公私财产遭受重大损失”： |
| Article 1 Any case under any of the following circumstances, shall be one that "leads to heavy losses of public or private property" as prescribed in Article 338, 339 and 408 of the Criminal Law: | |
|
| | （一）致使公私财产损失三十万元以上的； |
| (1) Causing a loss of public or private property of more than 300,000 Yuan; | |
|
| | （二）致使基本农田、防护林地、特种用途林地五亩以上，其他农用地十亩以上，其他土地二十亩以上基本功能丧失或者遭受永久性破坏的； |
| (2) Causing a loss of fundamental functions of, or permanent destructions to, 5 mu or more of the basic farmland, shelter forestland, or special-purpose forestland; or 10 mu or more of other farmlands; or 20 mu or more of other lands; | |
|
| | （三）致使森林或者其他林木死亡五十立方米以上，或者幼树死亡二千五百株以上的。 |
| (3) Causing the death of 50 m3 or more of forests or other woods; or 2500 young trees or more; | |

| | 第二条 具有下列情形之一的，属于刑法第三百三十八条、第三百三十九条和第四百零八条规定的“人身伤亡的严重后果”或者“严重危害人体健康”：
